Bayview Road (Shellfisher Preserve),the request for a side yard setback variance pertains to an existing as-built structure that does not conform to current zoning requirements. The property is situated on a coastal parcel characterized by generally level to gently undulating terrain, with natural environmental constraints common to waterfront areas in the Town of Southold. These conditions include low-lying elevations, potential wet or seasonally saturated soils, and proximity to regulated coastal or environmentally sensitive areas,which collectively limit the available buildable area on the lot. The existing structure, as constructed, reflects practical site constraints at the time of placement, including the limited buildable envelope, lot configuration, and efforts to avoid disturbance of environmentally sensitive areas and maintain appropriate drainage patterns. Due to these constraints,the structure was located in a position that resulted in a nonconforming side yard setback under current zoning regulations. Strict enforcement of the side yard setback requirement in this instance would impose a practical hardship, as relocation or modification of the existing structure would be unreasonable and could result in unnecessary environmental disturbance, increased noncompliance with other regulatory buffers, or substantial structural impact. The requested variance seeks to acknowledge the existing condition while minimizing further impact to the site and maintaining consistency with the surrounding residential neighborhood character. Accordingly, approval of the requested side yard setback variance is necessary to recognize the existing as-built condition and allow reasonable use of the property without imposing undue hardship.
