Upon the application of ABBY ROSMARIN filed pursuant to 19 NYCRR 1205 on May 13, 2025,
and upon all other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
This petition pertains to the pool barrier height of a detached one- or two-family dwelling located at
640 Lloyds Lane,Town of Southold, County of Suffolk, State of New York.
Relief is requested from:
19 NYCRR Part 1220,The 2020 Residential Code of New York State, Section R326.4.2.1,
Barrier height and.clearanoes, provided as follows:The topJof the barrier shall be no less than 48
inches above grade measured on the side of the barrier that faces away from the swimming pool.
[The petitioner requests having a portion of a pool barrier with a height that is less than allowed.]
FINDINGS OF FACT
1. Petition pertains to the installation of a pool behind a one-family dwelling that has an otherwise
complying fence around the grade level of the pool and uses the dwelling as part of the pool barrier.
2. The applicant is providing a permanent barrier complying with Sections R326.4.2.1 through
R326.4.2.6, however there is a raised patio overlooking the pool that is 8 feet above the pool grade
level that has a 3-foot-high glass guard railing along the edge.
3. The 3 foot high guard complies with Section R312.1.2 for walking surfaces more than 30 inches
above the grade below and the 8 foot drop to the pool level is considered a sufficient preventive.
4. The dwelling will be utilized by persons familiar with their surroundings who can take necessary
precautions in the pool area.
5. The local code official has been contacted in this matter and supports the granting of a routine
variance by the Department of State in this matter.

CONCLUSION OF LAW
The proposed variance will not substantially adversely affect the Code's provisions for health, safety,
and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building code would
entail practical difficulties or unnecessary hardship and would otherwise be unwarranted because such

DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220,The
2020 Residential Code of New York State, Section R326.4.2.1, be and is hereby proposed to be
GRANTED,with the following conditions:
1. That a permanent barrier complying with Sections R326.4.2.1 through R326.4.2.6 shall be
installed around the remainder of the pool.
2. That in all other respects the applicable requirements of the Uniform Code shall be satisfied.
This DECISION is issued under 19 NYCRR 1205:5 unless objected to by the petitioner in a writing
received by the department, the decision shall become FINAL after fifteen days of receipt of the decision
by the parties.
This decision is limited to the specific building and application before it, as contained within the
petition, and should not be interpreted to give implied approval of any general plans or specifications
presented in support of this application.
