This application is for the as-built in-place reconstruction of the existing 545 sq. ft.
raised deck with landward 4' wide stairs to a 4'x4' landing to 4' wide stairs to ground,
and seaward 4' wide set of stairs to ground.
The proposed action has been reviewed to Chapter 258, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy standards.
Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the policies of the
LWRP as follows:
Policy 4 Minimize loss of life structures, and natural resources from flooding and
erosion
4.2 Protect and restore natural protective features.
Natural protective geologic features provide valuable protection and should be

protected, restored and enhanced. Destruction or degradation of these features should
be discouraged or prohibited.
Policy 6. Protect and restore the quality and function of the Town of Southold's
ecosystem.
6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other lands
under their jurisdiction.
The site inspection revealed a concrete pad under the deck and a wooden walkway
through the dune, a natural protective feature pursuant to Town Code §111-6
Definitions. These are inconsistent with Policy 4.2 which calls for no development in
natural protective feature areas and the avoidance of the alteration/interference of a
shoreline in its natural condition.
The proposed as-built in-place deck is inconsistent with Policy 6.3A because the
structure was constructed without regulatory permits.
This project could be deemed consistent if the concrete pad underneath the deck and
the wooden walkway through the dune are removed, and all regulatory permits for the
deck are obtained.
The proposed action has been reviewed to Chapter §268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LwRP) Policy Standards.
