Box 1179 Eric Sepenoski Southold, New York 11971 Liz Gillooly Telephone(631) 765-1892 Joseph Finora ® Fax(631) 765-6641 �CNTV, BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD June 15, 2026 Dominic Mavellia 541 Caledonia Road Dix Hills, NY 11746 RE: JULIA MAVELLIA 1525 NORTH SEA DRIVE, SOUTHOLD SCTM# 1000-54-4-17 Dear Mr. Mavellia: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 10, 2026 regarding the above matter: WHEREAS, Dominic Mavellia on behalf of JULIA MAVELLIA applied to the Southold Town Trustees for a permit under the provisions of Chapter 111 of the Southold Town Code, the Coastal Erosion Hazard Areas Ordinance of the Town of Southold, application dated May 15, 2026; and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP under Policy 4.2 - Protect and restore natural protective features as the concrete pad under the deck and wooden walkway are through the dune, which is a natural protective feature; and Policy 6.3A — Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction, as the structures do not have a permit; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 10, 2026, at which time all interested persons were given an opportunity to be heard; and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and, WHEREAS, the proposal of JULIA MAVELLIA for the as-built in-place reconstruction of the existing 645sq.ft. raised deck with landward 4' wide stairs to a 4'x4' landing to 4' wide stairs to ground, and seaward 4' wide set of stairs to ground; and, 2 WHEREAS, the 645sq.ft. raised deck is larger than what is permitted under Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas; and, NOW THEREFORE BE IT RESOLVED, that the Board of Trustees DENIES the application of JULIA MAVELLIA for the as-built in-place reconstruction of the existing 645sq.ft. raised deck with landward 4' wide stairs to a 4'x4' landing to 4' wide stairs to ground, and seaward 4' wide set of stairs to ground; and as depicted on the site plan prepared by Charles W. Kuehn, Architect, received on April 29, 2026; and, This determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Back then there was no North Sea Drive. My beachfront lot abuts Ms. Marvellia's. She has been a kind and thoughtful neighbor, respectful of my property as she is of her own. Julia is one of the few homes that has not given into the Big House explosion. In fact, all she requests is approval of her small deck. I can see it from atop my property. It is esthetically pleasing and in keeping with the old neighborhood. I hope you will approve her request. Being 97, 1 regret I cannot be there in person to support my friend. Access to your meeting from my home would have been the only way I could participate. She has been instrumental in helping save the piping plover on her beach. While many of her neighbors have obstructed and rejected attempts to protect these federally protected, endangered birds, Mrs. Marvellia embraced the concept of string fencing a portion of her beachfront: a plover nest was found there! For me, this demonstrates her awareness of how important nature plays a part in our lives. By the respect she demonstrates, she is surely a good steward of our biggest Wetland -the Long Island Sound. For this reason, her decks are rebuilt with the care she feels for her landscape.As she respects nature, we should likewise respect her need to observe it from her new decks. Please approve. Natural protective geologic features provide valuable protection and should be protected, restored and enhanced. Destruction or degradation of these features should be discouraged or prohibited. Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The site inspection revealed a concrete pad under the deck and a wooden walkway through the dune, a natural protective feature pursuant to Town Code §111-6 Definitions. These are inconsistent with Policy 4.2 which calls for no development in natural protective feature areas and the avoidance of the alteration/interference of a shoreline in its natural condition. The proposed as-built in-place deck is inconsistent with Policy 6.3A because the structure was constructed without regulatory permits. This project could be deemed consistent if the concrete pad underneath the deck and the wooden walkway through the dune are removed, and all regulatory permits for the deck are obtained.
