Box 1179 Southold, NY 11971 Re: Deborah Colitti 720 Second Street, New Suffolk, NY 11956 SCTM: 1000-117.00-08.00-013.000 Narrative to the application To Zoning Board of Appeals, The applicant respectfully submits this application seeking an area variance for the Accessory Dwelling Unit(ADU) located in the basement of the primary dwelling located at 720 Second Street, New Suffolk. The applicant submits that the existing ADU was constructed without the benefit of permit about 25 years ago by the previous owners. In effort to legalize the as-built work, we received a denial letter dated April 17, 2026 stating that the proposed ADU is 64.6% of the existing portion of the dwelling. This is in conflict with the Town Code Article X Section 280-45 (C) (2) (f), which states that the apartment(s) shall not comprise more than 50% of the principal building. It is our belief that the intent of the 50% limitations was to prevent oversized ADUs being constructed. Here,we battle the opposite case, where the percentage is calculated based on the very small dwelling. The principal building, in this case, is a very modest structure, only 1,128.9 sf large, containing kitchen, living room, and dining room within one open space, two bedrooms and two bathrooms. The house is indeed unpretentious, in character with the neighborhood. Accordingly, the constructed ADU is also very modest, 729 sf large, containing one bedroom, bathroom, and living room connected with the kitchen. But even given the simple layout, the apartment exceeds the allowed size by 164.55 sf. The largest allowed apartment would be 564.45 sf. When exploring the alternatives of avoiding ZBA review, the owner could enlarge the primary dwelling by 329.1 sf for a total of 1,458 sf. This enlargement of the building would avoid the need for the area variance for ADU. However, the owner is not in need of any additional space for herself.Additionally, this enlargement would most likely also require ZBA area variance, since the dwelling encroaches into the front yard setback. Town;Law 267-b b Grant of the relief granted herein will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject neighborhood consists of single- family homes. Seasonal cottages and year-round cottages which are accessory to dwellings are not characteristic of the subject neighborhood. However,these accessory seasonal cottages legally exist and improving the cottages with wall mounted air conditioning units will not alter the seasonal nature of the cottages pre-existing non-conforming use. Improving the cottages with heat will change the use of the cottages and change the character of the neighborhood because the cottages will now be used year-round instead of seasonally 2. Town Law 267-b h 2 . The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than the granting of relief by the Board of Appeals since adding heating and/or wall mounted air conditioned is in violation of the pre-existing certificate of occupancy for the subject dwelling and three accessory seasonal cottages. 3. Town Law 267- , The relief granted herein is not substantial, because adding wall mounted air conditioning units to the three seasonal cottages will not change the pre-existing non-conforming seasonal use of the cottages,while adding a heating system as well will change the pre-existing non-conforming use of the cottages. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest•that;a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's•Storm Water Management Code. However,changing these cottages to year-round occupancy will exceed septic system density and capacity. The.applicant may require- approval for exceeding density from the Suffolk County.Department of Health Services. 5. -town Law 267--b 3 . The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual-or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase,The applicant purchased the parcel with a single-family dwelling and three seasonal cottages and one storage shed. 6.
