(631) 765-1809 Southold Town Clary FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MAY 21,2026 ZBA FILE: #8097 NAME OF APPLICANT: Soundview Sunsets,LLC PROPERTY LOCATION: 20210 Soundview Avenue, Southold NY SCTM: 1000-51-3-13.2 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, rectangular-shaped, conforming 40,638 square feet, 0.932-acre parcel in the R40 Zoning District measures 100.00 feet along Sound View Avenue,then runs south 377:27 feet along several residentially developed lots accessed via Clark Road, then runs west 112.34 feet along a residentially developed lot to the south and returns north 400.00 feet along a recharge basin, serving the Wildberry Fields subdivision adjacent to Wildberry Lane. The parcel is improved with single-story brick house and attached garage with brick entry stoop,a rear wood deck, steps and stoop leading to the garage,basement access stairs,a frame shed, an in-ground pool with concrete terrace surround, pool equipment, chain link pool fencing, a satellite dish, a tennis court and chain link tennis court fencing,as shown on the survey prepared by Pat Charles Seccafico,Land Surveyor, last dated June 13, 2023. BASIS OF APPLICATION: Request for Variances from Article IV, Section 28-0-18 and the Building Inspector's November 5, 2026, Notice of Disapproval based on an application for a permit to construct additions to a single- family dwelling(per Building Permit#50152 for interior alterations with amendment to include additional work) at: 1)less than the code required minimum front yard setback of 50 feet,2)less than the code required side yard setback of 15 feet; located at: 20210 Soundview Ave Southold,NY. SCTM No. 1000-51-3-13.2. RELIEF REQUESTED: The applicant requests two variances for undeclared `as built' improvements in order to amend Town of Southold Building Permit#50152, which include: LA front yard setback of 45 feet, 5.75 inches where the Code requires a minimum front yard setback of 50 feet for the construction of a second floor including a balcony area over an existing garage, and 2.A side yard setback of 14 feet, 10.75 inches where the Code requires a minimum single side yard setback of 15 feet for the noted improvement. Page 2, May 21,2026 #8097, Soundview Sunsets SCTM No. 1000-51-3-13.2 ADDITIONAL INFORMATION: The applicant provided plans labeled A001,Z100,A101,A102,A301,and A202 prepared by Nicholas J.Mazzaferro, Professional Engineer, dated April 3,2024. The submitted plans(signed copy) include a`bubble note': NOT PERMITED with an `X' over the proposed second floor addition over the garage,the subject of this application. The submitted plans included a blow up of the survey which indicates an existing and conforming front yard setback of 51.6 feet from Sound View Avenue to the northeastern corner of the garage and additionally, indicates a pre-existing, non-conforming side yard setback of 14.8 feet. The second story addition and balcony were built despite the applicant being told, by the Building Department,that it was not permitted under the building permit the applicant hopes to amend. The applicant built the addition over the existing garage, maintaining the existing setbacks; however, the framing of a 4-foot-deep balcony has now established a new, non-conforming 45-foot, 5.75-inch front yard setback. While there is discrepancy between the Town of Southold Building Department Notice of Disapproval(NOD)and the actual survey and design plans relative to the side yard setback (NOD 14 feet, 10.75 inches [14.9 feet] and survey 14.8 feet) for purposes of clarification, this Board will use the lesser side yard setback of 14.8 feet, recognizing the existing structure as recognized by the survey. The applicant seeks to amend building permit #50152, dated December 20, 2023 (previously amended), initially issued for interior alterations,to include the second-floor addition over the existing garage and the cantilevered front balcony. The parcel is the subject of prior Zoning Board of Appeals hearings in file numbers: #2123 dated April 12, 1976; #2851 dated August 27, 1981; and#2929 in 1985. These determinations did not apply to the residence constructed in 1989, but rather applied to the original, larger lot and subdivision of the land and a structure on it and its prior uses. Improvements on the parcel are covered by the following Certificates of Occupancy: #Z18376 dated September 15, 1989 covering a deck addition with an accessory inground pool and fence. #Z18395 dated September 21, 1989 covering an accessory tennis court. #Z18396 dated September 21, 1989 covering an accessory antenna(saucer). #Z18410 dated September 25, 1989 covering a one family dwelling with garage(amended to include deck). No member immediate neighbors or member of the public spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 7, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1.Town Law V67-W)(b)(U. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Sound View Avenue and the surrounding residential area consist of many large homes which have been recently renovated and/or enlarged located on the Long Island Sound or those, like the subject, across the street from waterfront residences, designed to take advantage of water views and sunsets. Two story residences are common to this community and Southold Town in general. The existing residence was built in the late 1980s with a conforming front yard setback of just over 51 feet and a non-conforming, side yard setback of just over 14 feet. The addition of a second floor over the front facing attached garage will not have any impact on the community as the non-code conforming front yard setback of the four-foot deep second floor balcony addition is not discernable to the eye by those using the roadway. The balcony structure is cantilevered over the existing garage fagade with no disturbance to the actual footprint or encroachment upon the existing as built setback. Page 3, May 21,2026 #8097, Soundview Sunsets SCTM No. 1000-51-3-13.2 Likewise, the reduced single side yard setback will also have no impact as there is no additional encroachment upon the as-built, original non-conforming footprint and existing setback. All improvements to the residence requiring Board relief are contained within the existing structure's footprint covered by Town of Southold Certificate of Occupancy#Z 18410. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Any addition to the existing residence, specifically over the garage area,will require a side yard setback variance as the existing structure is built 14.8 feet from the lot line where a minimum of 15 feet is required by code. The applicant can add the second floor without encroaching on the front yard setback, however, the addition of a front facing balcony adds a unique design element to the residence and allows the occupants a possibility to better view the Long Island Sound. 3. Town Law V67-b(3)(b)(3). The variances granted herein are not mathematically substantial, representing 9% relief from the code relative to a reduced front yard setback and 1.3%relief from the code relative to a reduced single side yard setback. The applicant proposes only a modest reduction, representing 9% relief, in order to maintain the `as built' second floor balcony over the existing garage without any encroachment on the pre-existing foundation or its currently non-compliant side yard setback. All proposed work is limited to the second-floor addition over the existing and legally recognized residence without disturbance to the structure's footprint or existing setbacks. 4. Town Law V67-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law V67-b(30)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions to a single-family residence consisting of a second story addition with,a front yard setback of 45 feet, 5.75 inches to accommodate a cantilevered balcony while maintaining a single side yard setback of 14.8 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Steinbugler, and duly carried,to GRANT the variances as applied for, and shown on the design plans labeled A001, Z100, A101, A102, A301, and A202 prepared by Nicholas J. Mazzaferro, Professional Engineer, dated April 3,2024, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The septic system on the subject property must be approved by the Suffolk County Department of Health Services, if applicable. 2. The cantilevered front second-floor balcony may not be roofed over or enclosed and/or conditioned in any way. It is to remain an open-air amenity accessed only via the adjoining bedroom and bathroom. 3. The applicant must submit the required additional Zoning Board of Appeals fee for as built rather than proposed structures requiring variance relief. The construction materials will match to the existing building exterior. 2—The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue other than an area variance,because:The side yard variance is specific to east wall of the existing building. CG:lk ZONING BOARD OF APPEALS FORM ZB4 The following are the findings and determination of the Board: By this appeal, appellant seeks permission to use accessory building for "servants quarters at premises owned by applicant and containing approximately 17 acres. Building permit application dated May 8, 1981 was approved under Permit No. 11152Z for recon- struction of. accessory building for storage purposes. Applicant states that he demolished the accessory building and began to rebuild, for use as a living unit. The rearyard setback of the accessory structure as reconstructed for living use is at or very near the neighboring property line. The sideyard setback is also very near the neighboring property line. The Board does not agree with the reasoning of the applicant. The relief requested is not within the spirit of the zoning ordinance. It is the determination of this:Board that to permit this accessory structure to be used for living facilities would, in effect, allow a use not permitted by the Zoning Code since the result would be to permit two dwellings on one lot. A use vari- ance may only be granted upon proof of hardship, which has not been demonstrated by applicant.
