SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION:The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property consists of a 21,626 square foot parcel located in an R-40 Zoning District. The property has a road frontage of 82.5 feet along Westphalia Road,then turns southwest for 264.00 feet to the rear yard,then turns northwest for 82.50 feet before returning northeast for 264.00 feet back to Westphalia Road: The property is improved with an existing two-story residence and an existing accessory building in the rear yard. All as shown on survey prepared by Jeffrey W. Haderer of Twin Forks Land Surveying last revised December 10,2025. BASIS OF APPLICATION: Applicant requests a Special Exception under Article III, Section 280- 13B(13). The Applicant is owner of the subject property requesting authorization to construct and establish an Accessory Apartment in a proposed (not yet built) accessory structure; at: 1865 Westphalia Road, Mattituck#1000-141-1-4. RELIEF REQUESTED: The applicant requests a special exception to remove an existing accessory building currently in the rear yard and construct a new accessory dwelling unit with an interior livable space of 683 square feet,as noted on the Southold Building Departments Verification of Livable Floor area dated March 12, 2026. Proposed building and site location as per site plan and architectural plans prepared by John Cunniffe, Architect, last revised December 12,2025. ADDITIONAL INFORMATION: The applicant proposes a new accessory dwelling unit under the new Town Code, which permits new buildings for this use. According to the owner's agent, the applicant has Page 2,May 21,2026 #8092SE, Schrank SCTM No. 1000-141-1-4 approval to construct the building. Suffolk County Department of Health Services approval for the accessory dwelling is currently in the permitting process. The proposed basement is intended for utilities and storage only; according to the architect, it is listed as an alternate in the bid process. According to the applicant,the proposed tenant is currently listed on the Southold Affordable Housing Registry. The Board noted that the proposed basement access stair would be problematic for approval and requested that it be changed to a Bilco-type door. The architect agreed to that change. A neighbor spoke at the hearing and asked the homeowner to provide screening, such as a fence, between the subject property and his property. Both the architect and the homeowner agreed that a fence between the properties could be installed for screening. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 2,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article 1I1, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. The architectural plans prepared by John Cunniffe Architect and dated December 12, 2025 proposes an accessory apartment with one full bathroom entirely on the first floor of the accessory structure with a conforming 683 square feet of livable floor area, as verified by the Building Department's "Verification of Livable Floor Area"request by the ZBA dated March 12,2026. 2. The dwelling unit complies with the definition of same in §280-4 of the code 3. The applicant herein owns and resides at the property as documented by drivers license, utility bills, and tax receipts and confirms that: occupancy of the resident structures on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member, as defined in chapter 280-4. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant testified that the tenant of the accessory apartment will be listed on the Southold Town Affordable Housing Registry as evidenced by testimony at the public hearing. IF A PERSON ELIGIBLE FOR AFFORDABLE HOUSING: Receipt of a letter from the Government Liaison/Manager of the Town's Affordable Housing Registry confirming the eligibility of the proposed tenant and a signed and notarized but undated renewable annual lease along with an affidavit agreeing to submit a signed notarized lease from the proposed tenant with an occupancy start date prior to obtaining the Certificate of Occupancy. 5. The owners' plans comply with the on-site parking requirements of three spaces, two for the principal Page 3,May 21,2026 #8092SE, Schrank SCTM No. 1000-141-1-4 dwelling and one for the accessory apartment, and provide for a total of four parking spaces, as shown on the site plan as prepared by John Cunniffe Architect, dated December 12, 2025. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 8. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations,determinations and findings required in Chapters 280-142(General Standards)and 280-143 (Matters to be Considered)specifically finds and determines the following: 1. That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. 2. That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. 3. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. 4. That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. 5. That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. 6.Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Lehnert, seconded by Member Planamento, and duly carried,to GRANT the Special Exception Permit as applied for, SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3. The applicant shall construct screening fencing along the east side of the property at the area of the accessory dwelling unit. 4. Access to the basement storage shall be by Bilco-type door only. The applicant shall submit written confirmation from the Town's Affordable Housing Coordinator, that the proposed tenant of the accessory apartment is on or eligible to be on the Town's affordable housing registry. 6. The applicant shall submit an executed, notarized lease for the annual rental of the accessory apartment That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein.
