No. # 129 This application is for the ,additions to a two-story dwelling and abandoning the existing septic system to install an 11A oWTS sanitary system. The proposed action is ,also in review with the Southold ZBA for a Bequest for a Variance for exceeding the gross floor area maximum of a single-family residence and not meeting the minimum side yard setback. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town .Code and the Local Waterfront Revitalization Program (LWRP) Policy standards. Based upon the information provided on the LWRP Consistency Assessment Farm submitted to this department, as well as the records available to me, it is my recommendation that the proposed action in INCONSISTENT with the policies of the LWRP as follows: Policy 1: Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. This proposed action is on a nonconforming lot with a pre-existing residence that is less than 100 ft from the wetland boundary of Arshamomaque Pond. Considering that the lot has two waterfront boundaries on the north and west side of the property, all proposed construction is within 100 ft of the wetland boundary. The proposed first floor addition brings the dwelling footprint closer to the western wetland boundary. The proposed action is inconsistent with Policy 1, which states that adverse effects of development should be minimized, because the increased amount of development is within 100 ft of the wetland boundary and will have negative effects on the shoreline. The proposed action is inconsistent with Policy 6.3A, which states that actions must comply with the Southold Town Board of Trustees laws and regulations which include Town Code Chapter 275-3(D)(1)(a)[1] that states the setback for a residence from the wetlands is 100 ft. The proposed residence is less than 100 ft from the wetland boundary. The proposed installation of an Innovative/Alternative Onsite Wastewater Treatment System (I/A OWTS) is consistent with Policy 5.1.C.3 which calls for the modification of existing sewage treatment facilities that improves nitrogen capacity removal and will reduce nutrient input to adjacent waters.
