The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed action is inconsistent with Policy .3A, which states that actions must comply with the Southold Town Board of Trustees laws and regulations in Town Code Chapter 275. The proposed pool is to be placed on the top of a bank, defined in Town Code Chapter 275-2I as land inclined adjoining a body of water, wetland andlor beach and does not comply with Town Code Chapter 275-2D(a)[5] that states a pool must be placed 60ft from the wetland boundary. If a pool is to be built in the future, it is recommended to retain the existing trees in the development area to the extent practical, and to retain native vegetation and trees within the Trustees' jurisdiction. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
