Revised plans to include an additional 2 ft of bulkhead replacement to meet the limits of the adjacent property line at the request of the NYSDEC during their project review The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP with conditions as follows: Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. D. Use hard structural erosion protection measures for control of erosion only where: 2. Vegetative approaches to controlling erosion are not effective 6. Practical vegetative methods have been included in the project design and implementation. Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed removal and replacement of the existing bulkhead is consistent with Policy 4.1 D(2) and 4.1 D(6) which states that a bulkhead can be found consistent if vegetative approaches to control erosion are not effective. In this case, a vegetative approach would not work because there is already a bulkhead there. In accordance with Policy 4.1 D(6), a 10 ft vegetated non turf buffer has been included in the project design; however, it is recommended to be expanded to a 15 ft vegetated non turf buffer to be effective and to be consistent with this policy. The replacement of the bulkhead is compliant with Town Code Chapter 275-11(13)(1)(a) which states, "only in-place replacement of existing functional bulkheads (as defined in 275-2) is permitted. In-kind replacement relates to the position and dimensions and does not necessarily require or allow for the use of the same materials." The proposed installation of the non-treated timber boardwalk is compliant with Town Code Chapter 275-116B that states that a boardwalk is an exception to the 75 ft setback from a bulkhead. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Town of Southold LWRP CONSISTENCY ASSESSMENT FORM MAY 2 2 2026 SOUTHOLD TOWN A. INSTRUCTIONS PLANNING BOARD 1. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its sigificant beneficial and adverse effects upon the coastal area(which includes all of Southold Town)_ 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained is detail, listing both supporting and non- supporting facts.
