A Regular Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held
at the Southold Town Hall Annex Lower Level, 54375 Main Road, Southold, New York 11971-0959,
and also accessible via Zoom Webinar Portal on Thursday, May 7, 2026 commencing at 9:00 A.M.
Present were:

9:09 A.M. Chairperson Weisman called the meeting to order.

I. EXECUTIVE SESSION: Began at 9:09 A.M.
9:09 A.M. —A Motion was offered by Chairperson Weisman, seconded by Member Acampora to
enter into Executive Session in order to receive Attorney Advice. Vote of the Board: -Ayes:
Members Weisman, Planamento,Acampora, Lehnert and Steinbugler. This Resolution was duly
adopted(5-0).
10:03 A.M. —A Motion was offered by Chairperson Weisman, seconded by Member Lehnert to exit
the Executive Session. Vote of the Board: Ayes: Members Weisman, Planamento,Acampora
Lehnert and Steinbugler. This resolution was duly adopted (5-0).
II. WORK SESSION:
1. Requests from Board Members for future agenda items.

2026.

Without a Date, and for #8084, Joseph Romano to Adjourn Public Hearing to November 5,
2026.
III. STATE ENVIRONMENTAL QUALITY REVIEWS:

A. RESOLUTION declaring applications that are setback/dimensional/lot waiver/accessory

IV. POSSIBLE RESOLUTIONS TO CLOSE/ADJOURN THE FOLLOWING HEARING:
CAROLINE SCHRANK—8092SE—(Adjourned from April 2, 2026) Applicant requests a Special
Exception under Article II1, Section 280-13B(13). The Applicant is owner of the subject property
requesting authorization to construct and establish an Accessory Apartment in a proposed (not built)
accessory structure; at: 1865 Westphalia Road, Mattituck 41000-141-1-4. RESOLUTION: (Please
see transcript of written statements prepared under separate cover). After receiving testimony, a
motion was offered by Chairperson Weisman, seconded by Member Lehnert to CLOSE HEARING
and RESERVE DECISION. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-
V. PUBLIC HEARINGS: All testimony shall be limited to zoning issues properly before the
Board. Each speaker is requested to speak for five minutes, and to submit testimony in writing when

Request for Variances from Article IV, Section 280-18 and the Building Inspector's November 5,
2026,Notice of Disapproval based on an application for a permit to construct additions to a single-
family dwelling (per Building Permit#50152 for interior alterations with amendment to include
additional work) at: 1) less than the code required minimum front yard setback of 50 feet, 2) less
than the code required side yard setback of 15 feet; located at: 20210 Soundview Avenue, Southold,
NY. SCTM No. 1000-51-3-13.2. RESOLUTION: (Please see transcript of written statements
prepared under separate cover). After receiving testimony, a motion was offered by Chairperson
Weisman, seconded by Member Planamento to CLOSE HEARING and RESERVE DECISION.

10:23 A.M. - JANE WEILAND # 8100 -By Krista Jones, Representative; Jane Weiland and Edward
Weiland, Owners. Request for Variances from Article III, Section 280-15;Article XXII, Section
280-116A(1); and the Building Inspector's January 14, 2026,AMENDED January 27, 2026 Notice
of Disapproval based on.an application for a permit to construct an accessory in-ground swimming
pool at: 1) located in other than the permitted rear yard, 2) less than the code required 100 feet from
top of the bluff; located at: 6485 Nassau Point Road, (Adj. to Little Peconic Bay) Cutchogue,NY.

the Board: Ayes: All. This Resolution was duly adopted(5-0).
10:41 A.M. —VERADEANA PROPERTIES, LLC#8099—By Martin Finnegan,Attorney, and
Margaret Ann Neimetz, Owner. Opposition from Maureen O'Connell and Lynn Normandia
Request for a Waiver of Merger petition under Article II, Section 280-10A, to unmerge land
identified as SCTM No. 1000-59-6-23 which has merged with SCTM No. 1000-59-6-22, based on
the Building Inspector's November 21, 2025,Notice of Disapproval; which states that a non-
conforming lot shall merge with an adjacent conforming or non-conforming lot held in common
ownership with the first lot at any time after July 1, 1983.An adjacent lot is one which abuts with the
parcel in common course of fifty (50) feet or more in distance.Nonconforming lots shall merge until

11:28 A.M. -PETER STEIN AND ALLISON KRONICK STEIN#8053 —(REOPENED and
AMENDED the public hearing on January 22, 2026.) By Martin Finnegan,Attorney. Request for
Variances from Article XXII, Section 280-116A(1);Article XXIII, Section 280-124 and the Building
Inspector's June 20, 2025 Notice of Disapproval based on an application for a permit to demolish

11:44 A.M. - GAILLARD CS REVOC TRUST, c/o CHRISTOPHER GAILLARD #8101 —By Sam
Fitzgerald, Representative. Request for a Variance from Article XXIII, Section 280-124 and the
Building Inspector's November 21, 2025 Notice of Disapproval based on an application for a permit
to construct additions and alterations to an existing seasonal dwelling and convert the cottage into a
year-round single-family dwelling; at: 1) less than the code required minimum front yard setback of

1:06 P.M. - MATTITUCK PLAZA, LLC#8098—By William Goggins,Attorney. Support from
Jamie Wilsberg and Patricia Moore. Opposition from Mary Eisenstein. Request for a Use Variance
under Article XI, Section 280-48A(2)d and the Building Inspector's July 11, 2025 Notice of
Disapproval based on an application to construct alterations to an existing storefront; at 1) buildings

VI. RESOLUTIONS: 3:12 P.M.
RESOLUTION ADOPTED: A Motion was offered by Chairperson Weisman, seconded by
Member Steinbugler to authorize advertising of hearings for the Regular Meeting to be held on
Thursday, June 4, 2026, which will commence at 9:00 A.M. for Work Session, and Regular
Meeting (Public Hearings)to begin at 10:00 A.M. Vote of the Board: Ayes: All. This
Resolution was duly adopted (5-0).
RESOLUTION ADOPTED: A Motion was offered by Chairperson Weisman, seconded by
Member Steinbugler to approve minutes from the Special Meeting held on April 16, 2026. Vote
of the Board: Ayes: All. This Resolution was duly adopted (5-0).
RESOLUTION ADOPTED: A Motion was offered by Chairperson Weisman, seconded by
Member Planamento to Grant a One Year Extension of#7609,Bay Beach,LLC, 1055 Bay
Home Road, Southold, SCTM No. 1000-56-5-35, to Expire April 21, 2027. Vote of the Board:
Ayes: All. This Resolution was duly adopted 5-0Z
RESOLUTION ADOPTED: A motion was offered by Chairperson Weisman, seconded by
Member Steinbugler to Adjourn the public hearing of#8042,1460 The Strand,LLC,Without
A Date, SCTM No. 1000-30-2-66. Vote of the Board: Ayes: All. This Resolution was duly
