Solar arrays are not a permitted use in the R-120 zoning district. The subject parcel was acquired by the FIWMD in 2001. It consists of 18.5 acres in total but it is constrained with approximately 9.97 acres of freshwater wetlands. In 2005, the landfill was capped and it is subject to a post-closure monitoring and maintenance plan with a thirty-year testing requirement that will continue through 2035. In 2024, the FIWMD sought proposals from New York solar energy development companies for the lease of the Pickett Landfill and installation operation and maintenance of a solar energy system on site. The intent and goal of the request for proposals was to site a solar energy system for the benefit of the FIWMD, the Fishers Island community in general by creating a revenue stream for the District and an alternative energy resource for residents. Pickett Power was the successful bidder for the project. In its proposal, Pickett Power noted that Fishers Island receives all of its electricity via an aging subsea cable from Groton Utilities in Connecticut. It is entirely dependent upon the cable and electricity from Groton except for an on- island diesel generator that can, in emergencies, fulfill island electric load. While an island presents significant challenges to ensuring the reliable supply of energy to its residents, it also presents unique opportunities to demonstrate innovation and sustainability. Producing local, renewable energy with solar on Pickett Landfill represents substantial progress in reducing the island's carbon footprint. Pickett Power has assembled a team deeply experienced in engineering, permitting and constructing solar projects sited on capped landfills in New York and Connecticut. The Team consists of its owners, Brad Burnham and Travis Garcelon who engaged Michael Rauch through his sustainable energy consulting business, Ember Consulting, LLC, to advise on development of the project. Additionally, Pickett has engaged: Crawford 8s Associates, a New York- based woman-owned firm, for Civil Engineering; CTec, an Engineering, Procurement and Construction firm licensed in Connecticut and New York, and; TRC, a national firm with experience working on landfill-sited solar farms in the Town of Southold, for permitting. The PV array is proposed to be located within an approximately 4.3 acre fenced in area within the existing cap limits of Pickett Landfill, and the majority of the electrical equipment including inverters, transformers and protective switchgear are proposed to be located outside of the existing cap limits to the north, along an existing driveway to be improved. The attached Table shows a summary of the current layout's tilt, spacing, number of modules and other specifications which results in an overall AC capacity of 990 kW-AC, and overall DC capacity of 1,271 kW-DC. The latest design is based on a PV table layout created in PVCase / AutoCAD, according to the following criteria: • Modules were limited to the area within the approximate existing landfill cap limits. • It was assumed the proposed 2-UP fixed tilt ballasted racking would be limited to a maximum slope of 15% in any direction. • A minimum of 5' from the array to the existing landfill vents, as well as a minimum of 10'from electrical equipment to the existing landfill vents was maintained. • No modules or equipment are proposed within the existing delineated limits of the wetlands to the west and east of the project area. As with the Landfill Solar project at the Town's capped landfill, the Applicant submits that a solar array is an adaptive reuse of the parcel that can be of enormous benefit to the residents of Fishers Island with no adverse environmental impacts. A change of zone of the parcel is required to make the project a permitted use, but the Applicant has no objection to limiting the zone change to the project area as proposed. In addition, the Applicant is willing to offer the Town a Covenant that would limit the permitted use of the property following the change of zone to solar generation and energy storage per Section 280-62(B)(10) of the code.
