WHEREAS, the Town of Southold Administrative Employee Handbook provides for certain
benefits to administrative employees, including vacation time off, and

Retirement Resolution for Elected Officials
WHEREAS,the State of New York has set additional reporting requirements in Section 315.4 of the New
York Codes,Rules and Regulations which requires all elected and appointed officials whose terms start on or
after August 12,2009,who are members of the New York State and Local Retirement System and who do not
participate in their employer's time keeping system to prepare a log of their work-related activities for three
consecutive months and submit their logs to the clerk or secretary of the governing body within 150 days of
the start of their term;

RESOLVED that the Town Board of the Town of Southold hereby amends resolution#2026-
370 to read as follows:
RESOLVED that the Town Board of the Town of Southold hereby grants permission to Boy
Scout Troop 6 to hold its Annual Car Show, setting up Friday, September 4th, 2026 at 5
PM.(Rain Date of Sunday, September 6th, 2026 ) The event will be held on Saturday,
September 5th, 2026 from 7 AM to 5 PM and will be taken down on Sunday, September 6th,
2026 by 5 PM. The event will be held at the Peconic Lane Community Center field, Peconic
Lane, Peconic,provided they file with the Town Clerk a Two Million Dollar Certificate of
Insurance naming the Town of Southold as an additional insured and comply with all the
provisions of the Town's Special Permit Policy. This application is for outside use only. There
will be no access to any Town buildings. All fees associated with this approval shall be waived,
with the exception of the clean-up deposit.

Cutchogue-New Suffolk Historical Council to hold its Rock&Roll Car Show on the Cutchogue
Village Green, Cutchogue,New York, on Saturday, October loth 2026 from 9:00 AM to 4:00
PM. The set-up will be Friday, October 9th, 2026, and the rain date will be Sunday, October
11th 2026,provided they comply with all the conditions of the Town's Policy for Special Events

Kennys /McCabes Beach Association to hold a Kenneys Beach Sunset Market on Saturday,
July 18th from 5PM till sundown. The event will be located adjacent to the picnic area at
Kennys Beach. Parking will continue to be by parking permit only. This permit is subject to all
the rules and regulations of the Town of Southold Special event permit. A certificate of
Insurance has been submitted to the Town Clerks office. Securing the parking area for the
vendors is the responsibility of the organizer.

Special Event- Old Town Arts and Crafts Fair
RESOLVED that the Town Board of the Town of Southold hereby grants permission to the Old
Town Arts & Crafts Guild to hold its annual Arts & Crafts Show on the Village Green in
Cutchogue, set up on the following dates: Fridays, July 3rd, July 31 st and October 2nd. Events
are on the following dates: Saturdays, July 4th, August 1st and October 3rd 2026. Rain
dates are July 5th, August 2nd and October 4th 2026, provided the applicant has met all the
requirements as listed in the Town Policy on Special Events and Use of Recreation Areas and
Town Roads. There will be no Traffic Control at the July 4th event. Failure to comply with

the Town's policy regarding the issuance of fireworks permits and subject to the approval of the

WHEREAS the Fishers Island Pump Station was last upgraded in 2008 and the pumps have
deteriorated to a critical condition, with impellers worn down by excessive stormwater inflow
and foreign object intrusion, such that the pumps can no longer properly handle sewer flow; and
WHEREAS the pump station is in imminent danger of catastrophic failure; and
WHEREAS there is no backup pump station on Fishers Island, and no emergency services
capable of responding in a timely manner to a pump station failure, such that failure of the
existing pumps will result in the immediate and complete failure of the entire Fishers Island
sewer system,posing a serious and immediate threat to public health, safety,property, and the
environment; and
WHEREAS the geographic isolation of Fishers Island compounds the emergency, as
replacement equipment, parts, and personnel must be transported by ferry, materially limiting
the Town's ability to mitigate a system failure once it occurs; and
WHEREAS the foregoing constitutes a public emergency arising out of an unforeseen
occurrence requiring immediate action to safeguard life, health, and property, and the Town is
therefore exempt from competitive bidding and procurement policy requirements pursuant to
General Municipal Law § 103(4); now, therefore,be it
RESOLVED that the Town Board of the Town of Southold hereby declares a public emergency
at the Fishers Island Pump Station and authorizes emergency work to replace the pumps and

WHEREAS, the Board of Commissioners of the Fishers Island Ferry District(the "District"), in
the Town of Southold(the "Town"), Suffolk County,New York,pursuant to a resolution of said
Board of Commissioners, which, together with a petition in due form, was duly submitted to the
Town Board(the"Town Board") of the Town,has requested that the Town Board call a public
hearing to hear all persons interested in the subject thereof, and

P.M. (Prevailing Time) and continued on May 20, 2026 at 6:00 P.M. at the Peconic Community
Center, 1170 Peconic Lane, Peconic New York, with considerable discussion on the matter
having been had and all persons desiring to be heard having been heard, including those in favor
of and those in opposition to said increase and improvement of such facilities; and
WHEREAS, the Town, has given due consideration to the impact that the project may have on
the environment pursuant to the State Environmental Quality Review Act (SEQRA), constituting
Article 8 of the Environmental Conservation Law, and 6 N.Y.C.R.R., Part 617(c) and has
determined that it is a Type 11 action and is not subject to review under SEQRA; and
WHEREAS, the aggregate principal amount which the Town Board may borrow and for which
obligations may be issued on behalf of the District, as authorized pursuant to Section 4 of
Chapter 699 of the Laws of 1947, and acts amendatory thereto, is $20,000,000; and
WHEREAS, the principal amount of bonds issued pursuant to this resolution shall not exceed
$1,600,000;
Now, therefore, on the basis of the information given at such hearing, it is hereby
DETERMINED, that it is in the public interest to increase and improve the facilities of the
District as described hereinabove, at the estimated maximum cost of$1,600,000; and it is hereby
ORDERED, that the facilities of the District shall be so increased and improved and that the
Board of Commissioners shall prepare plans and specifications, if necessary, and make a careful
estimate of the expense for said increase and improvement of such facilities and, with the
assistance of Attorney for said Board, shall prepare a proposed contract for such increase and
improvement of facilities of the District, which plans and specifications, estimate and proposed
contract shall be presented to the Town Board as soon as possible; and it is hereby
FURTHER ORDERED, that the expense of said increase and improvement of facilities shall be
financed as hereinabove set forth, and the costs thereof, including payment of the principal of
and interest on the obligations authorized to be issued, shall be assessed, levied and collected by

WHEREAS, after a public hearing duly called and held pursuant to Section 202-b of the Town
Law, and the applicable provisions of Chapter 699 of the New York Laws of 1947, the Town
Board of the Town of Southold(herein called the "Town"), in the County of Suffolk, New York
determined that it is in the public interest to increase and improve the facilities of the Fishers
Island Ferry District(referred to herein as the "District"), and ordered that such facilities be so
improved;
Now, therefore,be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY
OF SUFFOLK,NEW YORK(by the favorable vote of not less than two-thirds of all the
members of said Board) AS FOLLOWS:
Section 1. The Town hereby appropriates the amount of$1,600,000 for the increase and
improvement of facilities of the District, consisting of the replacement of the south vehicle
offloading ramp at the District's Fishers Island Terminal. The estimated maximum cost thereof,
including preliminary costs and costs incidental thereto and the financing thereof, is $1,600,000.
The plan of financing includes the issuance of bonds in the principal amount of$1,600,000 to
finance said appropriation, and the assessment, levy and collection of assessments upon the
several lots and parcels of land within the District in the same manner and at the same time as
other Town charges,but if not paid from such source, all the taxable property within said Town
shall be subject to the levy of ad valorem taxes, in an amount sufficient to pay the principal of
and interest on said obligations.
Section 2. Bonds of the Town are hereby authorized to be issued in the principal amount of
$1,600,000 pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of
the Consolidated Laws of the State of New York(herein called the "Law"), to finance said
appropriation.
Section 3. The following additional matters are hereby determined and stated:
(a) The period of probable usefulness of the objector purpose for which said bonds are
authorized to be issued, within the limitations of Section 11.00 a. 7 of the Law, is twenty (20)
years.

(b) The proceeds of the bonds herein authorized and any bond anticipation notes issued in
anticipation of said bonds may be applied to reimburse the Town for expenditures made after the
effective date of this resolution. The foregoing statement of intent with respect to reimbursement
is made in conformity with Treasury Regulation Section 1.150-2 of the United States Treasury
Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed five (5)years.
Section 4. Each of the bonds authorized by this resolution and any bond anticipation notes issued
in anticipation of said bonds shall contain the recital of validity prescribed by Section 52.00 of
the Law and said bonds and any notes issued in anticipation said bonds shall be general
obligations of the Town,payable as to both principal and interest by a general tax upon all the
taxable real property within the Town. The faith and credit of the Town are hereby irrevocably
pledged to the punctual payment of the principal of and interest on said bonds and any notes
issued in anticipation of the sale of said bonds, and provision shall be made annually in the
budget of the Town by appropriation for(a) the amortization and redemption of the bonds and
any notes issued in anticipation thereof to mature in such year and(b) the payment of interest to
be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and pursuant to the
provisions of Section 21.00 of the Law relative to the authorization of the issuance of bonds with
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to 60.00 and
168.00 of the Law, the powers and duties of the Town Board relative to authorizing bond
anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of
the bonds herein authorized, and the renewals of said bond anticipation notes, and relative to
executing contracts for credit enhancements and providing for substantially level or declining
annual debt service, are hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any notes issued in
anticipation of said bonds, may be contested only if.
(a) such obligations are authorized for an object or purpose for which the Town is not
authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the publication of such
resolution, or a summary thereof, are not substantially complied with, and an action, suit or
proceeding contesting such validity is commenced within twenty days after the date of such
publication, or
(c) such obligations are authorized in violation of the provisions of the constitution.
Section 7. This resolution shall take effect immediately and the Town Clerk is hereby authorized
and directed to publish the foregoing bond resolution, in summary, in "The Suffolk Times," a
newspaper having a general circulation in said Town, which newspaper is hereby designated as
the official newspaper of the Town for such publication, together with the Town Clerk's
statutory notice in the form prescribed by Section 81.00 of the Local Finance Law of the State of
New York.

against unauthorized access to computing resources. These layers of defense will work together to
create a secure environment and ensure that the Town's systems remain protected from evolving
security threats.

1 . Security Controls
1.1 Access Control
• Role-Based Access: Access to systems and data is granted based on the user's role. This is
done to ensure that employees and others can only access the data they need to perform their
official duties.
• Authentication: All users must authenticate their identity through secure methods such as
passwords and multi-factor authentication (MFA) before accessing any Town system.
• Least Privilege: Users will only be granted the minimum level of access required to complete
their tasks. This minimizes exposure to sensitive data.
1.2 Device and Endpoint Security
• Approved Devices: Only Town-owned devices (e.g., workstations, mobile phones, laptops,
tablets) may be used to access resources directly connected to the network infrastructure.
Personal devices are not permitted access to the network or systems connected to the network.
• Anti-virus Software: All devices connected to the Town's network must have up-to-date anti-
virus and anti-malware software installed and maintained by the Information Technologies
Department.
• Patch Management: Devices must be regularly updated to ensure all software vulnerabilities
are patched in a timely manner.
1.3 Network Security
Network IDs: The Town of Southold's Information Technologies Department shall be solely
responsible for assigning, managing, and deactivating network IDs. All individuals authorized to
access the Town's network must be issued a unique network ID. Access privileges shall be
based on the principle of least privilege and assigned in accordance with the Town's information
security policies, applicable laws, and cybersecurity standards. Network IDs are non-transferable
and must not be shared. All access shall be logged and monitored.
• The IT Department shall review access rights periodically, in coordination with Personnel staff, to
ensure they remain appropriate to users' current roles and responsibilities.
• Firewalls: The Town's internal network is protected by firewalls to block unauthorized access
from external sources.
• VPN for Remote Access: Remote access to Town resources must be secured using a Virtual
Private Network (VPN), ensuring that data transmitted over public networks is encrypted.
1.4 Data Protection
• Data Classification: Information handled by the Town will be classified based on its sensitivity.
Confidential and restricted data will be subject to more stringent security measures.
• Backups: Data is regularly backed up and stored securely.
1.5 User Awareness and Training
• Cybersecurity Awareness: All users shall undergo training at least annually on

2.3 Workstation and Device Security
• Lock Workstations When Not in Use:
• If you are leaving your workstation unattended, always lock your computer by pressing Ctrl + Alt
+ Delete and selecting the Lock or Lock Computer option. This ensures that your system is not
accessible to others while you are away.
• Screen Saver Password Protection:
• A password-protected screen saver will be enabled automatically on your computer after 15
minutes of inactivity. This ensures that your computer is not left accessible by unauthorized
individuals when you're not at your desk.
• Networked workstations are automatically locked after 15 minutes of no activity.
2.4 Application and Web Security
• Do Not Use the "Save Password" Feature:
• Never use the "Save Password" feature in browsers or applications. If you choose to save
passwords in your browser, others who have access to your computer may be able to view and
use your saved credentials to access your accounts.
• Multi-Factor Authentication (MFA):
• Whenever available, enable Multi-Factor Authentication (MFA) for systems, applications,and
accounts. MFA provides an additional layer of security by requiring a second form of verification
in addition to your password.
• MFA is used to all access of the Town's information systems.
2.5 Password Changes and Recovery
• Password Updates:
• Periodically, users will be forced to change their network passwords. In addition, in the event of a
security breech a mandatory password change will be enforced.
• Password Recovery:
• If you forget your password or get locked out, contact the Information Technologies Department
for assistance.
2.6 Accountability and Enforcement
• Compliance with the Password Policy:
• Compliance with this password policy is mandatory. Failure to follow these guidelines can result
in disciplinary action, including revocation of system access.
• Incident Reporting:
• If you suspect that your password has been compromised or your system has been accessed by
an unauthorized person, immediately report it to the Information Technologies Department.
If you need assistance in creating strong passwords, contact the Information Technologies Department
for guidance.

Email is a critical communication tool, but it can also be a target for cyber threats. By following these
email security practices, users can protect the Town 's systems and data from phishing,
malware, and other email-based risks. If you are ever in doubt about the legitimacy of an email,
remember that it's always safer to report it to the Information Technologies Department for verification.
To protect Town data, systems, and resources from security breaches and
unauthorized access, all users must adhere to the following email security guidelines.
3.1 Handling Email Attachments and Links
• Do Not Open Attachments from Unknown Sources: Never open email attachments unless
you are sure of the sender's identity and trustworthiness. Attachments can contain malware,
ransomware, or viruses that can compromise Town systems.
• Avoid Clicking on Suspicious Links: Do not click on links from unknown or untrusted sources,
as they could lead to phishing sites or malicious websites designed to steal personal information
or install harmful software.
3.2 Identifying Suspicious Emails
• Phishing Scams: Phishing emails often appear to be legitimate, but they may contain
misleading sender information, suspicious attachments, or ask for confidential information such
as login credentials, financial information, or other sensitive data. Be cautious of emails that:
• Contain urgent or alarming language (e.g., "Immediate action required!").
• Request sensitive information or credentials (e.g., passwords, classified documents).
• Include unsolicited attachments or links.
• Have misspellings, grammatical errors, or unusual formatting.
• Spoofed Emails: Spoofed emails often appear to come from legitimate Town email addresses
orknown contacts, but they may be attempts to deceive users into providing access to sensitive
information or systems.
• Tip: Check for email address legitimacy by hovering over the sender's name and viewing the
reply to address.
3.3 Reporting Suspicious Emails
• Forward Suspicious Emails: If you receive a suspicious email or suspect that an email may be
a phishing attempt or contain malicious content:

• Forward the email to the Information Technologies Department immediately.
• Delete the email after reporting it and empty your deleted items folder in Outlook.
The Information Technologies Department will investigate the email, determine whether it poses a
threat, and take appropriate action.

• Use Strong Email Passwords: Ensure your email account password is complex, and enable
multi-factor authentication (MFA) where possible to add an extra layer of security.
• Be Cautious with Auto-Complete: Email applications often use auto-complete to fill in

information.
• Email and Instant Messaging: Town email systems and other forms of electronic
communication (e.g., bulletin boards, newsgroups, chat groups) should only be used for official
Town business. The dissemination of political material, solicitations, or non-Town business-
related communication through these channels is prohibited.
• Email Etiquette: Users are expected to communicate in a professional and respectful manner at

4. Internet Security
To safeguard the Town of Southold's network, data, and systems from external threats such as
malware, viruses, and cyberattacks, all users must adhere to the following Internet security guidelines.
4.1 Primary Use for Town-Related Business
• Business-Related Browsing Only: The use of the Internet through Town systems should be
primarily for official Town business. Town resources and Internet access should be used to
support your job duties, including accessing government websites, conducting research,
communicating with colleagues and partners, and performing other work-related tasks.
• Minimize Non-Business Internet Use: Avoid browsing non-business related websites during

• Social media: Access to social media websites should be limited to work-related purposes, such
as communicating with constituents or posting official information. Personal use of social media

5. Security Software
• Antivirus and Anti-malware: All Town devices connected to the Internet should have up-to-date

• Secure Remote Access: When accessing Town systems remotely (e.g., from home or while

compartment, or docking station.
• Never leave a device unattended in an unlocked vehicle.
• Do not leave devices exposed (e. ., unlocked or unttene ) in public places or unattended
areas.
6.5 Reporting Loss or Theft
• Immediate Reporting: If your Town-issued mobile device is lost or stolen, you must immediately
report the incident to the Information Technologies Department.
• Prompt reporting allows IT to take action, such as remotely locking the device orwiping sensitive
data to prevent unauthorized access.
6.6 Restrict Use by Non-Employees
• No Unauthorized Use: Do not allow family members, friends, or other individuals to use your
Town--issued mobile device. These devices are intended solely for Town business and should be
kept in your possession and under your control at all times.
• Sharing devices can expose Town data to unauthorized access, risk of theft, or misuse.
If you have any questions about the security settings or need assistance with your device, contact the
Information Technologies Department.
7. Equipment and Software Usage
Equipment, both hardware and software, is intended for the efficient exchange of information and the
completion of job related responsibilities and tasks.
7.1 Authorized Usage Only
The Town's computer systems, including hardware, software, email, and Internet access, are for
use only by individuals authorized to access them and only for official Town business.
• Personal Use: Users are discouraged from using Town-provided devices and systems for
personal tasks, including browsing non-business websites, streaming media, or engaging in
personal communications unless explicitly authorized.
• No Sharing of Town Resources: Users are prohibited from sharing Town-provided devices,
accounts, and system access credentials with unauthorized individuals.
7.2 Enforcement and Consequences
Users who engage in any of these activities are subject to disciplinary action by the Town,
which may include, but is not limited to:

Technologies Department and Town Attorney. The Town takes violations seriously and will
investigate all reported incidents in a timely and thorough manner.
8. Prohibited Activities
The following activities are prohibited on all of the Town of Southold's computer resources and should
not be conducted under any circumstances.
8.1 Prohibited Uses
Town of Southold computer resources, including hardware, software, and networks, are
provided for the efficient conduct of Town business. Non-Town business and other unauthorized
activities are strictly prohibited. Specifically, users may not engage in the following:
• Non-Town Business: Using Town resources for personal, non-Town-related business activities
is prohibited.
• Commercial or Personal Advertisements: The dissemination or storage of commercial or
personal advertisements, solicitations, promotions, or any form of private commercial enterprise
is not allowed.

with Town systems is strictly prohibited.
• Political Material: The use of Town resources for promoting political campaigns, parties, or

• Unauthorized Uses: Any other use of the Town's computer resources that is unauthorized by
this policy or that interferes with Town business or violates legal or regulatory requirements.
• Artificial IntelligenceEmployees may not input any confidential information and data, PH,

9. Inappropriate or Illegal Material

• Policy Adherence: All users are required to adhere to the provisions of this policy. Violations of
this policy may result in disciplinary action, up to and including termination, depending on the

WHEREAS the Fishers Island Pump Station was last upgraded in 2008 and the pumps have
deteriorated to a critical condition, with impellers worn down by excessive stormwater inflow
and foreign object intrusion, such that the pumps can no longer properly handle sewer flow; and
WHEREAS the pump station is in imminent danger of catastrophic failure; and
WHEREAS there is no backup pump station on Fishers Island, and no emergency services
capable of responding in a timely manner to a pump station failure, such that failure of the
existing pumps will result in the immediate and complete failure of the entire Fishers Island
sewer system,posing a serious and immediate threat to public health, safety,property, and the
environment; and
WHEREAS the geographic isolation of Fishers Island compounds the emergency, as
replacement equipment,parts, and personnel must be transported by ferry, materially limiting the
Town's ability to mitigate a system failure once it occurs; and
WHEREAS the foregoing constitutes a public emergency arising out of an unforeseen
occurrence requiring immediate action to safeguard life,health, and property, and the Town is
therefore exempt from competitive bidding and procurement policy requirements pursuant to
General Municipal Law § 103(4); now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby declares a public emergency
at the Fishers Island Pump Station and authorizes emergency work to replace the pumps and
associated equipment necessary to restore safe and reliable operation of the station, all subject to
the approval of the Town Attorney.

WHEREAS, the Board of Commissioners of the Fishers Island Ferry District(the "District"), in
the Town of Southold(the "Town"), Suffolk County, New York,pursuant to a resolution of said
Board of Commissioners, which, together with a petition in due form, was duly submitted to the
Town Board(the "Town Board") of the Town, has requested that the Town Board call a public
hearing to hear all persons interested in the subject thereof, and
WHEREAS, on April 21, 2026, the Town Board of the Town of Southold(herein called the
"Town"), in the County of Suffolk,New York, on behalf of the District, adopted an Order
pursuant to Section 202-b of the Town Law, describing in general terms a proposed increase and
improvement of facilities, consisting of the replacement of the South Vehicle Offloading Ramp
at the District's Fishers Island Terminal, at the aggregate estimated maximum cost of
$1,600,000; and said Order stated that the Town Board would meet to hear all persons interested
in said increase and improvement of facilities on May 20, 2026 at 6:00 P.M. (Prevailing Time) at
the Peconic Community Center, 1170 Peconic Lane, Peconic,New York; and
WHEREAS, a Notice of said public hearing was duly published and posted pursuant to the
provisions of Article 12 of the Town Law; and
WHEREAS, said public hearing was duly held by the Town Board on May 20, 2026 at 6:00
P.M. (Prevailing Time) and continued on May 20, 2026 at 6:00 P.M. at the Peconic Community
Center, 1170 Peconic Lane, Peconic New York, with considerable discussion on the matter
having been had and all persons desiring to be heard having been heard, including those in favor
of and those in opposition to said increase and improvement of such facilities; and
WHEREAS, the Town, has given due consideration to the impact that the project may have on
the environment pursuant to the State Environmental Quality Review Act (SEQRA), constituting
Article 8 of the Environmental Conservation Law, and 6 N.Y.C.R.R., Part 617(c) and has
determined that it is a Type II action and is not subject to review under SEQRA; and

WHEREAS, the aggregate principal amount which the Town Board may borrow and for which
obligations may be issued on behalf of the District, as authorized pursuant to Section 4 of
Chapter 699 of the Laws of 1947, and acts amendatory thereto, is $20,000,000; and
WHEREAS, the principal amount of bonds issued pursuant to this resolution shall not exceed
$1,600,000;
Now, therefore, on the basis of the information given at such hearing, it is hereby
DETERMINED, that it is in the public interest to increase and improve the facilities of the
District as described hereinabove, at the estimated maximum cost of$1,600,000; and it is hereby
ORDERED, that the facilities of the District shall be so increased and improved and that the
Board of Commissioners shall prepare plans and specifications, if necessary, and make a careful
estimate of the expense for said increase and improvement of such facilities and, with the
assistance of Attorney for said Board, shall prepare a proposed contract for such increase and
improvement of facilities of the District, which plans and specifications, estimate and proposed
contract shall be presented to the Town Board as soon as possible; and it is hereby
FURTHER ORDERED, that the expense of said increase and improvement of facilities shall be
financed as hereinabove set forth, and the costs thereof, including payment of the principal of
and interest on the obligations authorized to be issued, shall be assessed, levied and collected by
the Town Board from the several lots and parcels of land within the District in the same manner
and at the same time as other Town charges, but if not paid from such source, all the taxable
property within said Town shall be subject to the levy of ad valorem taxes, in an amount
sufficient to pay the principal of and interest on said obligations; and it is hereby
FURTHER ORDERED, that the Town Clerk record, or cause to be recorded, a certified copy of
this Resolution and Order After Public Hearing in the office of the Clerk of Suffolk County

APPROPRIATION
WHEREAS, after a public hearing duly called and held pursuant to Section 202-b of the Town
Law, and the applicable provisions of Chapter 699 of the New York Laws of 1947, the Town
Board of the Town of Southold(herein called the "Town"), in the County of Suffolk,New York
determined that it is in the public interest to increase and improve the facilities of the Fishers
Island Ferry District(referred to herein as the "District"), and ordered that such facilities be so
improved;
Now, therefore, be it
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY
OF SUFFOLK,NEW YORK(by the favorable vote of not less than two-thirds of all the
members of said Board) AS FOLLOWS:
Section 1. The Town hereby appropriates the amount of$1,600,000 for the increase and
improvement of facilities of the District, consisting of the replacement of the south vehicle
offloading ramp at the District's Fishers Island Terminal. The estimated maximum cost thereof,
including preliminary costs and costs incidental thereto and the financing thereof, is $1,600,000.
The plan of financing includes the issuance of bonds in the principal amount of$1,600,000 to
finance said appropriation, and the assessment, levy and collection of assessments upon the
several lots and parcels of land within the District in the same manner and at the same time as
other Town charges, but if not paid from such source, all the taxable property within said Town

shall be subject to the levy of ad valorem taxes, in an amount sufficient to pay the principal of
and interest on said obligations.
Section 2. Bonds of the Town are hereby authorized to be issued in the principal amount of
$1,600,000 pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the
Consolidated Laws of the State of New York(herein called the "Law"), to finance said
appropriation.
Section 3. The following additional matters are hereby determined and stated:
(a) The period of probable usefulness of the objector purpose for which said bonds are
authorized to be issued, within the limitations of Section 11.00 a. 7 of the Law, is twenty (20)
years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes issued in
anticipation of said bonds may be applied to reimburse the Town for expenditures made after the
effective date of this resolution. The foregoing statement of intent with respect to reimbursement
is made in conformity with Treasury Regulation Section 1.150-2 of the United States Treasury
Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed five (5)years.
Section 4. Each of the bonds authorized by this resolution and any bond anticipation notes issued
in anticipation of said bonds shall contain the recital of validity prescribed by Section 52.00 of
the Law and said bonds and any notes issued in anticipation said bonds shall be general
obligations of the Town,payable as to both principal and interest by a general tax upon all the
taxable real property within the Town. The faith and credit of the Town are hereby irrevocably
pledged to the punctual payment of the principal of and interest on said bonds and any notes
issued in anticipation of the sale of said bonds, and provision shall be made annually in the
budget of the Town by appropriation for (a) the amortization and redemption of the bonds and
any notes issued in anticipation thereof to mature in such year and (b) the payment of interest to
be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and pursuant to the
provisions of Section 21.00 of the Law relative to the authorization of the issuance of bonds with
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to 60.00 and
168.00 of the Law, the powers and duties of the Town Board relative to authorizing bond
anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of
the bonds herein authorized, and the renewals of said bond anticipation notes, and relative to
executing contracts for credit enhancements and providing for substantially level or declining
annual debt service, are hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any notes issued in
anticipation of said bonds, may be contested only if-
(a) such obligations are authorized for an object or purpose for which the Town is not authorized
to expend money, or

(b)the provisions of law which should be complied with at the date of the publication of such
resolution, or a summary thereof, are not substantially complied with, and an action, suit or
proceeding contesting such validity is commenced within twenty days after the date of such
publication, or
(c) such obligations are authorized in violation of the provisions of the constitution.
Section 7. This resolution shall take effect immediately and the Town Clerk is hereby authorized
and directed to publish the foregoing bond resolution, in summary, in "The Suffolk Times, "a
newspaper having a general circulation in said Town, which newspaper is hereby designated as
the official newspaper of the Town for such publication, together with the Town Clerk's
statutory notice in the form prescribed by Section 81.00 of the Local Finance Law of the State of
New York.
