An undesirable change will not be produced in the CHARACTER of the neighbopor a detriment to nearby properties if granted,because: The property is an existing single-story frame house that has been on the property for decades.Legalizing the conversion to a habitable dwelling does not change the building's current footprint or its 14-foot height, ensuring it remains consistent with the scale of the surrounding residential area 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The parcel is a"lot of record" from 1909 and is only 5,629 sq.ft.,which is less than 15%of the 40,000 sq.ft.required for the R-40 Zone.Due to the narrow and shallow nature of the lot, it is physically impossible to place a functional single-family home on the site while meeting the 35-foot front and 10-foot side yard setbacks. 3. The amount of relief requested is not substantial because: While the side yard is 0 ft and the front is 21.5 ft,these are existing"as-built"conditions of a modest house footprint. The relief is only "substantial'because the property is being held to R-40 standards designed for lots seven times larger than this one. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The house sits on a flat terrace and the project does not involve changing land contours or increasing the buildings footprint. To further reduce environmental impact and clutter,an existing gazebo and hot tub are being removed, which helps maintain the total lot coverage at 18.3%,well under the 20%maximum allowed by the Town. 5.
