The area in need of a side yard setback variance is the proposed second floor above the existing attached garage. The proposed second floor also stays within the allowable sky plane despite portion of the existing roof not complying. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: Area where second floor addition is desired and most feasible is above the first floor that is already encroaching the required side yard setback. 3.The amount of relief requested is not substantial because: The proposed second floor addition stays within the existing first floor footprint that has an existing non-conforming yard setback. The GFA is for more living space where a large portion of the existing square footage is double height space not being able to utilize for liveable floor area. 4.
