Please note that all of the existing fireboxes, smoke chambers and hearths will be removed and replaced with boxes that conform to the current New York State building code. The Hearths are being cantilevered from existing masonry mass allowing for the hearths to be completely structurally independent of the framing system. The fireboxes will be built out of approved material and the smoke chambers will be completely reconstructed. At this level of reconstruction,I would consider the fireplaces to be completely new construction. If you wish to review any of this information,the masonry drawings (pages #A407-#A410) are available at the job trailer on the Island. The petitioner has agreed to install sprinklers throughout the third floor and along the path of travel down the rear service stair to a service/mudroom exit door: The installation shall.be in accordance with 9 NYCRR 1060.4 6. The entire.house will be equipped with.an integrated fire- and smoke-detecting system, with central station monitoring. The installation shall be in accordance with 9 NYCRR-1060.3. 7. The,roof at the rear of the building has a shallow pitch, and curves down to an eave height of approximately nine feet above grade. The roof could be easily accessed from the dormer egress.windows. This affords an additional level of protection in an emergency situation. 8. The local code enforcement official concurs with the granting.of the relief. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would be unnecessary in light of the alternatives which are an enclosed second stairway, a sprinkler system installed on the third floor and along the path of travel down the rear service stair to the exit door, interconnected fire=and smoke-detecting system with central station ,monitoring.These,.alternatives will ensure the achievement of the code's intended objective. The building was the subject of another routine variance, #200-97-52, to retain third floor habitable space. 8. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would be unnecessary in light of the alternatives which include the hardwired smoke detection devices with central station monitoring, the exit signs and emergency lighting, and the 2-hour enclosure of the mechanical room.
