"_1 ..-1 ,20. 6, the Applicants, their b g p ppv are seeking variances from the lot area and lot width and lot depth requirements set forth in §280-18 and 280--39 of'Town Code, to permit the Applicant to adjust the common lot line between the subject parcels +/- 135' to the south to create Proposed Lot 1 so that it is more consistent in depth with neighboring lots along Pike Street and the new lot line will be more consistent with the Zoning District Line. As depicted on the attached Lot Line Modification, the existing Finnegan Parcel (SCTM# 1000-140-3-19.1) presently consists of 18,981 SF in the R-40 Zoning District and is improved with a single family residence with attached garage that cover 2,637 SF or 13.9% of the parcel. The lot depth is currently nonconforming at 125 feet. The Hahn Parcel (SCTM# 1000-140-3-27) presently consists of 36,593 SF "L-shaped" parcel that is split zoned R-40 and RO. It is improved with a residence with a covered front porch that cover 1,385 SF or 3.8% of the parcel. The lot width is currently 66.29 feet. Both parcels are nonconforming as to lot area. Variance relief is required to allow the Hahn Parcel to maintain its pre-existing non-conforming Lot width and become more nonconforming as to Lot Area. The Finnegan parcel will become substantially more conforming as to Lot Area and will become entirely conformingas to Lot Depth. The granting or relief will place the Proposed Lot 1 almost entirely in the R-40 Zoning District and Proposed Lot 2 entirely within the RO Zoning District. For the following reasons, the Applicant submits that Variances from Sections 280-18 and 280--39 are warranted: 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The lot line modification will result in a positive change to the proposed . character of the neighborhood since the resulting lots will be more consistent in size and configuration with their neighboring lots. Both parcels are currently improved with single family residences and there will continue to be two homes when the lot line is moved. The resulting common lot line will also be more consistent with existing zoning district lines and eliminate an irregular parcel. 2. The benefit sought by the Applicant CANNOT be achieved by some feasible method for the applicant to pursue other than an area variance, because: Due to the pre-existing nonconformities of both parcels, there is no way that their common lot line can be relocated without variance relief for the resulting lot area of each parcel and the lot width of the Hahn Parcel 1. 3, The amount of requested relief is not substantial because: The App licant submits that while the relief requested to create Proposed Lot 2 may be mathematically substantial at 56% for lot area and width, it is not practically substantial since the 18,931 SF transferred to Proposed Lot I will result in a substantially conforming parcel. Proposed Lot 2 will essentially mirror the neighboring parcel to the west. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, there will be no new construction associated with the relocation of the common lot line between Proposed Lots I and 2. The movement of the line will result parcels that are more symmetrical in size and configuration vis a vis their neighboring parcels, and parcel size will remain consistent with the size of neighboring parcels. In addition, as a Type 11 action, there is no perceivable environmental impact stemming from the proposed renovation. 5. Has the alleged difficulty been self-created? To the extent that the difficulty is self-created, pursuant to New York Town Law §267-b (3), a self-created hardship "shall not necessarily preclude the granting of an area variance."
