RESOLUTION:
WHEREAS, 22494 Main Road, Orient, NY, is on the Town of Southold Registry of Historic
Landmarks; and
WHEREAS, as set forth in Section 170-6 of the Town Law (Landmarks Preservation Code) of the
Town of Southold, all proposals for material change/alteration must be reviewed and
granted a Certificate of Appropriateness by the Southold Town Historic Preservation
Commission prior to the issuance of a Building Permit; and
WHEREAS, the applicant submitted a proposal on April 20, 2026, for an approval to erect a cedar
wood fence and gate surrounding a proposed in-ground swimming pool upon the above
referenced premises; and
WHEREAS, the applicant's representative, David Freeborn of Islandia Pools, Ltd., appeared before the
Commission at a Work Session on April 23, 2026 to describe the proposed improvements;
and
WHEREAS, the proposed improvements consist of tongue and groove cedar wood fence and gate as
depicted on fence specifications received on April 20,2026,and shall surround a proposed
in-ground swimming pool as depicted on a copy of the survey received on April 24, 2026;
and
WHEREAS, the Commission has determined that pursuant to Chapter 170-4(E)(2) of the Southold
Town Code, the Commission has the authority to determine that some proposals do not
rise to the level of requiring a public hearing, as the proposal is de minimis in nature; and

WHEREAS, the Commission has determined that the subject application for the Certificate of
Appropriateness is de minimis in nature, and therefore does not require a Public Hearing;
and
WHEREAS, the applicant shall submit to the Commissioners photographs of the finished
improvements upon completion; and
WHEREAS, the Commissioners may conduct a site inspection of subject premises once improvements
are completed.
NOW THEREFORE BE IT RESOLVED,that the Southold Town Historic Preservation Commission
determines that the proposed improvements consisting of a cedar wood fence and gate
surrounding a proposed in-ground swimming pool, as depicted on illustrations received
on April 20, 2026, with the location depicted on a copy of the survey received on April
24, 2026, meets the criteria for recommendation under Section 170-8 (A) of the Southold
Town Code; and
BE IT FURTHER RESOLVED,that the Commission approves the request for a Certificate of
Appropriateness, subject to approvals by all involved agencies; and
BE IT FURTHER RESOLVED, that this approval is subject to the condition that the proposed
installation of a fence conforms to Town of Southold Zoning Regulations, Section 280-
105 "Height of Fence"; and
BE IT FURTHER RESOLVED, that any deviation from the approved plans referenced above may
require further review from the Commission.

Chapter 280. Zoning
Article XXII. Supplementary Regulations
§ 280-105. Height of fences, walls and berms.
[Amended 11-24-1992 by L.L. No. 25-1992; 10-19-2010 by L.L. No. 12-2010; 6-29-2021 by L.L. No. 9-2021]
Fences, walls or berms may be erected and maintained, subject to the following height limitations:
A. When located in the front yard of residential zones, the same shall not exceed four feet in height. When
located in the`front yard of nonresidential zones, the same shall not exceed six feet in height.
B. When located in or along side and rear yards, the same shall not exceed 6 1/2 feet in height.
C. t-When located-in-or along-a-secondary-frontyard, the same h not-exceed 6112-feet-in_he g t and shall
,=be set back from the secondary front yard linerro less than-10 feet.
D. In residential and nonresidential zones, except properties/parcels engaged in bona fide agricultural
production, the installation of a deer exclusion fence may be permitted by obtaining a building permit
issued by the Building Inspector, subject to the following criteria:
(1) When located in or along side and rear yards, the height of the deer exclusion fence shall not exceed
eight feet.
(2) When located in or along a secondary front yard, the height of the deer fence shall not exceed eight
feet in height and shall be set back from the secondary front yard line no less than 10 feet.
(3) Specifications for construction of deer exclusion fences:
(a) Fencing fabric: high-tensile, woven wire fence fabric with graduated opening.
(b) Spacing between posts: 20 feet.
(4) Deer fencing is prohibited in or along the front yard or primary front yard of any property.

photo. Please indicate on the survey the areas where the fence will be located. Will the
proposed fence be 6 feet in height? If so, please review with the Building Dept. areas on the
property that a 6 feet fence is permitted.
I will forward your application the HPC members for their review.
As discussed, the next meeting of the Historic Preservation Commission will be held on
Thursday, April 23, 2026 at 3:00 PM in the Annex 2nd Floor conference room.

Hi Dave,
I've attached the application for a Certificate of Appropriateness (issued by the HPC). Please
complete sections that apply; i.e., fence, surrounding the swimming pool.
Include in your application:
1. Survey or site plan showing the proposed location of the swimming pool (size, setbacks,
distances from lot lines) and fence, dated, sign, sealed by a design professional
2. Materials used for the fence.
3. Photographs of subject property from the streets.
Once the completed application is received, I will schedule the matter on a Work Session
Agenda to be reviewed by the Commission.
