INTRODUCTION Zoning Board of Appeals Marie Elena Lynch-Dobert (the "Applicant"), herein applies for the legalization of an existing, as-built garage roof extension located at 1350 Ole Jule Lane,Mattituck,NY(SCTM No. 1000-122-4-1) (the "Premises"). The proposed development requires relief from the side yard setbacks for the existing dwelling. II. STATEMENT OF FACTS The subject 90,152 sq ft/2.07 acre lot is located in the Residential R-80 District and fronts partially on the curve of Ole Jule Lane; the rear of the property is situated on James Creek and includes a fixed pier and floating dock that extends into the creek. The tidal wetlands on the western portion of the property were last flagged on January 28, 2025. The property was transferred into the Applicant's name,as wife with rights of survivorship, with her husband Ronald S. Dobert, on March 12, 2029; the deed is attached as Exhibit A. Mr. Dobert constructed the primary dwelling in 1983 and subsequently added a greenhouse, frame shed, and carport(attached to shed)to the property, all with the required permits. The Certificates of Occupancy are attached herein as Exhibit B. However, the carport that is the subject of this application was not part of any of these previous approvals and the Applicant, realizing the oversight, applied accordingly to the Building Department in order to rectify any outstanding issues with subject property. The Notice of Disapproval, dated February 20, 2026 was received for the existing roof-over carport attached to the primary dwelling(attached herein as Exhibit C). The sunroom and generator that were part of the initial application to the Building Department do not require approval from this Board but will be part of the Applicant's future application to the Board of Trustees. III. NATURE OF RELIEF REQUESTED The Applicant requests variance relief from the yard setbacks contained in the Town of Southold Code §280-14 as follows: a. Existing "as built" roofed over carport to the existing single-family dwelling, located 9.1 feet from the side yard boundary line,where 20 ft is required. IV. STANDARDS FOR THE GRANT OF AREA VARIANCES Pursuant to Town Law Section 267-b,the Zoning Board of Appeals is required to take into consideration the following factors when weighing the benefit to the applicant if the variance is granted against the detriment to the health, safety, and welfare of the neighborhood and community: a) Whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; Appli/)cant:Marie Elena Lynch-Dober°t Received Premises: 1350 tll Jule Lane, Mattituck �' b) Whether the benefits sought by the applicant can be achiev^U40gethod feasible for the applicant to pursue other than an area variance; Zoning Board of Appeals c) Whether the requested area variance is substantial; d) Whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; e) Whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. These variance standards are addressed as follows: a) There is no undesirable chap a in the Character of the Nevi hborhood and detriment to nearb ro er-ties(Town Law 4 267-b b 1)). The subject improvement has existed on the property, albeit without the proper approvals, since at least 2007. The roof-over carport has not caused any measurable detriment to the surrounding properties or to the character of the neighborhood. Although it extends into the side yard setbacks for the main dwelling,it is located in a portion of the property that is not close to the neighbor's house or improvements on the adjacent property(930 Ole Jule Lane,Mattituck, SCTM No. 1000-114.00-12.00-013.007) (see attached NearMap aerial from April 9. 2025 as Exhibit D). This is visible in the photos included as Exhibit E. c) The area variances requested are not substantial Torun Law 4 267"-b b . Although this application is for the legalization of an existing improvement, constructed without approval, and it is located over 50% within the side yard setbacks, the structure itself, when taken in the context of the property and the surrounding uses, is not substantial. It does not offend or encroach on any of the neighboring residential uses and operates merely as an extension of the existing dwelling. d) There is no adverse imact on the phsical and environmental conditions to the neighborhood/town Town Law §267- 3 b . The to-be-legalized improvement is located on the opposite side of the dwelling(as shown in Exhibit D)from the tidal wetlands located on the property and,in the almost 20 years that it has existed, has not caused any measurable impact to the environmental conditions both on the property or in the neighborhood generally. The carport was constructed over an previously disturbed impervious surface (i.e. the existing driveway) and matches the material used for the main dwelling. e) This is a self-created difficul Town Law 267-b 3 b 5 . Although the difficulty is self-created, in that the existing improvement was constructed on the subject property without a permit,this factor should not be determinative and preclude the granting of an area variance.
