This report is intended to identify Recognized Environmental Conditions (as defined in Standard Practice for Environmental Site Assessment; ASTM E 1527-21 and United States Environmental Protection Agency (USEPA) Standards and Practices for All Appropriate Inquiries (AAI)) on the subject property based on four (4) components of a Phase I Environmental Site Assessment (ESA): records review, site reconnaissance, interviews and evaluation and reporting. Appendix A provides a statement of limiting conditions. Appendix B includes the resumes of key personnel. The subject property is located in the Town of Southold, County of Suffolk, State of New York. The subject property consists of a 14.54±-acre parcel of vacant land that is situated on the south side of Main Bayview Road, approximately 650 feet east of Meadow Court. The property is more particularly described as Suffolk County Tax Map# 1000-087-05-21.7-21.9, 29.10, 21.11, 21.12, & 21.13. This assessment has identified the following with respect to recognized environmental conditions (RECs), controlled recognized environmental conditions (CRECs), historical recognized environmental conditions (HRECs) and de minimus conditions in connection with the subject property, subject to the methodology and limitations of this report. No RECs were noted on the subject property based on the site reconnaissance, interviews and regulatory agency records review. MELISSA SPIRO : Hi, I am 14 Melissa Spiro . Land Preservation 15 consultant . I apologize . There was 16 some technical difficulties and we can ' t 17 get the map on Zoom . So it ' s just the 18 map up here . As stated in the Public 19 Hearing notice, this is for an open 20 space acquisition using community 21 preservation funds . The property is on 22 Hogs Neck, off Main Bayview in Southold . 23 For those of you that can see the map, 24 the property is outlined in red . The 25 current property shows six tax parcels FEBRUARY 28, 2023 REGULAR MEETING 5 1 and the acquisition is including all of 2 the tax parcels . The property fronts on 3 Corey Creek and is in close proximity to 4 many protected properties . The yellow 5 property on the map comprises of two 6 different property positions that is 7 totaling 52 acres with significant 8 frontage on creek that were acquired 9 jointly by the Town and open space . It 10 enhances the existing preserved lands . 11 Not only for protecting the creek 12 frontage but also irrespective, the 13 property is also visible when you look 14 at Corey Creek from our preserved land . 15 Southview Custom Homes is also in close 16 proximity to another 52 acres that are 17 comprised with preserved by Peconic Land 18 Trust . They are known as Wolf Preserve 19 and Reese Preserve, and they are labeled 20 in white . There are many other 21 preserved lands, but for the people that 22 can ' t see them, I can describe them all . 23 In addition to fronting on Corey Creek, 24 a significant amount of marsh lands and 25 wetlands are on this property for FEBRUARY 28, 2023 REGULAR MEETING 6 1 protection of the shoreline . It has 2 been included as a potential project for 3 restoration funding from the Peconic 4 Estuary partnership restoration . So 5 that is a good thing . I have been 6 involved one way or another for my 7 career here with the Town of Southold 8 for this property . For the 80 ' s and 9 90 ' s, it was owned by a man named Jim 10 (inaudible) . As a planner working in 11 the Planning Department in the 90 ' s , I 12 spent a lot of time with Mr . 13 ( Inaudible) . He was trying to move 14 lines around and trying to subdivide and 15 re-subdivided the property over the 16 years . And then I was working in the 17 Land Preservation Department . When the 18 property was on the market, there was 19 several efforts to try and purchase and 20 preserve the property by the County, by 21 the Peconic Land Trust and trying to et 22 funding from New York State DEC . These 23 efforts by all these entities show the 24 significant preservation of this 25 property . Last year, Town Board members FEBRUARY 28, 2023 REGULAR MEETING 7 1 asked me to reach out to the land owners 2 and we were thankful that the land 3 owners were then ready to sell to the 4 Town and we ' re where we are today . The 5 Land Preservation Committees supports 6 this purchase and they recommend that 7 the Town Board proceed . As I mentioned 8 earlier, I am participating here as a 9 consultant . The Town has recently hired 10 Lily McCullough . She is here next to me 11 today to lead the Land Preservation 12 Department . Today is her first day . So 13 I didn ' t want to make her get up here 14 and do this . This is likely to be my 15 last time before the Town Board. And 16 for me, it ' s really significant that I 17 am here for this significant project . I 18 am happy to be here today for this 19 project that I have come across multiple 20 times and also always been a goal here . 21 I also thank the land owners and the 22 Town for preserving this property and I 23 do recommend the Town Board proceed with 24 it . I would invite anybody to get S E Q R A P U R C H A S E R E S O L U T I O N '® RESOLUTION 2023-264 + ADOPTED DOC ID: 18944 THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2023-264 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON FEBRUARY 28, 2023: WHEREAS, the Town Board of the Town of Southold held a public hearing on the 281h day of February,2023, on the question of the purchase of fee title to property owned by Southview Custom Homes Two, Inc., for open space preservation pursuant to the provisions of Chapter 17 (Community Preservation Fund) and Chapter 185 (Open Space Preservation) of the Town Code of the Town of Southold, at which time all interested parties were given the opportunity to be heard; and WHEREAS, said property is identified as SCTM#1000-87.-5-21.7 and 87.-5-21.9, 21.10, 21.11, 21.12,21.13. The address of the property is 9230, 9293 and no number Main Bayview Road, Southold. The property is located within the Agricultural-Conservation(A-C) zoning district; and WHEREAS,the proposed acquisition is for the Town of Southold to acquire fee title to the entire combined property, totaling approximately 14.54 acres, for open space preservation. The exact area of the purchase is subject to survey, and WHEREAS, the purchase price for the combined 14.54±acre parcel is $2,195,000 (two million one hundred ninety-five thousand dollars)plus acquisition costs associated with the purchase of this property. The purchase will be funded by the Town's Community Preservation Fund; and WHEREAS, the property is listed on the Town's Community Preservation Project Plan as property that should be preserved for open space and the preservation of fresh and salt water wetlands. The purpose of this acquisition is for open space,passive recreational purposes, and wetland protection. Proposed uses of the property may include the establishment of a nature preserve,wetland restoration and passive recreational area with trails and limited parking for access purposes, all subject to a Management Plan which will be developed for this property; and WHEREAS, the purchase of this property is in conformance with the provisions of Chapter 17 (Community Preservation Fund) and Chapter 185 (Open Space Preservation) of the Town Code of the Town of Southold; and WHEREAS,the proposed action has been reviewed pursuant to Chapter 268 (Local Waterfront Consistency Review) of the Town Code and the Local Waterfront Revitalization Program (LWRP) and the LWRP Coordinator has determined that this action is consistent with the LWRP; and WHEREAS, the Land Preservation Coordinator and the Town Board have reviewed the acquisition in accordance with Chapter 117 (Transfer of Sanitary Flow Credits) of the Code of the Town of Southold, and have determined that seventeen point two (17.2) Sanitary Flow Resolution 2023-264 Board Meeting of February 28, 2023 Credits may be available for transfer from the property upon the Town's purchase of the property. The transfer of the Sanitary Flow Credits will not be finalized, and shall not occur, until the Town closes on the property, and the Town Board passes a resolution allowing the transfer of such credit into the sanitary flow credit(SFC)bank; and WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition and recommends that the Town Board acquires the property; and WHEREAS,the Town Board deems it in the best public interest that the Town of Southold purchase fee title to the subject property for open space and passive recreational purposes; and WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et.
