PUBLIC NOTICE: The regular Town Board Meeting will be held at the Southold Town
Recreation Center, 970 Peconic Lane, Peconic, NY 11958.
POLICY: At the beginning of scheduled Town Board meetings, the attending public is
encouraged to briefly address the Town Board relating to agenda resolutions prior to their
enactment; the public will also be given time at the conclusion of the regularly scheduled
business agenda to address the Board on any given topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting.
The video of the meeting is usually available to watch live during the meeting. Minutes with
adopted resolutions are available 1 to 2 days after the meeting. A full copy of the minutes,
agenda and meeting video can be viewed on the official Town of Southold website.

RESOLVED that the Town Board of the Town of Southold hereby grants permission to the
Bicycle Shows U.S. to hold four different length rides, all in accordance with the Application on
file in the Town Clerk's Office to the Gods Love We Deliver North Fork Century Bike Ride
on Saturday, May 16, 2026,beginning at 5:00 A.M. Provided the applicant agrees to comply
with all the conditions of the Southold Town Policy for Special Events on Town Properties and
Roads. A 2 million dollar insurance certificate must be filed before the event. Failure to comply
with conditions will result in the forfeiture of the deposit, subject to the approval of the Town
Attorney. Approval is for this year only, as the Town continues to evaluate road usage. The

Court interpreters from $385 to $500 for a Court day and from $220 to $300 for half or any part
thereof of a Court day, effective 4/1/2026.

WHEREAS, the State of New York has set additional reporting requirements in Section 315.4 of
the New York Codes, Rules and Regulations which requires all elected and appointed officials
whose terms start on or after August 12, 2009, who are members of the New York State and
Local Retirement System and who do not participate in their employer's time keeping system to
prepare a log of their work-related activities for three consecutive months and submit their logs
to the clerk or secretary of the governing body within 150 days of the start of their term;
NOW THEREFORE, BE IT
RESOLVED that the Town Board of the Town of Southold hereby establishes the following as
standard workdays for elected and appointed officials and will report the following days worked
to the New York State and the Local Employees' Retirement System based on the record of

Special Event 2026-3 Greenport Brewing Company Dog Dock Diving Festival
RESOLVED that the Town Board of the Town of Southold hereby grants permission to
Greenport Brewing Company to hold Special Event 2026-3 at the Greenport Brewing Co,
located at 42155 Main Rd., Peconic, New York, as applied for in the application GBC-la for
their 2026 Annual Dog Dock Diving Event on 5/16/2026 and 5/17/2026 from 9AM to 5PM.
This event is approved with the following conditions:
1. No Parking on Peconic Lane or Main Road as per parking plan.
2. Provided they adhere to ALL conditions on the application, permit and to the Town of

Southold Policy for Special Events. This permit is subject to revocation if the applicant fails to
comply with any of the conditions of the approval or is unable to properly control traffic flow

RESOLVED that the Town Board of the Town of Southold hereby grants permission to Times
Review to hold Special Event 2026-4 at the Borghese Vineyard, County Road 48, Cutchogue,
New York, as applied for in the application BV-1a for Special Event "Northforker Wine and
Food Classic" on Thursday, September 3rd, 2026 from 6PM to IOPM with the following
conditions from the Suffolk County Department of Economic Development and Planning,
Division of Planning and Environment:
1. The special use permit shall be valid on September 3rd 2026 only.
2. The "Northforker Wine & Food Classic" special event shall be conducted in accordance with
the proposal and updated site plan received by the Suffolk County Department of Economics
Development and Planning, Division of Planning and Environment.
3. The "Northforker Wine & Food Classic" special event shall not adversely impact the viability
of the agricultural operation and/or the associated natural resources; and
4. The landowner shall be responsible for compliance with all conditions of Farmland
Committee Resolution No. FC-19-2022, the deed of development rights, the contract of sale, and
all applicable federal, state, county, and town regulations, rules and statutes.
All parking must be contained on site. No stopping or standing on Country Road 48. Approval
provided that they adhere to all conditions on the application, Suffolk County Department of
Economic Development and Planning, Division of Planning and Environment needs to approve.
The event must go along with Town of Southold Policy for Special Events. This permit is
subject to revocation if the applicant fails to comply with any of the conditions of the approval
or is unable to properly control traffic flow into and out of the event.

Cutchogue-New Suffolk Historical Council to hold a "Family History Day 1776" event on

AM to 3:30 PM, (with a Rain date of June 6th, 2026)provided they comply with all the

Indemnity Agreement between Town of Southold and Mattituck Chamber of Commerce
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Albert J. Krupski, Jr., to execute an Indemnity Agreement between the Town of
Southold and the Mattituck Chamber of Commerce for the purpose of allowing one storage unit,
utilizing one parking space only, to be temporarily placed at the Love Lane Municipal Parking
Lot and to be utilized for the Mattituck Chamber of Commerce's First Fridays on Love Lane
equipment only, during the months of May through October. The Mattituck Chamber of
Commerce is to coordinate with the DPW director for placement of the storage container, and
they must label the unit as the owner, subject to the approval of the Town Attorney.

WHEREAS,the Town Board of the Town of Southold held a public hearing on the 21st day of
April, 2026 on the question of adding a parcel owned by Moffat Farm Tiny LLC to the
Town's Community Preservation Fund Eligible Parcel List and for the purpose of
purchasin,2 fee title to said parcel, together with parcels owned by Moffat Farm South LLC
and Moffat Farm Rabbit LLC, for open space purposes, at which time all interested parties
were given the opportunity to be heard; and
WHEREAS, said parcels are identified as SCTM#1000-55.-3-6.4 (Moffat Farm South LLC),
SCTM #1000-55.-3-6.5 (Moffat Farm Rabbit LLC), and SCTM #1000-55.-3-7 (Moffat Farm
Tiny LLC) (collectively, "Property"). The Property is located at 48460 & 50100 County Route
48 in Southold. The Property fronts on the southeasterly side of County Route 48 in two

locations, extends to Long Creek, and is in the R-80 Zoning District; and
WHEREAS,the proposed open space acquisition is for the Town of Southold, in a joint
50%150%partnership with the County of Suffolk, to acquire fee title to the entire 34.81[]-acre
Property for open space preservation. The exact area of the purchase is subject to survey; and
WHEREAS,the purchase price for the entire 34.81❑-acre Property is $110,000 (one hundred
ten thousand dollars)per acre, estimated at $3,829,100 (three million eight hundred twenty-nine
thousand one hundred dollars). The purchase price will be adjusted at the time of closing based
on the final surveyed acreage. The purchase will be funded by the Town's Community
Preservation Fund and the County of Suffolk in a 50%150%partnership, which will include the
purchase price and any related acquisition costs associated with the Property's purchase; and
WHEREAS, SCTM #1000-55.-3-7 will be added to the Community Preservation Project Plan
Eligible Parcel List for the establishment of parks, nature preserves, or recreation areas and the
preservation of open space; and
WHEREAS,the Property is listed on the Town's Community Preservation Project Plan as
property that should be acquired for the establishment of parks, natures preserves or recreation
areas; the preservation of open space; preservation of saltwater marshes or other wetlands; and
preservation of undeveloped beach lands and shoreline at significant risk of flooding and sea
level rise. Proposed uses of the property may include the establishment of a nature preserve or
other passive recreational area with trails and limited parking for access purposes, all subject to a
management plan that will be developed for the property; and
WHEREAS,the purchase of this property is in conformance with the provisions of Chapter 17
(Community Preservation Fund) and Chapter 185 (Open Space Preservation) of the Town Code
of the Town of Southold; and
WHEREAS,the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and the Local Waterfront Revitalization Program
(LWRP) and the LWRP Coordinator has determined that this action is consistent with the
LWRP; and
WHEREAS, as per Chapter 117 (Transfer of Development Rights) of the Code of the Town of
Southold, Section 1 17-5, the Land Preservation Coordinator and the Town Board have reviewed
the acquisition and have determined that Sanitary Flow Credits may be available upon the
acquisition of the property. The County of Suffolk will determine if Sanitary Flow Credits (a/k/a
County Workforce Housing Development Rights) are available, and if so, the number of
Sanitary Flow Credits available from the property. Any available Sanitary Flow Credits will be
divided between the County and the Town in accordance with the 50%150%joint partnership
percentage. The transfer of the Sanitary Flow Credits allotted to the Town will not be finalized,
and shall not occur, until the County and Town acquire title to the property, and the Town Board
passes a resolution allowing the transfer into the Town Sanitary Flow Credit Bank; and
WHEREAS,the Land Preservation Committee has reviewed the application for the acquisition
and recommends that the Town Board acquires the property; and
WHEREAS,the Town Board deems it in the best public interest that the Town of Southold
purchase fee title to the subject property for the purpose of open space, wetland, shoreline, and
habitat preservation and passive recreation; and

Action pursuant to the SEQRA Rules and Regulations, 6 NYCRR 617.1 et. Seq.; and

WHEREAS,the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact
on the environment and declares a negative declaration pursuant to SEQRA Rules and

B. Definitions and usages. Unless otherwise expressly stated, the following terms shall, for the
purpose of this chapter, have the meanings as herein defined. Any word or term not noted below
shall be used with a meaning as defined in Webster's Third New International Dictionary of the

ACCESSORY APARTMENT
An apartment created in a presently ex one-family dwelling unit or detached accessory
structure pursuant to § 280-13A(6) or § 280-13B(13).
§280-13 Use Regulations
A. Permitted Uses

a rental permit in

PH 4/21 at 6 PM - A Local Law in relation to a twelve (12) month extension of a Temporary
Moratorium on the issuance of approvals and/or permits for Battery Energy Storage System
(BESS) facilities
WHEREAS,there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 26th day of February 2026, a Local Law entitled, "A Local Law in
relation to a twelve (12) month Extension of a Temporary Moratorium on the issuance of
approvals and/or permits for Battery Energy Storage System (BESS) facilities" and
WHEREAS, that the Town Board of the Town of Southold held a public hearing on the
aforesaid Local Law at which time all interested persons were given an opportunity to be heard,
and
WHEREAS, as part of that proceeding, the Town Board of the Town of Southold referred the
local law to the Suffolk County Planning Commission and received their comments, and
WHEREAS,the Suffolk County Planning Commission issued its report regarding the proposed
Local Law after a public hearing, and voted to disapprove the proposed local law, and
WHEREAS,the rationale for the Planning Commission's decision was based on the newly
adopted updates to the New York Fire Code, which became effective January 2026. The
updated Fire Code was drafted in conjunction with the Governors 2023 working group which
was formed to examine the safety and security of BESS Systems, and encouraged the Town to
consult other municipalities BESS Code, and
WHEREAS, the Suffolk County Planning Commission also provided comments, and
WHEREAS, the Town Board, after the public hearing and in consideration of the entire record,
including the comments from the Suffolk County Planning Commission, intends to enact the
Local Law for extension of the BESS moratorium, as written; and it be
RESOLVED, in accordance with the requirements set forth in Section A14-22 of the Suffolk
County Administrative Code and Section 239-m(6) of the General Municipal Law, the Town
Board of the Town of Southold hereby sets forth the reasons the Town Board intends to override
the disapproval of the Commission:
1. The Planning Commission suggested the Town review the Model Law by NYSERDA,
which was published in February 2026, and the New York State Fire Code, which only
became effective January 2026. However, sufficient time must be granted to effectively
review and consider these suggestions. The NYSERDA guidance document for adopting
local zoning code for BESS calls for the first step in the process to be an update specific to
BESS in the Town's Comprehensive Plan, which in turn will support the zoning code for
BESS. The steps for updating even a small section of the Comprehensive Plan include
public input, which is time-consuming. Since this guidance document was issued in
February 2026, it is reasonable to expect it to take the Town considerable time to get
through the process of adopting changes to the Comprehensive Plan, and then developing
new code for BESS that is consistent with that update.

2. The Planning Commission also suggested the Town make only BESS portions of a
possible larger land use application the subject of whether a proposal is unfit. This twelve
(12) month moratorium extension is specific and would restrict BESS facilities only. If a

efforts and land use expertise to consider all possible options.
3. Finally, the Planning Commission suggested the Town engage with other
municipalities to review regulations that may relate to BESS. The Town has already
undertaken to do so and finds coordination will be productive but also time-consuming,
and it further be
RESOLVED that the Town Board finds the twelve (12) month extension of this moratorium is a
reasonable and necessary exercise of the Town's authority to preserve the status quo while the
Town reviews all of the above in addition to reconvening the Southold BESS Task Force to
review same and access their recommendations, and it further be
RESOLVED that this twelve (12) month moratorium extension is specific and would restrict
BESS facilities only. It is limited in terms of its reach, and does not affect any other type of
energy use. Further, the enacted law includes a mechanism for hardship applications.
Accordingly, the length of the moratorium extension is reasonable; and it be further
RESOLVED that the Town Board also finds that although not mentioned by the Suffolk County
Planning Commission, the Town is still heavily engaged in the Town Zoning Update which will
have huge bearing on the implementation of a BESS Code. The Zoning Update is a
comprehensive update of its zoning code. With limited resources, the process of zoning updates,
including those for BESS, take time to accomplish; and it further be
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed
Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a
Temporary Moratorium on the issuance of approvals and/or permits for Battery EnerIly
Storage System (BESS) facilities" and reads as follows:
LOCAL LAW NO. 2026
A Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a
Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy
Storage System (BESS) facilities".
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
I. PURPOSE - Moratorium Extension
In furtherance of Local Law 2025-4, which extended the Battery Energy Storage System (BESS)
moratorium, the Town Board acknowledges that BESS facilities are a key component to the
viability and promotion of renewable energy sources. The Town Board acknowledges the
storage systems play an important role in reducing demand and costs associated with grid
infrastructure, add capacity while lessening the burden on existing infrastructure and deter the
use of fossil fuels. However, significant public health and safety concerns relative to the
potentially volatile nature of lithium-ion batteries and battery storage operations remain. These
public health and safety concerns include location of mega-watt scale facilities in close

proximity to established residential areas.
On February 6, 2024, Governor Hochul's Inter-Agency Fire Safety Working Group released
recommendations for inclusion in the New York Fire Code. In July 2025, the Code Council
adopted the Fire Safety Working Croup's recommendations for the 2025 NYS Fire Code, which
took effect January 1, 2026.
4. The Town Board finds that in order to review and comply with the newly effected
Code, it will require extensive time and would not be resolved in the next months. The
Town Board acknowledges and understands the need for clear and concise laws to
successfully work toward a safe and effective Bess Code;
5. With the new State Fire Code in effect, the Town Board now must reconvene the Town
of Southold BESS Task Force to review the new Code, make recommendations to the
Town Board for adopting a BESS Code that complies and aligns with the NYS Fire Code;
6. Due to unforeseen circumstances, which include discontinuing the work with the
Zoning Code Consultants, and other matters, the ongoing comprehensive zoning update
project being conducted by the Town is not near completion. The new Zoning Code is
expected to be advertised for public comment in the next few months, which will require
an extensive public comment time and may delay the adoption by additional months. The
Town Board does not find it possible now to adopt a BESS code where the zoning update
is still being formulated. The BESS code is an integral part of the Zoning Code for the
Town. The zoning update, in conjunction with the Town's Comprehensive Plan and other
applicable town laws that will affect the BESS facilities,require guidance from the NYS
Fire Code as well as the Towns Task Force. The timeline for the Zoning Update, due to
circumstances beyond the Towns control, will be extended considerably.
A one (1)year moratorium was enacted by the Town Board of the Town of Southold as Local
Law 8-2023, on January 31, 2023, with an effective date of April It, 2023. The one (1) year
moratorium was further extended by the Town Board of the Town of Southold as Local Law
2024-6 with an effective date of April 3, 2024. Further extension was adopted by Local Law
2025-4 effective April 22, 2025 and the current moratorium is set to expire on April 22, 2026.
The moratorium as originally enacted, extended, and still intended to provide sufficient time
for the Town to undertake a thorough examination of these systems to identify any possible
threats to public health, safety and welfare as well as evaluate the potential for environmental
degradation.
The Town Board finds it necessary to extend the moratorium already in effect, the terms of
which remain unchanged and are set forth below. This action is necessary in order to protect
the character,public health, safety and welfare of the residents of the Town of Southold.
II. ENACTMENT OF A TEMPORARY MORATORIUM
Until twelve (12) months from the effective date of this Local Law, after which this Local
Law shall lapse and be without further force and effect and subject to any other Local Law
adopted by the Town Board during the twelve (12) month period, no agency,board,board
officer or employee of the Town of Southold including, but not limited to, the Town Board,
the Zoning Board of Appeals, the Trustees, the Planning Board, or the Building Inspector(s),
issuing any building permit pursuant to any provision of the Southold Town Code, shall

issue, cause to be issued or allow to be issued any approval, special exception, variance, site
plan,building permit, subdivision, or permit for any use identified as a Battery Energy
Storage System (BESS) facility.
III. EXCLUSIONS
This Local Law shall not apply:
1) To any person or entity who/which has,prior to the effective date of this Local Law,
obtained all permits required for such a facility and, relying upon such permission, has
undertaken significant development of such facility.
2) To any application by a municipal corporation or special district or fire district.
IV. AUTHORITY TO SUPERSEDE
To the extent and degree any provisions of this Local Law are construed as inconsistent with
the provisions of Town Law, this Local Law is intended,pursuant to Municipal Home Rule
Law, to supersede any said inconsistent authority.
V. VARIANCE TO THIS MORATORIUM
Any person or entity suffering unnecessary hardship as that term is used and construed in
Town Law section 267-b (2)(b),by reason of the enactment and continuance of this
moratorium may apply to the Town Board for a variance excepting the proposed use from the
temporary moratorium and allowing issuance of a permit all in accordance with the
provisions of the Southold Town Code.
VI. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate the
remainder of this Local Law.
VII. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.

SUBJECT: Per Diem Court Interpreter Rates and Payments for Canceled Assignments
*This supersedes the provisions of DFMBulletin 2403, dated March 18, 2024.
Effective April 1, 2026, the maximum rate of compensation for per diem interpreter ser-
vices provided to the courts and agencies of the Unified Court System shall be reimbursed at$500
for a full day rate (greater than 4 hours) whereas a half-day rate (less than 4 hours) shall be reim-
bursed at $300. This change in compensation is pursuant to Administrative Order AO/78/2026,
issued March 25, 2026.
Per Diem Interpreter Rates —Effective April 1, 2026
Full-Day Rate Half-Da Rate

The calculated work hours will be determined from the start of the first assignment to the
end of the last assignment. An interpreter may be assigned to multiple courts/assignments in any
given day.For assignments that conclude in a shorter time than expected,interpreters shall remain
available for additional assignments in the NYS Unified Court System during the timeframe for
which they are scheduled.
The above rates are applicable to all subcontractors providing per diem language or sign
interpreting services.
Payments for Canceled Assignments
If a per diem court interpreting assignment is canceled and the interpreter is notified:
• Prior to the scheduled hour on the previous business day—No fee is paid. For example,
if the assignment is scheduled for 9:00 AM on Wednesday, July 5th, the assignment
must be canceled prior to 9:00 AM on Monday, July 3rd as July 4t" is a holiday;

• Within 3 - 24 hours before the scheduled start time of the assignment—Half(50%) of
the regular fee is paid. If the assignment was scheduled for a full day at $500, the
interpreter is paid $250 for the canceled assignment. If the assignment was for a half
day at $300, the interpreter is paid $150 for the canceled assignment;
• Less than three (3) hours before the scheduled start time of the assignment— Full fee
is paid. If the assignment was scheduled for a full day, the interpreter is paid $500. If
the assignment was scheduled for a half day, the interpreter is paid$300; and
• If the canceled assignment was scheduled for multiple days, the interpreter would be
paid for the first day, at the full- or half-day rate, as applicable. Assignments scheduled
on the subsequent days of the multiple-day assignment are also subject to the cancella-
tion policy. For example, if the assignment concludes early on day one of a three-day
assignment, the full fee is paid for the first day and the following day is paid at half
(50%) of the regular fee paid. There would be no cancellation fee paid for day three.
If an assignment concludes in a shorter time than expected, the court should notify local
courts of the interpreter's availability and attempt to utilize the interpreter in other parts,or nearby
courts, for the time frame that was originally scheduled.
Should an interpreter accept an assignment on the date previously "canceled," which re-
sulted in a cancellation payment,the interpreter will be paid at the half-day rate,regardless of the
newly scheduled assignment time frame.
If an interpreter has an assignment canceled and the remaining assignment for that same
date results in a full-day payment, the interpreter will be paid $500 for that day in total. For ex-
ample,if the$150 cancellation fee was paid,the remaining payment to the interpreter would be$350.
Administrative closings, for reasons including inclement weather and emergencies, are ex-
cluded from this policy.
The interpreter will be deemed "notified" of a cancellation when notice is sent by e-mail
to the address on file with the Office of Language Access and as recorded in the Electronic Sched-
uling System for Court Interpreters (E-system). A copy of the cancellation email must be attached
to the invoice and will be uploaded to SFS when submitted for payment. Courts should complete
and submit to the appropriate fiscal office the new UCS CIX-PDInvoice claim form to process
payment for canceled assignments. The form does not require the interpreter's signature.
Required Information for SFS Data Entry
"Invoice Number" — The invoice number is unique for each claim form and is created by
the fiscal office upon data entry of date,type, and court assignment. SFS data entry guidelines are
as follows:

Type of Canceled Assignment: XHD (Half Day), or XFD (Full Day)

WHEREAS, the Board of Commissioners of the Fishers Island Ferry District(the "District"), in
the Town of Southold, Suffolk County, New York, pursuant to a resolution duly adopted and a
petition in due form,has requested that the Town Board of the Town of Southold(herein called
the "Town"), in the County of Suffolk, New York, call a public hearing on behalf of the District
to hear all persons interested in the proposed increase and improvement of facilities of the
District, consisting of the replacement of the South Vehicle Offloading Ramp at the District's
Fishers Island Terminal, at the aggregate estimated maximum cost of$1,600,000; and the Town
Board has determined that it is in the best interests of the Town and the District to increase and
improve the facilities of the District pursuant to Section 202-b of the Town Law and to hold said
public hearing, as requested; and
WHEREAS, the Town, has given due consideration to the impact that the project may have on
the environment pursuant to the State Environmental Quality Review Act(SEQRA), constituting
Article 8 of the Environmental Conservation Law, and 6 N.Y.C.R.R., Part 617(c) and has
determined that it is a Type II action and is not subject to review under SEQRA;
NOW, THEREFORE, the Town Board hereby determines to commence proceedings under
Section 202-b of the Town Law, and it is hereby
ORDERED, that a meeting of the Town Board of the Town be held at the Town Hall, 53095
Main Road, Southold, New York, on May 20, 2026 at 6:00 o'clock P.M. (Prevailing Time) to
consider said increase and improvement of facilities of the District and to hear all persons
interested in the subject thereof concerning the same and for such other action on the part of the
Town Board with relation thereto as may be required by law; and it is
FURTHER ORDERED, that the Town Clerk publish at least once in "The Suffolk Times" and
"The Day,"hereby designated as the official newspapers for such publication, and post on the

WHEREAS, the Town Board of the Town of Southold held a public hearing on the 21 st day of
April, 2026 on the question of adding a parcel owned by Moffat Farm Tiny LLC to the
Town's Community Preservation Fund Eligible Parcel List and for the purpose of
purchasing fee title to said parcel, together with parcels owned by Moffat Farm South LLC
and Moffat Farm Rabbit LLC, for open space purposes, at which time all interested parties
were given the opportunity to be heard; and
WHEREAS, said parcels are identified as SCTM#1000-55.-3-6.4 (Moffat Farm South LLC),
SCTM #1000-55.-3-6.5 (Moffat Farm Rabbit LLC), and SCTM#1000-55.-3-7 (Moffat Farm
Tiny LLC) (collectively, "Property"). The Property is located at 48460 & 50100 County Route
48 in Southold. The Property fronts on the southeasterly side of County Route 48 in two
locations, extends to Long Creek, and is in the R-80 Zoning District; and
WHEREAS, the proposed open space acquisition is for the Town of Southold, in a joint
50%150%partnership with the County of Suffolk, to acquire fee title to the entire 34.81:]-acre
Property for open space preservation. The exact area of the purchase is subject to survey; and
WHEREAS, the purchase price for the entire 34.81❑-acre Property is $110,000 (one hundred
ten thousand dollars)per acre, estimated at $3,829,100 (three million eight hundred twenty-nine
thousand one hundred dollars). The purchase price will be adjusted at the time of closing based
on the final surveyed acreage. The purchase will be funded by the Town's Community
Preservation Fund and the County of Suffolk in a 50%150%partnership, which will include the
purchase price and any related acquisition costs associated with the Property's purchase; and
WHEREAS, SCTM#1000-55.-3-7 will be added to the Community Preservation Project Plan
Eligible Parcel List for the establishment of parks, nature preserves, or recreation areas and the
preservation of open space; and

WHEREAS, the Property is listed on the Town's Community Preservation Project Plan as
property that should be acquired for the establishment of parks, natures preserves or recreation
areas; the preservation of open space;preservation of saltwater marshes or other wetlands; and
preservation of undeveloped beach lands and shoreline at significant risk of flooding and sea
level rise. Proposed uses of the property may include the establishment of a nature preserve or
other passive recreational area with trails and limited parking for access purposes, all subject to a
management plan that will be developed for the property; and
WHEREAS, the purchase of this property is in conformance with the provisions of Chapter 17
(Community Preservation Fund) and Chapter 185 (Open Space Preservation) of the Town Code
of the Town of Southold; and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and the Local Waterfront Revitalization Program
(LWRP) and the LWRP Coordinator has determined that this action is consistent with the
LWRP; and
WHEREAS, as per Chapter 117 (Transfer of Development Rights) of the Code of the Town of
Southold, Section 117-5, the Land Preservation Coordinator and the Town Board have reviewed
the acquisition and have determined that Sanitary Flow Credits may be available upon the
acquisition of the property. The County of Suffolk will determine if Sanitary Flow Credits (a/k/a
County Workforce Housing Development Rights) are available, and if so, the number of Sanitary
Flow Credits available from the property. Any available Sanitary Flow Credits will be divided
between the County and the Town in accordance with the 50%/50%joint partnership percentage.
The transfer of the Sanitary Flow Credits allotted to the Town will not be finalized, and shall not
occur, until the County and Town acquire title to the property, and the Town Board passes a
resolution allowing the transfer into the Town Sanitary Flow Credit Bank; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition
and recommends that the Town Board acquires the property; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase fee title to the subject property for the purpose of open space, wetland, shoreline, and
habitat preservation and passive recreation; and
WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted
Action pursuant to the SEQRA Rules and Regulations, 6 NYCRR 617.1 et. Seq.; and
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and
Regulations; and
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact
on the environment and declares a negative declaration pursuant to SEQRA Rules and

Regulations for this action; and,be it further
RESOLVED that SCTM #1000-55.-3-7 is hereby added to the Community Preservation Project
Plan Eligible Parcel List and a copy of the plan shall be filed with the Commissioner of
Environmental Conservation, the Commissioner of Agriculture and Markets, and the
Commissioner of the Office of Parks, Recreation and Historic Preservation; and, be it further
RESOLVED that the Town Board of the Town of Southold hereby enters into a joint 50%/50%
partnership with the County of Suffolk to purchase fee title to property owned by Moffat Farm

I. Purpose
The Purpose of the amendment is to update the Southold Town Code with regard to Accessory
Apartments.

The Southold Town Code is hereby amended by removing the struck through words and adding
the underlined words as follows:

B. Definitions and usages. Unless otherwise expressly stated, the following terms shall, for the
purpose of this chapter, have the meanings as herein defined. Any word or term not noted below
shall be used with a meaning as defined in Webster's Third New International Dictionary of the

ACCESSORY APARTMENT
An apartment created in a,..,wady o* one-family dwelling unit or detached accessory
structure pursuant to § 280-13A(6) or § 280-13B(13).
§280-13 Use Regulations

III. Severability

IV. Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided

ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
APRIL 21, 2026:
WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 26th day of February 2026, a Local Law entitled, "A Local Law in
relation to a twelve (12) month Extension of a Temporary Moratorium on the issuance of
approvals and/or permits for Battery Energy Storage System (BESS) facilities" and
WHEREAS, that the Town Board of the Town of Southold held a public hearing on the
aforesaid Local Law at which time all interested persons were given an opportunity to be heard,
and
WHEREAS, as part of that proceeding, the Town Board of the Town of Southold referred the
local law to the Suffolk County Planning Commission and received their comments, and
WHEREAS, the Suffolk County Planning Commission issued its report regarding the proposed
Local Law after a public hearing, and voted to disapprove the proposed local law, and
WHEREAS, the rationale for the Planning Commission's decision was based on the newly
adopted updates to the New York Fire Code, which became effective January 2026. The updated
Fire Code was drafted in conjunction with the Governors 2023 working group which was formed
to examine the safety and security of BESS Systems, and encouraged the Town to consult other
municipalities BESS Code, and
WHEREAS, the Suffolk County Planning Commission also provided comments, and
WHEREAS, the Town Board, after the public hearing and in consideration of the entire record,
including the comments from the Suffolk County Planning Commission, intends to enact the
Local Law for extension of the BESS moratorium, as written; and it be
RESOLVED, in accordance with the requirements set forth in Section A14-22 of the Suffolk
Page 11G of 123
County Administrative Code and Section 239-m(6) of the General Municipal Law, the Town
Board of the Town of Southold hereby sets forth the reasons the Town Board intends to override
the disapproval of the Commission:
1. The Planning Commission suggested the Town review the Model Law by NYSERDA,
which was published in February 2026, and the New York State Fire Code, which only
became effective January 2026. However, sufficient time must be granted to effectively
review and consider these suggestions. The NYSERDA guidance document for adopting
local zoning code for BESS calls for the first step in the process to be an update specific to
BESS in the Town's Comprehensive Plan, which in turn will support the zoning code for
BESS. The steps for updating even a small section of the Comprehensive Plan include
public input, which is time-consuming. Since this guidance document was issued in
February 2026, it is reasonable to expect it to take the Town considerable time to get
through the process of adopting changes to the Comprehensive Plan, and then developing
new code for BESS that is consistent with that update.
2. The Planning Commission also suggested the Town make only BESS portions of a
possible larger land use application the subject of whether a proposal is unfit. This twelve
(12) month moratorium extension is specific and would restrict BESS facilities only. If a
BESS facility were part of a larger land use application, the Town would certainly use best
efforts and land use expertise to consider all possible options.
3. Finally, the Planning Commission suggested the Town engage with other municipalities
to review regulations that may relate to BESS. The Town has already undertaken to do so
and finds coordination will be productive but also time-consuming, and it further be
RESOLVED that the Town Board finds the twelve (12) month extension of this moratorium is a
reasonable and necessary exercise of the Town's authority to preserve the status quo while the
Town reviews all of the above in addition to reconvening the Southold BESS Task Force to
review same and access their recommendations, and it further be
RESOLVED that this twelve (12) month moratorium extension is specific and would restrict
BESS facilities only. It is limited in terms of its reach, and does not affect any other type of
energy use. Further, the enacted law includes a mechanism for hardship applications.
Accordingly, the length of the moratorium extension is reasonable; and it be further
RESOLVED that the Town Board also finds that although not mentioned by the Suffolk County
Planning Commission, the Town is still heavily engaged in the Town Zoning Update which will
have huge bearing on the implementation of a BESS Code. The Zoning Update is a
comprehensive update of its zoning code. With limited resources, the process of zoning updates,
including those for BESS, take time to accomplish; and it further be
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed
Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a
Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy

Storage System (BESS) facilities" and reads as follows:
LOCAL LAW NO. 2026
A Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a
Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy
Storage Svstem (BESS) facilities".
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
1. PURPOSE - Moratorium Extension
In furtherance of Local Law 2025-4, which extended the Battery Energy Storage System (BESS)
moratorium, the Town Board acknowledges that BESS facilities are a key component to the
viability and promotion of renewable energy sources. The Town Board acknowledges the storage
systems play an important role in reducing demand and costs associated with grid infrastructure,
add capacity while lessening the burden on existing infrastructure and deter the use of fossil
fuels. However, significant public health and safety concerns relative to the potentially volatile
nature of lithium-ion batteries and battery storage operations remain. These public health and
safety concerns include location of mega-watt scale facilities in close proximity to established
residential areas.
On February 6, 2024, Governor Hochul's Inter-Agency Fire Safety Working Group released
recommendations for inclusion in the New York Fire Code. In July 2025, the Code Council
adopted the Fire Safety Working Group's recommendations for the 2025 NYS Fire Code, which
took effect January 1, 2026.
4. The Town Board finds that in order to review and comply with the newly effected
Code, it will require extensive time and would not be resolved in the next months. The
Town Board acknowledges and understands the need for clear and concise laws to
successfully work toward a safe and effective Bess Code;
5. With the new State Fire Code in effect, the Town Board now must reconvene the Town
of Southold BESS Task Force to review the new Code, make recommendations to the
Town Board for adopting a BESS Code that complies and aligns with the NYS Fire Code;
6. Due to unforeseen circumstances, which include discontinuing the work with the
Zoning Code Consultants, and other matters, the ongoing comprehensive zoning update
project being conducted by the Town is not near completion. The new Zoning Code is
expected to be advertised for public comment in the next few months, which will require
an extensive public comment time and may delay the adoption by additional months. The
Town Board does not find it possible now to adopt a BESS code where the zoning update
is still being formulated. The BESS code is an integral part of the Zoning Code for the
Town. The zoning update, in conjunction with the Town's Comprehensive Plan and other
applicable town laws that will affect the BESS facilities, require guidance from the NYS

Fire Code as well as the Towns Task Force. The timeline for the Zoning Update, due to
circumstances beyond the Towns control, will be extended considerably.
A one (1)year moratorium was enacted by the Town Board of the Town of Southold as Local
Law 8-2023, on January 31, 2023, with an effective date of April 11, 2023. The one (1)year
moratorium was further extended by the Town Board of the Town of Southold as Local Law
2024-6 with an effective date of April 3, 2024. Further extension was adopted by Local Law
2025-4 effective April 22, 2025 and the current moratorium is set to expire on April 22, 2026.
The moratorium as originally enacted, extended, and still intended to provide sufficient time
for the Town to undertake a thorough examination of these systems to identify any possible
threats to public health, safety and welfare as well as evaluate the potential for environmental
degradation.
The Town Board finds it necessary to extend the moratorium already in effect, the terms of
which remain unchanged and are set forth below. This action is necessary in order to protect
the character,public health, safety and welfare of the residents of the Town of Southold.
II. ENACTMENT OF A TEMPORARY MORATORIUM
Until twelve (12) months from the effective date of this Local Law, after which this Local
Law shall lapse and be without further force and effect and subject to any other Local Law
adopted by the Town Board during the twelve (12) month period, no agency,board, board
officer or employee of the Town of Southold including, but not limited to, the Town Board,
the Zoning Board of Appeals, the Trustees, the Planning Board, or the Building Inspector(s),
issuing any building permit pursuant to any provision of the Southold Town Code, shall issue,
cause to be issued or allow to be issued any approval, special exception, variance, site plan,
building permit, subdivision, or permit for any use identified as a Battery Energy Storage
System(BESS) facility.
III. EXCLUSIONS
This Local Law shall not apply:
1) To any person or entity who/which has,prior to the effective date of this Local Law,
obtained all permits required for such a facility and, relying upon such permission, has
undertaken significant development of such facility.
2) To any application by a municipal corporation or special district or fire district.
IV. AUTHORITY TO SUPERSEDE
To the extent and degree any provisions of this Local Law are construed as inconsistent with
the provisions of Town Law, this Local Law is intended, pursuant to Municipal Home Rule
Law, to supersede any said inconsistent authority.

V. VARIANCE TO THIS MORATORIUM
Any person or entity suffering unnecessary hardship as that term is used and construed in
Town Law section 267-b (2)(b),by reason of the enactment and continuance of this
moratorium may apply to the Town Board for a variance excepting the proposed use from the
temporary moratorium and allowing issuance of a permit all in accordance with the provisions
of the Southold Town Code.
VI. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate the
remainder of this Local Law.
VIL EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.
