SCTM No. 1000-53-6-39 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 12,500 square foot parcel located in the Residential R-40 Zoning District. The northerly property line measures 100.00 feet and is adjacent to Bayshore Road, the westerly property line measures 125.00 feet, the southerly property line measures 100.00 feet and the easterly property line measures 125.00 feet. The parcel is improved with a two-story frame dwelling with an attached garage, an existing paver patio at the rear of the dwelling and a 12 feet by 8 feet shed located in the southeast rear corner of the property as shown on the survey map prepared by Kenneth M Woychuk, LS and last revised April 2, 2026. BASIS OF APPLICATION: Request for Variance from Article XXIII, Sections 280-124 and the Building Inspector's December 17, 2025, AMENDED February 19, 2026,Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; at: 1) more than the code permitted maximum lot coverage of 20%; located at 3080 Bayshore Road, Greenport,N.Y. SCTM No. 1000-53-6-39. RELIEF REQUESTED: The applicant requests a variance to construct an accessory in-ground swimming pool on the subject premises. The proposed construction, on this nonconforming 12,500 square foot parcel located in the Residential R-40 Zoning District, is not permitted pursuant to Article XXIII, Section 280-124, which stipulates a maximum lot coverage of 20%. The proposed pool will cause lot coverage to be non-conforming at 22.7%. ADDITIONAL INFORMATION: The original application requested a lot coverage of 21.5% which resulted in the issuance of a Notice of Disapproval dated December 17, 2025. An amended application to the Building Department requested a proposed lot coverage of 22.7%,an increase of 1.2 percentage points or 5.6%. During the public hearing, the applicant offered to remove the 12 feet by 8 feet shed which will reduce lot coverage by 96 square feet, resulting •' Page 2,April 16,2026 #8107 Dealy SCTM No. 1000-53-6-39 in 21.9% lot coverage. A new survey must be prepared to show drywell location along with the location of the pool mechanicals. The applicant has also agreed to plant screening along the rear of the property. AMENDED 'APPLICATION: On April 10, 2026 the Board of Appeals received a survey from the applicant by Kenneth M. Woychuk, Land Surveying, PLLC last revised April 2, 2026, amending the proposed lot coverage to 21.9%thereby bringing the application into more conformity with the code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 2,2026 at which time written and oral evidence were presented. Based upon all testimony,"documentation, personal inspection of their property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law �267-b(3)(b)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are common in this community. Other lot coverage requests exceeding the code-allowed 20% have also been approved in this community by the Zoning Board of Appeals. The proposed pool is in the code required rear yard which is visually screened from the street and adjacent properties by the subject dwelling, mature evergreens,brambles and deer fencing 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing lot coverage of 20.6%already exceeds the code permitted maximum of 20% maximum so any additional structure will necessitate variance relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 9.5%relief from the code. However, removing the shed has reduced the lot coverage and the size of the proposed in-ground swimming pool is modest in size at 10 feet by 26 feet or 260 square feet. 4,. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Weisman(Chairperson),seconded by Member Planamento, and duly carried,to GRANT the RELIEF AS AMENDED for Lot Coverage of 21.9% as shown on_a survey by Kenneth M. Woychuk, Land Surveying, PLLC last revised April 2, 2026. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall remove the 8 feet by 12 feet shed from the premises. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. Pursuant to § 280-11, the Applicant has submitted documentation, to the satisfaction of the Board that these lots were merged consequent to the death of the owners. There have been no transfers of ownership outside the family since the time merger was effected. Pursuant to §280-11,the Zoning Board finds that; (1) The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood. Many of the lots on the landward side of Bayshore Road are smaller than the subject lots proposed to be unmerged and there are few vacant lots remaining in the community. Many of the homes have been improved over the years and are quite large on much smaller sized lots than the subject lots. (2) The waiver would recognize a lot that is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation. The community known as Peconic Bay Estates is an area with diverse sized lots and homes. In 1966 the subdivision lots identified by the Suffolk County Clerk's office as lots 130 and 131 were sold to Mr.John Rempe and his wife, Stacia M. Rempe, now known as SCTM as#1000-53-6-40 in 1966. Mr. John Rempe, Jr. in 1956 filed a deed in the Suffolk County Clerk's office for lots 128 and 129 which is known as SCTM#1000-53-6-39. Mrs. Rempe has resided in the home on the adjacent improved lot 40 for the last 60 years. The subject"vacant" lot 39 and the improved lot 40 appear to be one lot. Grass has been planted and carefully maintained on lot 39; a continuous hedgerow has been planted along the property lines of both lots; and an accessory shed has been built on the "vacant" lot 39 to store the applicant's lawnmower and gardening tools. Therefore the Board cannot find that the lot to be unmerged has historically been treated as a separate vacant lot. When this was discussed at the public hearing, the applicant's agent informed the Board that Mr. and Mrs. Rempe added an attached garage and sun room to their house in 1994,and that they limited their addition to a one car garage in order to maintain the code required 10 feet side yard setback from the common property line with lot 39. She also indicated that, in 1987, the Town of Southold issued a Certificate of Occupancy for lot SCTM#1000-53-6-39 as a "vacant land." There is also an asphalt apron on Bayshore Road for access to lot 39 should a dwelling be built in the future. (3)The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because many of the Iots in the subdivision are smaller than the subject lots; the area is almost totally, built out; there is public water on the street; and the conditions imposed herein will protect local water quality and community character.
