SCTM Nos. 1000-9-5-14 and 1000-9-5-16.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING BOARD: The application was referred to the Southold Town Planning Board for comment. In a memorandum dated March 31, 2026,the Planning Board stated that they had no objection to the area variance required to allow the lot line change as it is a site-specific circumstance. Any approval should be carefully conditioned to reflect the unique factors and to avoid establishing a broader precedent. PROPERTY FACTS/DESCRIPTION: The subject properties are conforming lots. The existing Lot 14 is a 41,132 square foot parcel located in the Residential R-40 Zoning District. The existing Lot 16.1 is a 54,457 square foot parcel located in the Residential R-40 Zoning District. The northerly property line of Lot 14 measures 136.53 feet and is adjacent to Cresent Avenue, the easterly property line measures a total of 275.82 feet and is adjacent to Glenmaine Avenue,the southerly property line measures 181.47 feet,and the westerly property line measures a total of 287.91 feet and is adjacent to Oriental Road. The northerly property line of lot 16.1 measures 144.39 feet, the easterly property line measures 134.00 going southerly then turns northeasterly 80.00 feet for a total of 214.00 feet,the southerly property line measures 91.17 feet then measures northeasterly 44.41 feet, then measures southeasterly 135.00 feet for a total of 270.58 feet and the westerly property line measures 45.00 feet and runs northwest in three segments of 263.80, 96.89 and 30.99 feet. Lot 14 is improved with an existing single-family dwelling and two existing cottages. The first building is a one- story dwelling located at the westerly side of the property with an attached screened porch and an outdoor shower located on the east side of the dwelling, the second building is an existing cottage located to the east of the existing first dwelling with an attached wood deck located on the east of the dwelling, and the third building is an existing cottage located to the south of the second cottage with a small attached wood deck located on the south of the cottage. BASIS OF APPLICATION: Request for Variances from Article III, Sections 280-18 and the Building Inspector's November 7, 2025 Notice of Disapproval base on an application for a permit for a lot line modification; at: (1 proposed lot no.14 having less than the code required minimum lot size of 40,000 square feet; 2) proposed lots 14 and 16.1 having less than the code required minimum lot depth of 175 feet; 3)cottages(two) located on proposed lot numbers 14 and 16.1 less than the code required minimum side yard setback of 15 feet; 4) existing cottage on proposed lot no. 16.1 constitutes a non-permitted second use; at: 806 Oriental Avenue, Fishers Island,N.Y. SCTM Nos. 1000-9-5-14 and 100-9-5-16.1. RELIEF REQUESTED: The applicant requests variances for a lot line change. The proposed lot line change on this conforming 41,457 square foot lot located in the Residential R-40 Zoning District (Lot 14) and this conforming 54,457 square foot lot located in the Residential R-40 Zoning District(Lot 16.1), is not permitted pursuant to Article III, Section 280-18 which states;No building or premises shall be used and no building or part thereof shall be erected or altered in the R-40 District.unless the same conforms to the requirements of the Bulk Schedule, with the same force and effect as if such regulations were set forth herein in full. Proposed parcel 1000-9-5-14 - Bulk Schedule requires a minimum lot size of 40,000 square feet and lot depth of 175 feet. Following the proposed lot line change, this parcel will be nonconforming, measuring 31,246 square feet with a lot depth of 136.53 feet. Proposed parcel 1000-9-5-16.1—Bulk Schedule requires a minimum lot depth of 175 feet. Following the proposed lot line change,this parcel will be nonconforming with a lot depth of 147.35 feet. In addition,the proposed lot line change is not permitted pursuant to the Bulk Schedule which requires a minimum side yard setback of 15 feet. The lot line change will result in one existing cottage on Lot 14 and one on Lot 16.1 to each have minimum side yard setbacks of 13.7 feet. Furthermore,the lot line change is not permitted as it will result in an existing cottage (being relocated from Lot 14 to the newly proposed Lot 16.1 [64,343 square feet])constituting a second use on this lot. The bulk schedule requires 40,000 square feet for each use. Lastly, the proposed lot line change requires approval from the Southold Town Planning Board. ADDITIONAL INFORMATION: The applicant has entered into a contract with The Lighthouse Works,Inc.,a New York not-for-profit corporation,providing for the sale of Lot 14 by the applicant to Lighthouse and the reacquisition from Lighthouse by the applicant of the cottage on Lot 14 located nearest to Lot 16.1 (referred to and known as the "Shire Cottage"). The purpose of the lot line change is to permit the reacquisition of the Shire Cottage by the applicant so that it may continue its current use of the Shire Cottage to provide housing for musicians who perform at the applicant's seasonal worship services while simultaneously raising funds from the sale of Lot 14 to fund its operating and capital expenses and further mission work. By permitting the applicant to reacquire the Shire Cottage, the lot line change will allow the community-based Lighthouse to retain funds for the restoration of the historic Hans C. Hansen House on Lot 14 that would otherwise have been applied to the acquisition of the Shire Cottage for which it has no current need. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 2, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: J Page 3,April 16,2026 #8095, St Johns Episcopal Church SCTM No. 1000-9-5-14& 16.1 1. Town Law $267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The request merely permits a relocation of the boundary line between Lot 14 and Lot 16.1. In this unique situation,the new boundary line will not increase density, impair views from any nearby properties, or create any issues or changes in the existing neighborhood. The Southold Town Planning Board stated, "the total amount of land and existing development on the site will remain unchanged, and the proposal does not introduce any new or intensified use." 2. Town Law§267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. In order for the applicant to sell Lot 14 with the objective to reacquire the Shire Cottage to provide significant contribution to the conduct of its liturgical services, the only recourse is to apply for the lot line change and to incur the associated need for variances. 3. Town Law U67-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 21.9% lot size relief and 22% lot depth relief for the new Lot 14, 15.8% lot depth relief for the new Lot 16.1, 8.6% relief for each of the two side yard setbacks, and 100% relief for the second use on the new Lot 16.1. However, there are no feasible alternatives for the applicant to pursue in order to retain the Shire Cottage while also realizing the sale of Lot 14. Further, despite the number and magnitude of the variances granted herein, there is no new or intensified use on either parcel and there are no physical changes to,or relocations of,any of the existing structures. Lastly,due to the nonconformances introduced with this lot line change, any future additions, alterations, or construction on either the new Lot 14 or the new Lot 16.1 will require further relief from this Board. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of lot line changes while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Weisman(Chairperson),seconded by Member Planamento, and duly carried,to GRANT the variances as applied for,and shown on the Re-Subdivision Map prepared by Craig P. Bigger, LS, and dated August 1, 2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall obtain Subdivision Approval from the Southold Town Planning Board. Rich III, Chairman Members of the Planning Board �C Date: March 31, 2026 Re: ZBA#8095, St. John's Episcopal Church Located at 664 & 806 Oriental Avenue, Fishers Island SCTM#1000-9.-5-14 & 16.1 The Planning Board has reviewed your request for comments regarding the above-referenced application, and provides the following for your consideration. 1. Area Variance/Relief from �280-18: The applicant is requesting relief from §280-18, which requires that all buildings and premises in the R-40 Zoning District conform to the Town's Bulk Schedule. The proposal involves a lot line modification between two existing parcels owned by St. John's Episcopal Church on Fishers Island, which would result in nonconformities related to minimum lot area, lot depth, and required side yard setbacks, as well as the presence of a second principal structure on a parcel that does not meet the minimum lot size. In considering this request, the Planning Board notes that the total amount of land and existing development on the site will remain unchanged, and the proposal does not introduce any new or intensified use. The Board also recognizes the unique geographic and historic context of Fishers Island, where development patterns often reflect long- standing lot configurations and structures that predate current zoning requirements. The subject properties include historically significant buildings dating back to the late 19th century, and the proposed lot line change aims to better align property boundaries with these existing conditions. The requested relief is driven by a reconfiguration of property boundaries to facilitate the sale of one parcel and the retention of an existing cottage, which can only be achieved through the proposed lot line adjustment. 2. Comprehensive Plan Consistency The Planning Board notes that the proposed lot line adjustment is consistent with the Town of Southold Comprehensive Plan's goals and vision. The Town seeks to preserve its extraordinary history and community character while supporting thoughtful, site- specific solutions that maintain existing structures and land uses. Both St. John's Episcopal Church(1881) and the associated Hans C. Hansen House (circa 1870s) are recognized cultural resources and identified in the Town's Comprehensive Survey of Historic Resources (SPLIA, 1988) as being of regional importance. Chapter 5, Goal 2 of the Comprehensive Plan emphasizes the protection and management of the Town's historic and architectural resources, and Objective 2.2(E) specifically notes the Town's intent to encourage preservation by providing appropriate zoning flexibility for historic structures. The requested relief would allow the Church to realign property boundaries to better reflect existing site conditions without altering or expanding historic buildings, thereby supporting the preservation of these cultural assets in a manner consistent with the Comprehensive Plan's stated objectives. 3. Recommendation Given that the proposal does not increase density or intensity of use, and primarily relates to existing, pre-existing conditions on a fixed land area,the Planning Board views this as a site-specific circumstance. Ali of the foregoing variances relate to the requirements under Section 280-18 of the Zoning Code(by reference to the Bulk Schedule and Parking Schedule). Since the relief sought relates to the dimensional and physical requirements of the Zoning Code, the requested variances are area variances. Town Law §267.1. Therefore, the standards of Town Law§267-b(3)(b)apply. The factors to be considered by a zoning board of appeals in making a determination regarding an area variance under Town Law§ 267-b(3)(b) are as follows: (1)the benefit to the applicant as weighed against the detriment to the health, safety and welfare of the neighborhood; (2)whether an undesirable change will be produced in the character of the neighborhood or to nearby properties; (3)whether the benefit sought can be achieved in another manner; (4)whether the variance is substantial; (5) whether the variance will have an adverse effect on physical or environmental characteristics;and (6) whether the alleged difficulty was self-created. An examination of the circumstances present in the instant matter in light of the foregoing factors follows. 1. Relative'Benefit and: Detriment. The applicant has entered into a contract with The Lighthouse Works, Inc., a New York not-for-profit corporation ("Lighthouse"), providing for the sale of Lot 14 by the applicant to Lighthouse and the 2 reacquisition from Lighthouse by the applicant of the cottage on Lot 14 located nearest to Lot 16.1 (hereinafter referred to as the "Shire Cottage"). That portion of the sales price attributable to the Shire Cottage will be held in escrow pending issuance of the approvals required for the lot line change and will be returned to Lighthouse upon the reconveyance of the Shire Cottage to the applicant or released to the applicant if any required approval is denied. The purpose of the lot line change is to permit the reacquisition of the Shire Cottage by the applicant so that it may continue its current use the Shire Cottage to provide housing for musicians who perform at the applicant's seasonal worship services while simultaneously raising funds from the sale of Lot 14 to fund its operating and capital expenses and further its mission work. By permitting the applicant to reacquire the Shire Cottage,the lot line change will also allow the community-based Lighthouse to retain funds for the restoration of the historic Hans C. Hansen House on Lot 14 that would otherwise have been applied to the acquisition of the Shire Cottage for which it has no current need. There would clearly be no detriment to the health, safety or welfare of the neighborhood by the granting of the requested variances. They would have no impact on the current permitted uses for residential purposes. There would be no increase in noise or traffic. The character of the neighborhood would not be adversely affected since the variances would not increase the permitted number of homesites and,with no surface or subsurface disturbance of existing grounds or structures there would be no impact, let alone a significant impact, on physical and environmental conditions at the site. Under these circumstances, the benefits sought by the applicant clearly outweigh any conceivable detriment to the public. 3 , J 2. Cha"racterofthe Nelghborh'ood. The granting of the variances would have no impact whatsoever on the character of the neighborhood, let alone an adverse impact.The variances would merely permit the relocation of the boundary line between Lot 14 and Lot 16.1. The new boundary line will not result in an increase in density, impair views from any nearby properties or otherwise produce any perceptible changes in the neighborhood. Indeed, as the Planning Board noted as a factor to be considered in its March 31, 2026 Memorandum to your Board, "the total amount of land and existing development on the site will remain unchanged, and the proposal does not introduce any new or intensified use." 3. Alternatives. In order for the applicant to realize the proceeds of sale of Lot 14 which it intends to use to fund its operating and capital expenses and further its mission work while continuing to use the Shire Cottage for its seasonal housing needs,the proposed change to the existing lot line separating Lot 14 from Lot 16.1 is absolutely necessary. Indeed, with both Lots already improved, dimensional variances would be required however the new line is drawn. For the applicant to achieve the objective of reacquiring the Shire Cottage to provide a significant contribution to the conduct of its liturgical services,the benefit sought cannot practicably be achieved in another manner. In order for the applicant to sell Lot 14 but continue to keep the Shire Cottage for its housing needs, the land on which that Cottage is situated must be removed from Lot 14 and added to Lot 16.1,thereby creating a necessity for variances. The circumstances giving rise to the need for the new lot configurations are clearly unique to the properties and not the result of some personal whim of the owner. 4 4. Substantial Nature of Variance: If the applicant were proposing to add a second use on a parcel thatwould be nearly 16,000 square feet short of the required minimum lot area for that purpose or to create a new lot with a lot area of 31,246 square feet in an R-40 Zone District(78% of the required minimum lot area), then the requested variances could indeed be deemed to be substantial. In this case, however, the degree of the variances must be evaluated in light of existing conditions and alternatives. For example, the second use requested for Lot 16.1 is a residence, the Shire Cottage, that already exists in the same size and same location; no new use is being proposed for that portion of the property the applicant intends to reacquire. Furthermore,while Lot 14 would be reduced by 9,886 square feet, Lot 16.1 will be increased by the same amount so there will be no reduction in the overall lot area devoted to residential use.The variances will not have any impact on existing conditions and the goal of separating of the Shire Cottage from Lot 14 cannot be achieved without creating some nonconformities. In any event, there is no feasible alternative to variances in order for the applicant to realize the benefit of retaining the Shire Cottage while simultaneously realizing the proceeds from the sale of Lot 14. Based on the foregoing circumstances present in the application before you,the requested variances should not be deemed to be substantial. 5. Impact on Physical and Environmental Conditions. There will be no impact on physical and environmental conditions at the site as the variances will neither sanction nor prohibit the introduction of additional activities or structures. 6. Self-Created Hardship: Self-created hardship is not an issue in this case where the applicant is merely requesting permission to change the dividing line between two adjoining parcels and has not taken any improper actions from which it seeks 5 to be extricated from the consequences. CONCLUSION For the foregoing reasons and in the interests of justice, the variances requested in order to permit the relocation of the lot line between Lot 14 and Lot 16.1 should be granted.
