SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions,exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject nonconforming 29,033 square feet, 0.667 acre, rectangular- shaped parcel located in the R-40 Zoning District, is improved with a two-story frame house,a detached garage,pool and shed(latter two improvements subject of this application). The parcel fronts Sound Beach Drive to the north for 100.00 feet and has a second front yard paralleling Summit Drive to the south for 120.06 feet. The adjoining property line to the east is 266.84 feet and the adjoining property line to the west is 261.58 feet. The parcel is accessed via a 10-foot right-of-way(r.o.w.)from Summit Drive,over a building lot also owned by the applicant. There is no access from Sound Beach Drive. Approximately half of the parcel (southern portion) is at a substantial elevation 100+/- (where the improvements are constructed)and the remainder has a steep slope down to Sound Beach Drive as shown on the survey prepared by Nathan Taft Corwin lIl, L.S. dated May 21, 2003, last revised December 20,2017, "Final Survey". BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; and the Building Inspector's October 6, 2025 Notice of Disapproval based on an application for a permit to demolish an existing dwelling and construct a new single family dwelling and install an in-ground swimming pool; at: 1) swimming pool is located in other than the code permitted rear yard; 2) existing shed is partially located in other than the code permitted rear yard; located at: 1795 Summit Drive, Mattituck,NY. SCTM No. 1000-106-1-30.2. RELIEF REQUESTED: The applicant requests two variances,previously,granted but now expired,for the"as built" construction of an inground swimming pool located in the front yard and the"as built"construction of an accessory shed located in a side yard,where the code requires both improvements to be located in a rear yard. ADDITIONAL INFORMATION: The applicant is the beneficiary of prior relief granted, pennitting the construction of the improvements subject of this application, under Zoning Board of Appeals file #6965 dated July 22,,2016 for IF, Page 2, April 16,2026 #8094,Livanos SCTM No. 1000-106-1-30.1 which Town of Southold Building Permit#51122(replacing building permit#40827)was issued on August 23,2024 for the"demolition of an existing single family dwelling and construction of a new single family dwelling as applied for only, per SCHD approval" and Southold Town Building Permit #41681 was issued on May 30 2017 for the construction of an inground swimming pool as applied for per ZBA approval. The `as built' shed existed in its location prior to the demolition of the house and construction of a new residence. On December 30,2024,the applicant's architect wrote to the Town of Southold Zoning Board of Appeals a request for an extension to ZBA determination #6965. In a letter dated January 10, 2025, the Zoning Board of Appeals responded to the applicant's architect that as a result of not addressing the request in a timely manner ("...any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured within three (3) years from decision date. The Board may, upon written request, prior to the date of expiration, grant one-year extensions, not to exceed three consecutive years, all totaling six years."), to be advised that even if all extensions were granted, the variance would cease being valid on July 21, 2022, long before the extension request date. The applicant's agent is presently seeking the same relief as previously granted in order to `close out' the open building permit and obtain a Certificate of Occupancy for the improvements. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 2,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are common accessory structures to residential properties and the adjoining parcels to the east and west both have an in-ground swimming pool in a location similar to what the applicant proposes. The subject accessory shed presently exists in its location without evidence of detriment to nearby properties. 2. Town Law V67-b(3)(b)(2)- The benefit sought by the applicant to construct an in-ground swimming pool cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The parcel is subject to two front yards and there is no rear yard to construct an in-ground swimming pool in a conforming location. Placing the accessory structure in a code conforming location cannot be achieved since there is no rear yard. 3. Town Law V67-b(3)(b)(3). The variance granted herein to locate an in-ground swimming pool in a front yard location is mathematically substantial, representing 100% relief from the code. However, the subject parcel has no conforming rear yard in which to locate accessory structures and the two adjoining parcels, both similarly subject to two front yards, each have in-ground swimming pools in a front yard location.The variance granted herein to locate an accessory shed partially in a side yard is mathematically substantial, representing 100% relief from the code. However,the `as built' shed existed prior to the residential demolition and new construction, partially in a side yard location without a compliant location to place it. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. J Page 3,April 16,2026 #8094, Livanos SCTM No. 1000-106-1-30.1 5. Town Law U67-W)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an inground swimming pool and accessory shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Steinbugler, and duly carried, to GRANT the variances as applied for,and shown on the survey prepared by Nathan Taft Corwin III,L.S.,last revised December 20,2017, "Final Survey". SUBJECT TO THE FOLLOWING CONDITIONS: 1. The septic system on the subject property must be approved by the Suffolk County Department of Health Services. 2. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a shed-type enclosure with a lot line set back that is in conformance with the bulk schedule for accessory structures. 3. Drywell for pool de-watering shall be installed. 4. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s) and submit same to the Office of the Zoning Board of Appeals within 6 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a Certificate of occupancy in the time allotted. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar desion that is de minimis in nature for an alteration that does not increase the decree of nonconformity, provided de minimis relief is requested within one year of the date of this decision. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7,2016, at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are common accessory structures to residential properties and the adjoining parcels to the East and West both have an in-ground swimming pool in a location similar to what the applicant proposes. The subject accessory stucco shed presently exists in its location without evidence of detriment to nearby properties. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant to construct an in-ground swimming pool cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. The parcel is subject to two front yards and there is no rear yard to construct an in-ground swimming pool in a conforming location. However,the subject parcel has no conforming rear yard in which to locate accessory structures and the two adjoining parcels, both similarly subject to two front yards, each have in-ground swimming pools in a front yard location. The variance granted herein to locate a stucco accessory shed partially in a side yard is mathematically substantial, representing 100% relief from the code. However, the existing stucco shed appears to presently exist partially in a side yard location and to continue this partial side yard location is not substantial. 4. Town Law &267-b(3)N(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool and existing shed location, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
