MOSLEY WWW.DOS.NY.GOV SECRETARY OF STATE In the Matter of the Petition of: DECISION PETER FIGLIOZZI For a Variance to the New York State Uniform Fire Prevention & Building Code PETITION NO. 2025-0700 Upon the application of Peter Figliozzi, filed pursuant to 19 NYCRR§1205.5(a)on September 22, 2025, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the alteration of an existing one-family dwelling, 2 stories in height, of type VB construction, and having a gross area of approximately 6,693 square feet, located at 120 Caiola Court, Greenport, Town of Southold, County of Suffolk, State of New York. Relief is requested from: • 19 NYCRR, Part 1220,The Residential Code of New York State, Section 311.6,Hallways. Which requires that the width of a hallway shall be not less than 3 feet. [The Petitioner is requesting relief from the required minimum hallway width of 3 feet in a passageway in the basement of the residence to allow a 2 feet 4 inches wide hallway, as a result of installing insulation and furring on the existing basement walls.] FINDINGS OF FACT 1. The subject building was constructed in 2022, and the owner proposes alterations in the basement to"finish"the basement to provide additional living and storage space. 2. The project includes alteration work that includes furring the existing basement walls out 2 inches; the hallway that is the subject of the petition is an existing passage from the basement under the residence to the attached garage. 3. The subject hallway which is the connecting passage measures 36 inches before the proposed furring, insulation and drywall is applied to both sides to conceal piping and wiring, reducing the width to 2 feet 4 inches for a distance of 2 feet 6 inches in length. The petition meets the threshold of a de minimus element that does not have a substantial adverse effect on health, safety&security. 5. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would not substantially adversely affect the Code's provisions for health, safety and security, and would be physically impracticable or would entail a change so slight so as to produce a negligible additional benefit consonant with the purpose of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR PART 1220, SECTION 311.6, to be, and is hereby PROPOSED TO BE GRANTED with the flowing conditions: 1. That all other elements and conditions meet the requirements of the Residential Building Code for alterations,which include the installation of smoke and carbon monoxide detection in the new spaces in accordance NFPA 72. This DECISION is issued under 19 NYCRR 1205.5. Unless objected to by the petitioner in a writing received by the department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
