Klipp at Greenport, on Monday, November 10, 1958 and the meeting was called to order at 7:OO P.M. with the following present: Supervisor Klipp; councilmen Albertson and Demarest; Justices Tuthill and Clark; Town Attorney Tasker and Town Clerk Booth. The public hearing on the petition 'of. GEORGE W. SMITH & SOU§, INC. IRVING LATHAM, ANGELLO PETRUCCI aad EDWIN H. KING for a change of zone from "A" Residential and Agricultural District xmt to "C" Industrial District and EUGENE PASKARZ for a change' of zone from "A" Residential & Agricultural District to "M" Multiple REsident District was opened by the Supervisor at 7:00 P.M. Lederle, Moved "by Justice Tuthill; seconded by Councilman Albertson: WHEREAS; a petition was received from 14ENNETH PAPISH, relative to change of zone, NOW, THEREFORE, BE IT RESOLVED: That the Town .Clerk of the. Town of ' outhold be and he hereby is directed to transmit this applic- ation to the Planning Board in accordance with Section 901, Subdiv- ision C of Article 1X of the Building Zone Ordinance of the Town of Southold. Movee by Councilman .Albertson; .seconded by Councilman Demarest: WHEREAS, the Southold Town Planning Board has prepared an official report and recommendation upon the proposal of KENNETH PAPISH for change of zone from "A" Residential and Agric. Dist. to "B" Business Dist. on certain real property situate at Mattituck, NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold .Town Board at the Supervisor's office in Greenport, on Tuesday, Nov. 25, 1.958, at 7:00 P.M. on the above mentioned petition. Moved by Justice Tuthill; seconded by Councilman Albertson: RESOLVED: That the Town Board on its own motion amend the Southold Town' Building Zone Ordinance including the Building Zone Maps by changing from "A" Residential and Agric. Dist. to "B" Business Dist. the following described property: ALL .that certain piece of parcel of land situate at Mattituck, in 4fs the Town of Southold, County of 'Suffolk, and State of New York, more particularly bounded and described as follows; BEGINNING at a .point on the southerly line of Sound .Avenue at the northwesterly corner of land of Sepko and the northeasterly corner of Papis.h, said point of beginning being about 180 feet westerly along said southerly line of Sound Avenue from the point . . where said southerly line would be in6ersected by the direct ex- tension southerly of the westerly line of Cox Neck Road; from said point of beginning running southerly along said land of Sepko 1000 feet, more or less, to the northerly line of the Long Island Lighting Co. easement; thence westerly along said northerly line , 242 feet, more or less; thence northerly along land of Sacks, 1092 feet, more or less to said southerly line of Sound Avenue; thence easterly along said southerly line of Sound Avenue, 300 feet, to the point of beginning. BE .IT FURTHER RESOLVED: That this proposed amendment be referred to the Southold Town Planning Board f or its recommendation and official report. Vote of Town Board: Ayes-Supervisor Klipp; councilmen Albertson and Demarest; Justices Tuthill and Clark. i Moved by Justice Tuthill; seconded by Courici;man .Albertson: WHEREAS , by the preceding resolution the Town Board proposed to amend _ the Southold Town Building Zone Ordinance on its own motion; and WHEREAS , this Board now deems it advisable. that the question of -rezoning said property should be initiated by the application of the owners of said property rather than by this Board on its own motion NOW, THEREFORE, BE IT RESOLVED: that the preceding resolution be and it hereby is in all respects recinded. Moved by Councilman Albertson; seconded by Justice Tuthill: WHEREAS an application has been filed with this Board by. DAVID I: DeFRIESI" requesting an amendment of the Southold Town Building' Zone . Ordinance, .including the Building Zone Maps by changing from "A" Agricultural and Residential District to "B'; Business District certain real property on the north side of Route 25 at Mattituck, New York, said property being more fully described in said application, and WHEREAS, the property along the southerly side of Toute 25 opposite the property described in said ,application as well as the property on the horth =side of Route 25 west of Wickham Avenue , is presently. ` zoned "B" Business, and. the business growt4 in this area warrants the creation of additional business zones , and WHEREAS , it is the opinion of this Board that the property described in said application as well as other property on the northerly side of Route 25, westerly to Wickham .Avenue, should be rezoned from "A" Residential and Agricultural District to "B" Business District, NOW, THEREFORE] BE IT RESOLVED: that the Town Board of. the Towhi of Southold refer to the Southold Town Planning Board for its official'' report, the proposal to amend, on its .own motion, the Southold Town Building Zone Ordinance, including the Building Zone Maps , by changing from ".A" Residential and AGric. District to "B" Business District , the following described property: , ALL that certain tract of land situate at Mattituck, in the .Town 'of ' Southold, County of 'Suffolk, and State -of Ne.w York, more particularly bounded and described as follows:. BEGINNING at the intersection of the northerly line of the Main Road with the easterly line of Wickham Avenue; from said point of beginning ..running northerly along said easterly line of Wickham Avenue, 19.5 feet, more or less; thence easterly along land now or formerly of Duryee and along land now or formerly of Conklin Estate ,. 254 feet, more or less;. thence northerly along said land now or formerly of Conklin Esta.tei 60 feet, more or less; thence easterly along land of Dries and along land of Hollenbeck, 97 feet, more or less; thence, southerly along land of Edward F. Jerome, 265 feet, more or less,, to said northerly line of. the Main Road; thence westerly along said northerly line of the Main Road, 343 feet, more or less, to the point of beginning. BE IT (FURTHER RESOLVED:. that- the Town Clerk be and he hereby is authorized *ad directed to request in writing that the Southold Town Planning Board prepare an official report pursuant to Section 901 of said Ordinance concerning said proposed amendment. Moved by Justice Tuthill; seconded by Councilman Albertson: WHEREAS, the Town Board of the Town of Southold by resolution has re- ferred to the Southold Town Planning Board for its recommendation and report a proposal to amend the Southold Town Building Zone Ordinance°l including the Building Zone Maps by changing from "A" Residential and Agricultural District to "B" Business District certain property on the north side of Route 25 at Mattituck, New York, which property is more particularly described in said resolution, and. WHEREAS , the recommendation and official report of. sa.id Planning. Boerd concerning said proposed amendment has been filed with the Town Board, NOW, THEREFORE, BE IT RESOLVED: that a public hearing be held by the Southold Town Board on sdi.d. proposal at the Supervisor 's Office , 16 South Street, Greenport, New York., on = the 25th day of November, 1958, at 7:00 o'clock P.M. of said days Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. 8 5 Moved by Justice Tuthill; seconded-by Justice Clark: WHEREAS., the Town Board of the Town of Southold has heretofore referred to the Southold Town Planning Board for its recommendation, . and report, proposals to amend the Southold Town Building Zone Ordinance by amending Article 1, Section. 100, by adding thereto a new ' paragraph to be paragraph 9A; by amending Article Vll, by adding thereto' a new Section to be Section 703B, and by amending Article X by ddding thereto anew Section to be Section 1000A , and WHEREAS, the said Planning Board has filed its report on- said proposed amendments with the Town Board , ` NOW, THEREFORE BE IT RESOLVED, that a public 'hearing be held by the Southold Town �oard on said proposed amendments at the Supervisor's Office, lb South Street, Greenport, New..York, on November 25th, 1958, at 7:00 o1cl6ck of said day. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS , an application has been made to the Town Board of the Town of Southold on behalf of Sunrise Coach Lines, Inc. , for a bus fran- chise within the Town of '- outhold, and WHEREAS, , a public heating upon said application was held by this Board after due notice thereof on November,10th7 1958, and WHEREAS, this Board deems it in the public interest that said franchise. be granted, NOW THEREFORE, BE IT RESOLVED: that the Supervisor be and he hereby is' authorized to execute a franchise agreement on behalf of the Town of `'outhold substantially in the same .form as the proposed agreement now on file with the Town for a period of ten years at a fee of $30.00. Moved by Justice Clark; seconded by Councilman Demarest: WHEREAS, a petition was heretofore filed with the Town Board of the Town of Southold by EDWIN H. KING requesting a change , modification and" amendment of the Building Zone Ordinance including the Building Zone Maps_ made a part thereof by changing from "A" Res. & Agric. Dist. to "C" Industrial District the property described in said petition, and WHEREAS, said petition was duly regerred to the Planning .Board for its investigation, recommendation and report, and its report having been filed with the Town Board, and thereafter, a public hearing in relation to said petition having been duly held by the .Town Board on the loth` day of' November, 1958, 'and due deliberation having been had thereon, N0W, THEREFORE, BE IT RESOLVED that the relief demanded .in said . petition be, and it hereby is granted. District to "C" Industrial District the property described in said petition, and WHEREAS, said petition was duly referred to the Planning Board gor , its investigation, recommendation and. report, and its report having been filed with the Town Board, and thereafter, a publid hearing in relation to said petition having been duly held by the Town Board on the loth day of November, 1958, and due deliberation having been had thereon NOW, THEREFORE, BE IT RESOLVED that the relief demanded in said petition be, and it hereby is denied. Zone Maps mdde a part thereof by changing from "A" Res. & Agric. . District to "C" Industrial District the property described in said petition, and WHEREAS, said petition was duly referred to the Planning Board for .,its investigation, recommendation and report, and its report having been filed with the Town Board, and thereafter, a public hearing in relation to said petition having been duly held by the Town Board on the loth day of Nov- ember, 19,58, and due deliberation having been had thereon NOW, THEREFORE, BE IT RESOLVED that tie relief demanded in said petition, be and it hereby is denied. Moved by Justice Tuthill; seconded by Councilman Albertson:_ WHEREAS, a petition was heretofore filed with the Town Board of the Town of Southold by ANGELLO PETRUCCI requesting a change, modification ,and- , amendment of the Building' Zone Ordinance including the Building' Zone Maps made a part thereof by changing from "A" Residential and Agricultural ' District to "C" Industrial District the .property described in said petition, and WHEREAS, SAID PETITION WAS DULY REFERRED TO THE Planning Board' for its investigation, recommendation and report, and its report having been filed with the Town. Board, and. thereafter., a public hearing in relation to said petition having been duly held by the Town Board obi the - 10th. day of November, 1958, and due deliberation having been had thereon NOW, THEREFORE BE IT RESOLVED that the relief -demanded in said petition be, and it hereby is denied. PUSKARZ requesting a change , modification and amend ment of the Building Zone Ordinance including the Building Zone Maps made a part thereof by chanting from "A" Residential and A ricultural Dist- rict to "M" Multiple Residant District the property described . in said petition, and WHEREAS, SAID petition was duly referred to the Planning Board for its investigation, recommendation and report, and its report having .been filed with the Town Board, and thereafter, a public hearing in relation to said petition having been duly held by the Town Board- on the loth day of November, 1958, and due deliberation having been had thereon NOW, THEREFORE, BE IT RESOLVED that, the relief demanded in slid petition be, and it hereby is denied. .
