There were present: Messrs. Robert -W. Gillispie, Jr. , Chairman, Robert Bergen, , Herbert Rosenberg, Charles Grigonis, . Ur.' , and Serge Doyen, .Jr. . On motion of Mr. Grigonis, seconded by Mr. Doyen, it was RESOLVED that the minutes of July 5, 1962 be approved as submitted. Vote of the Board: Ayes: - Mr. Bergen, Mr. Grigonis, . Mr. Doyen, ,and Mr. Rosenberg and Mr. Gillispie. . ;PUBLIC HEARING: Appeal No. 483 - 7: 30 P.M. (E.D.S.T. ) , upon application of Phyllis' R. Moore, 3 Bryant Road, Glen Cove, New York, for recognition of access in accordance .with .STate of New York Town Law, Section 280A. Location of property: south side Peconic -Bay Boulevard, .'Laurel, New York, property bounded north by land of :Phyllis R. Moore, east by J. A. The Chairman opened the hearing by reading application for access, . legal notice of hearing, .affidavit attesting to its publication in the official newspaper and notification to the applicant. THE CHAIRMAN: Is there anyone, present who wishes ' to speak for this application? WILLIAM WICKHAM, ESQ_ , , Mattituck, New York. I do. Does this application include access to the Bay lot? THE CHAIRMAN: No, it says on the application "center lot; " You will have to make another application. for. the Bay lot. Is there anyone present who wishes to speak against this application? (There was no response. ) After investigation and inspection the Board finds that this property being approximately 500 ft. in length and 100 ft. frontage on both Peconic Bay and Peconic Bay Boulevard is to be divided into three lots each containing more area than required in our Ordinance. Access is to be afforded by a private road at , least 15 feet in width. The present application is for the middle lot. The Boulevard lot has access along its entire 100 ft. frontage. The intended private road has not been completed and in consequence the Board finds that temporary access should be granted to enable the passage of vehicles used in construction. A certificate of occupancy should not be issued until a right- of-way has been completed at least 15 feet in width andsuitable for use according to the legal requirements. On motion of 'Mr. Gillispie, seconded by Mr. Bergen., it was RESOLVED that Phyllis R. Moore be granted recognition of Southold Town Board of Appeals -3- July 12, 1962 access to the center lot of her property located on the south side of. Peconic Bay Boulevard, Laurel, New York. This lot is bounded north by otherland of Phyllis R. . Moore, east by J. A. Driscoll, south by land of 'Phyllis R. Moore, and west by G. L. Penny. This access is temporary to enable the passage of vehicles used in construction. A certificate of occupancy should not be issued until a right-of-way has been completed at least 15 ft. in width and suitable for use according to the legal requirements. Vote of the Board: Ayes: - Mr. Gillispie, Mr. Ber gen, Mr. Rosenberg, and Mr. Grigonis. PUBLIC HEARING: Appeal No. 484 - 7:45 'P.M. (E.D.S.T. ) , upon application of Alexander W. Koke and Frederick C. Koke, Youngs Avenue, Southold, New York, for a variance in accordance with the Zoning ordinance, . Article IV, . Section 409, for permission to set off a business lot with reduced frontage and area. Location of property: west side Youngs Avenue, Southold,, New York, bounded north by other land of Koke Bros. , east by Youngs Avenue, south by C. Eiscmann, and west by other land of Koke Bros. Fee paid $5. 00. The Chairman opened the hearing by reading application for a variance, legal notice. of -hearing, affidavit attesting to its publication in the official newspaper and notification to the applicant. Edson gave the history of the property, stating that the building on the proposed lot has been used for a barbershop and the upper f1mr has been an apartment. The building has not been used as part of -the automobile business. ) During the preliminary discussion Mr. Edson, attorney for the applicants requested a recess for one week so that he might consult with the applicants and secure additirn al information. Koke be granted a recess until 9: 15 P.M. , Thursday, July 19, 1962. Vote of the Board: Ayes:- Mr. Gillispie, .Mr. Bergen, Mr. Rosenberg,. and Mr. Grigonis. Mr. Albert Zanowski appeared before the Board of Appeals to discuss their favorable decision on appeal of J. Herbert Cassidy for permission to rent a labor camp on the property of I. P. Krupski, Bridge Lane, East Cutchogue. Mr. Zanowski owns property on Bridge Lane and does not. favor the Board's decision. PUBLIC HEARING: Appeal No. 485 - 8: 00 P.M. (E.D. S. T. ) , upon application of .Russell Tabor & Sons, Village Lane, Orient, New York, for a special exception in accordance with the Zoning Ordinance, Article X,,. Section 1003a, for permission to expand an existing private labor camp. Location of property: east side Platt Road, Orient, New York, bounded north by W. B. Karcher and V. T. Latham, east by R. W. Gillispie, south by G. W. Hallock, and west by Platt Road. Fee paid $5. 00. The Chairman opened the hearing by reading application for a special exception, legal notice of hearing, affidavit attesting to its publication in the official newspaper and notification to the applicant. THE CHAIRMAN: We have the following letter from George. W. Hallock: "July 12, 1962, To Whom it May Concern: I have no objections to the present plans of Russell9Abor & Sons for increasing the size of their labor camp adjoining my property. " Is there anyone present who wishes to speak for this appli- cation? MR. WENDELL TABOR, Orient, New York: George Hallock is the nearest house and is approximately 300 .feet from the camp building. Southold Town Board of :Appeals -5- July 12, 1962 (Mr.. Tabor stated that they are making improvements according to Health Department requirements and will have ' room for 12 workers. The camp itself .is approximately ,2500 feet from the' Main Road. ) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response. ) After investigation and inspection the Board finds that the farm in- question is one of several owned and operated by . the applicant in the. immediate vicinity. A labor camp has been operated on the same location since 1952. . Due to the discontinuance of the Greenport -Eastern Suffolk Cooperative Labor 'Camp the farmers must house the temporary labor. The pr.esent. camp is being remodeled to conform to the strict regulations of the County'"Health -Department and another building is being added. This camp is about 2500 feet .from a main road and while it is near a residence the tenant and owner has given approval of the. plan.. This is. open farm country and the use of so called migrant labor is .an accepted practice and in the ,past -has not been obj ectionable... This type -of farmlabor is essential for the conduct of these farms and all camps are under rigid supervision of the, -County Health au horities . as well as inspection by .State Police -at regular 'intervals. The Board finds that inasmuch as this type of labor camp on the 'farms of -active owners is definitely a requirement for the operation .of .the local farms a permit valid -until, December 31, 1962 should be issued for the housing of 12 workers. The _limited time will give all concerned an opportunity to observe the conduct and result of these camps. . All of the requirements and standards set .forth in the ordinance have been met. On motion of :Mr. Gillispie, seconded by Mr. Bergen, it was Southold Town Board of Appeals -6- July 12, 1962 RESOLVED that Russell Tabor & Sons be granted permission to expand an existing private labor camp.
