WAIVER OF NOTICE OF' TOVII BOARD MEETING WE, the undersigned - being. members of the Town Board of the Town of, Southold Suffolk County, 'New York, do hereby severally waive notice of the time, place and -purpose of the meeting of the Town Board, to be held at Greenport in the -Town of Southold New York, ' on Wednesday, Septembdr 24, 195$, and do hereby consent that the same be held on said date for the transaction of any business which may properly come before the said meeting. Tuthill, Justice of .the Peace and Ralph P. .Booth, Town Clerk. The Southold Town Board met. at the office .of Supervisor Norman E. Klipp at 'Greenport, on Wednesday, September 24, 1958. The meeting was called to -order at 1:30 P.-M. with the following present: Supervisor Klipp; Counilman Demarest; Justices Tuthill and Clark; Supt. of. Highways .Price Town Attorney Tasker and Town Clerk Booth. Moved by Councilman Demarest; seconded by Justice Tuthill: RESOLVED: That the minutes .of the meeting. of. September 9 and September 23 be and. the same hereby are duly approved as read. Vote of Town Board: "Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill . and Clark. Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That Supervisor Norman E. Klipp be and he hereby is author- ized to advertise-for bids for the purchase of automobile tires for use on the police cars and for bids to furnish and deliver to the Town of Southold approximately 32, 500 gallons of special grade gasoline for use of the Town Police and Town Highway Department. Vote of Town Board: Ayes- Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest; RESOLVED: That Supervisor Norman• E. Klipp be and he hereby is authorized to purchase and install one new blinker light at the intersection of. Depot Lane and County Road 27A at Cutchogue, Town of Southold, N.Y. Vote of Town Board: Ayes-Supervisor Klipp; councilman Demarest; Justices Tuthill and' Clark. Moved by Justice Tuthill; seconded by Councilman Demarest: RESOLVED: That Supervisor Norman E. Klipp be and he hereby is authorized to petition the State Department of Public Works to place a NO PARKING OR STANDING sign in the area of the South Side of State Highway Route 25 from the Green port Corporation line to the East side of nth Street, Green- port, Town of bouthold, N.Y. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Councilman Demarest- seconded by Jutice Clark: RESOLVED:, That Bond No. 1S122194, issued by The .Aetna Casualty and Surety Company on behalf of Edna R. Angell, in the sum of 'Two Thousand ($2,000.00) Dollars be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Vote of Town Board: Ayes-Supervisor Klipp; Uouncilman Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS, the Southold Town P lanning Board has prepared an official report and recommendation upon the petition of Charles 0. Ziegler for a change of zone from "A" Residential and Agricultural District to "M" Multiple Resident District on certain real property situate at East Marion, N.Y. NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Superviosr's Office in Greenport,' on Tuesday,. October 11+, 1958, at �:30 P.M. Vote of Town Board; Ayes-Supervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Councilman Demarest: WHEREAS, JOHN NEWELL has applied to the Town Board fvr a single auto- mobile trailer permit, NOW, THEREFORE, - BE IT RESOLVED: That the application of John Newell to locate a single automobile trailer on the property of Sylvia Barnes, Main Road, Mattituck, N.Y. be and hereby is granted. Vote of Town Board: .Ayes-Sypervisor Klipp; Councilman Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest; WHEREAS WILLIAM CALEY has applied to the Town Board for a single automobile trailer permit, NOW, THEREFORE, BE IT RESOLVED: That the application of WILLIAM CALEY to locate a single automobile trailer on his property, Main Road, Southold, N.Y. be and hereby is granted, providing that the minimum distance on the side yard on the east side is not less than 10 feet and the minimum setback is not less .than 35 feet and the minimum distance in the rear yard is not less than 25 feet. Vote of Town '-'Board: Ayes-Supervisor Klipp; `councilman Demarest; Justices Tuthill and Clark. The hearing on the proposed amendments to the Trailer Camp Ordinance was opened by the Supervisor at 2:00 o'clock P.M. . He read the call of the hearing and then called upon any person present who wished to speak either . in favor or in opposition to the proposed Amendments to the Trailer Camp Ordinance. There was no response in the negative. Howard M. Terry spoke in favor of the proposed amendments. The hearing was closed at 2:1 5 P.M. for further deliberation of the Board pending a resolution vote. Moved by Councilman Demarest; seconded by Justice Tuthill: RESOLVED: That the Southold. Town Board does hereby make the following Amendments . to the Southold Town Ordinance Providing For The Regulation Of Tourist Camps, House Trailer Camps, House Trailers, or Similar Establishments: 1. By amending Section 1,1 subdivision (c) to read as follows: (a) Camp Cottage is defined to be any small building of whatever zflaterial cdnstructed having less than 350 square feet of enclosed area and used as .living or sleeping quarters and constructed and equipped only for seasonal occupancy. 2. By amending Section 1, subdivision (e) to read as follows:. . . (e) Board or Department of Public Health shall mean any such Board or Department established pursuant to the laws of the State of New York and entrusted with the regulation, controldand supervision of matters pertaining to and effecting the public health in the Town of Southold. 3. By amending Section 2 to read as - follows: ,.Section 2. It whall. be unlawful for any person or persons, firm, association, corporation or co-pattnership to establish , maintain or operate within the limits of the Town of Southold, any tourist camp on any location or plot of ground for use of transients by the day, week, month or season, whether a charge is or is not made, who does not possess a permit from the Department of Health and the Town Board of the Town of `Southold.. The permit issued by the Town Board shall not be transfer- able or assignable and may be revoked for cause by such Board after a hearing. 4. By amending Section 3 to read as follows: Section 3. .Any person or persons, firm, association corporation or co-partnership hereafter applying for a permit and/or license to establish' and operate a tourist camp must first file with the Town Clerk a complete plan of the proposed camp. This plan with the legal description of the property shown, shall be drawn to scale and must clearly show the extent and 'area to be used for camp purposes. All proposed roadways and/or drive- ways, method of sewage disposal plan for water supply and lighting and each proposed location or site for tents, tent houses, camp cottages and/or zzttxgzx trailers or camp cars must be shown on such plan. 5. By amending Section 7 to read as follows: (Section 7.) Each unit in any tourist. camp upon which' a tent' tent . house, trailer or house car 'is erected and placed and each unit in any tourist camp upon which a camp cottage is hereafter erected or placed shall be not less than 40x 50 feet in area .clearly defined by markers .in each corner. 6. By repealing Sections 8 and 9 of said Ordinance. 7. By amending and renumbering Section 10 to be Section 81 to read as follows: Section 8. No cottage hereafter erected or placed upon a site. shall be less than 15 feet distant from any other building. 8. By amending and renumbering Section 11, to be Section 91 to read as follows: Section 9., No trailer or camp . car shall be located on- any.site where there is less than 15 feet betwecn, such trailer. or camp car. and. other - buildings, trailers or camp cars . included in the camp. With'.,the, exception of cottages preVi6usly placed or erected, . no cottage, trailer or scamp car shall be placed or .erecteA within 20 feet from the property or highway . lines. .9. By amending and renumbering Section 12 to be Section 10, to read as follows Section 10, Adequate roadways ,or driveways shall be provided which . shall be so' located that each unit of the camp is easily accessible ' thereto. Said roadways or driveways shall be adequately lighted while such camp is occupied and such roadways or driveways shall be so constructed.,and maintained that a dust nuisance will not be created. All entrances and exits from the camp shall be well marked and so arranged that they will be easily controlled and supervised. 10. By repealing Section 13 of said Ordinance. 11. By renumbering, and amending Section 14 to be Section 11, to read as follows: Section 11. Each tourist camp shall be 'under the direct management of the owner or licensee or his agent or representative for whose acts he or they shall be fully responsible. The names of the persons entrusted with the direct management of the camp shall be filed for reference with the Southold Town Police. 12. By renumbering and amending Section 15 to be Section 129 to read as follows: Section- 12. Each tourist camp shall keep copies of all records per- taining to the management or supervision of the camp which records shall be available for inspection. 13. By renumbering and amending Section 16 to be Section 13, to read .as follows: ,Section 13. It shall be the duty of the owner, his agent or manager to keep ' a register of. all persons accommodated in the camp, said register to include the names of all such persons , their home address and the regis- tration number and description of their automobile or other vehicle. It shall also be the duty of the owner, .his agent or manager to .provide for the collection and removal of garbage or other waste materials; . t'o pr6hibit the placing or storage of unsightly material or vehicles within the camp; to provide at least one 2 1/2 gallon soda and acid fire extinguisher, or its equdkalent,' for each 5 units, so located that all unite shall :be with- fn 200 feet of an extinguisher; to report to the Board of Health all cases of communicable disease or suspected ,cases of communicable. disease affect- ing any occupant of the camp; to report immediately to the public, - authority all ' acts of disorderly conduct committed by any person or person within the camp. 14. By renumbering Section 18 to read Section 14. 15. By renumbering Section 19 to read Section 15. 16. By renumbering Section 20 to read Section 16. 17. By renumbering Section 21 to read Section 17. . 18. By renumbering and amending Section 22 to be Section 18, to read as follows Section 18. Any person,- firm or ,corporation who shall violate or fail to comply with any of the provisions of this ordinance, shall be -- guilty of an offense and shall upon conviction be punishable by a fine . . of not to exceed '$100.00 or by imprisonment for a term not to exceed six months or by both such fine and imprisonment. Each day that a violation 'is permitted to exist shall constitute a separate offense. Vote of Town Board" Ayes-Supervisor Klipp• Councilman Demarest; Justidices Tuthili and Clark. The Southold Town Board met at the office of Supervisor Norman E. -Klipp at Greenport, on Wednesday, October 19 1958. The meeting was called to order at 7:00 o'clock P.M. with the following present: Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark; Supt. of Highways Price and Town Clerk Booth. Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED: That the regular monthly audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, October 14, 1958, at 1:30 P.M. Vote of Town .Boprd: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Councilman Albertson; WHEREAS JEAN A. MUNSON has applied to the Town Board for a single automobile trailer permit, NOW THEREFORE, BE IT RESOLVED: That the application of JEAN A. MUNSON to iocste a single automobile trailer. on her property on Westphalia Avenue Mattituck, N.Y. .be and hereby is granted. Vote of Town .Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demrarest; Justices Tuthill and Clark. The Town Clerk presented to the Town Board_ pursuant to Section 111 of the Town Law, detailed estimates of revenue and expenditures from the various Town Officers, departments and distficts for the fiscal .year beginning January 1, 1959. Resolution offered by Justice Clark; seconded by Councilman Albertson. On roll call was unanimously adopted. RESOLUTION OF TOWN BOARD APPROVING PRELIMINARY BUDGET AND CALLING PUBLIC HEARING THEREON RESOLVED: That this Town Board does hereby prepare and approve as the preliminary budget of this Town for the fiscal year beginning on the lst day of' January, 1959, the itemized statement of estimated revenues and expenditures hereto attached and made a part of this resolution, and be it FURTHER RESOLVED: That such preliminary budget shall be filed in the office of the T own Clerk where it shall be available for inspection by any interested person at all reasonable hours, and be it- FURTHER RESOLVED: That this Board shall meet at 2 61clock p.m. on the 6th day of November, 1958, for the purpose of holding a public hearing upon such preliminary budget, and be . it FURTHER RESOLVED: That the Town Clerk give notice of such public hearing in the manner provided in Section 113 of the Town Law, and. that such notice be published in. substantially the -following form:- NOTICE OF HEARING UPON PRELIMINARY BUDGET Notice is 'hereby fivers that the preliminary budget of the Town of Southold for the fiscal year beginning January 1st, 1959, has . been completed and filed in the office of the Town Clerk of Southold, New York, where it is available for inspection by any interested person at all reasonable hours.
