MOSLEY HTTPS:/IDOS.NY.GOV SECRETARY OF STATE ----------------------------------------------------- In the Matter of the Petition of: DECISION Amy Brill and Ivan Guerrero For a Variance to the New York State Uniform Fire Prevention & Building Code PETITION NO. 2025-0795 ------------------------------------------------------- Upon the application of Amy Brill and Ivan Guerrero filed pursuant to 19 NYCRR 1205 on October 27, 2025, and upon all other papers in this matter,the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT This petition pertains to the alteration of space in the basement of a One-story high, detached one-or two-family dwelling of wood frame construction, approximately 4,087 square feet in gross floor area, inclusive of basement space. The dwelling is located at 850 Track Avenue, Town of Southold, County of Suffolk, State of New York. Relief is requested from: 19 NYCRR Part 1220,The 2020 Residential Code of New York State, Section AJ601.3, Compliance, Exception 1, provided as follows: Space created in basements may have a ceiling that projects to within 6 feet, 8 inches of the finished floor; and beams, girders and ducts in such space or other obstructions may project to within 6 feet, 4 inches of the finished floor. [The petitioner requests having a basement with ceiling heights that is less than allowed.] FINDINGS OF FACT 1. Drawings and photographs of the subject dwelling show a finished basement space. 2. The existing basement ceiling height is code compliant. 3. The existing basement girder projection is 6'-2"which is 2 inches less than required. 4. A 6'-2" headroom is more than the average adult male according to anthropometric data in the current Life Safety Code published by NFPA. 5. Marking or painting these overhead projections would make persons aware of the reduced headroom and alert them to avoid contact. E Department STATE 0f State Petition No. 2025-0795 Page 2 6. An existing interior stairway connects the basement to the floor above and is the primary means of egress for the basement. 7. The basement floor plan indicates the provision of a"Bilco Scapewel"egress compliant window. 8. The basement is ancillary to space above and will be utilized by persons familiar with their surroundings who can take necessary precautions in the basement environment. 9. Installing smoke detecting alarm devices within the basement that would provide advance warning of a smoke or fire emergency. 10. The local code official supports the granting of a routine variance by the Department of State in this matter. CONCLUSION OF LAW The proposed variance will not substantially adversely affect the Code's provisions for health, safety, and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building code would entail practical difficulties or unnecessary hardship and would otherwise be unwarranted because such would be unnecessary considering alternatives which, without a loss in the level of safety, achieve the intended purpose of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, The 2020 Residential Code of New York State, Section AJ601.3, Compliance, Exception 1, be and is hereby GRANTED with the following conditions: 1.
