We are unfortunately unable to attend the meeting at the Peconic Community Center (which we understand is on the 15th rather than the 141h) so we are writing this note to share our thoughts ahead of time for your consideration, We respectfully oppose the plan as proposed. Our concerns are primarily related to the proposed location of the pool and related paving and structures.In most if not all of the properties on Shore Lane and Richmond Lane which have a pool,the pool is located behind the house and out of sight to maintain the aesthetics of the area, with the related machinery and equipment nearer to the house to minimise the noise to adjacent properties. The proposed siting of the pool is unusual and is much nearer to our property line than might otherwise have been the case if it were consistent with the other pools in the area. Based on our understanding of the area's elevation and natural slope from our most recent land survey and experience as the original owners of 280 Shore Lane, we have concerns about the significant reduction in the 330 Shore Lane property's capacity to absorb water so close to our property line. The elevation of our property is lower than our neighbor's and so we would like to ensure that any approved plan does not result in an increased level of water drainage onto our ROBERT AND KAREN MONCRIEFF 280 SHORE LANE PECONIC, NEW YORK 11958 TELEPHONE:(917)385-2898 robert.moncrieff@optonline.net property. The heavy rainfalls that have become increasingly common in recent years should be taken into consideration in determining the increased risk of erosion and flooding from stormwater runoff. We understand that the plot map of the property printed on the Notice was prepared while the ground was snow covered which suggests that the natural contours of the properties have not been considered. While it shows red lines past which we assume construction of the pool is not permitted due to wetlands or other non-disturbance area limitations,it does not include any land contours showing the elevation and slope of the property. It is not possible for us to ascertain from the limited information provided whether consideration has been made of the likelihood of and potential damage from increased water run off across our property and the nearby wetlands and protected areas towards Richmond Creek resulting from the location and extent of the proposed new impervious surfaces. Secondly,we are concerned about the noise level resulting from the proposed placement of the pool equipment so close to our property line and impact that may have on our enjoyment of our own property. Further,we wonder what the aesthetic impact might be to the other homeowners on Shore Lane. We do of course welcome our neighbors' efforts to improve and enjoy their property and suggest that they consider an alternate placement of a pool that is consistent with those in the neighborhood to maintain the aesthetics of the area and reduces the risk of damage to our property. We appreciate the Board's consideration of our significant concerns of the potential impact on both our property and the adjacent areas from the placement and extent of the proposed changes as presented in the Notice. The proposed action has been reviewed to Chapter§268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The property in question is the subject of a Trustee Permit NO. 5616 Issued on September 10, 2002 to Schembri Homes, Inc. a previous owner. Before any decision or actions can take place relative to the current proposal (above), the requirements of that 2002 permit must be complied with. Therefore, prior to any consideration of a pool, the split rail fence, as noted in the plans appended to the 2002 permit, will need to be installed. Following this installation and subsequent inspection by the Trustees and/or building department, a new permit, for a pool or otherwise, can be considered. It should also be noted that any permit to install a pool must include some means of defining and creating the non-turf area that extends 25' landward of the fence line as noted on the 2002 permit. This area will likely have to consist of sand, gravel and/or native (no mow) grass such as Switchgrass (Panicum virgatum) or similar to establish an appropriate buffer. In addition to this, the area within the Reserve Area "C" as noted on the plans in the 2002 permit plans and current proposed plans cannot be mowed.
