The Site is bordered to the south by and directly adjacent to a mapped tidal wetland designated as an intertidal marsh. The tidal wetland boundary follows the shoreline along the toe of the bank and extends further landward on the southeast side. The Site has a natural shoreline. 6. On September 27, 2022, while inspecting aerial images to review NYSDEC Permit application #1-4738-04221/00002 (NJ request to build a new single-family dwelling at the Site), Staff _ observed that a large pathway, varying between 5 and 20 feet in width, had been cleared at the Site through the 30' non-disturbance buffer and down to the water. The path appeared to have been filled with a material, possibly gravel,. A prior permit issued for construction of a new dock and float on the Site,NYSDEC Permit#1-4738-04221/00001 (the"Dock Permit"), had shown a 4-foot-wide path through the buffer to access the pier. 7. On November 8, 2022, Staff issued a NOV to Respondent Hobart Road LLC for the violations observed on the Site during the September 27, 2022, aerial inspection. 8. On April 1, 2025, Staff inspected the Site. During the inspection, Staff observed that vegetation had been cleared on the Site within the 30' non-disturbance buffer. Staff also observed that approximately 20' of stone armor had been placed at the Site without a NYSDEC permit. 9. On April 14, 2025, Staff issued an updated NOV to Respondent Hobart Road LLC for the violations observed at the Site during the April 1, 2025, inspection. 10. This Order shall not be construed as being in settlement of events regarding1whiel_;the x' : Department lacks knowledge, or which occur after the effective date of this;Order. "._ L I ! FEB 1 1 2026 ENFORCEABLE PROVISIONS OF LAW 11. Pursuant to ECL § 25-0202(1), no person shall alter the state of any tidal wetland-or&2ariy aiea immediately adjacent to such wetland without a permit. 12. 6 NYCRR § 661.4(hh) defines"tidal wetlands" or"wetland" as "any lands delineated as tidal wetlands on an inventory map[.]" 13. 6 NYCRR § 661.4(hh)(2) defines "intertidal marsh" as "[tjhe vegetated tidal wetland zone, designated 11V1 on an inventory map, lying generally between average high and low tidal elevation. The predominant vegetation in this zone is low marsh cordgrass, Spartina alterniflora." 14. Pursuant to 6 NYCRR § 661.4(b)(1)(i)-(iii), "adjacent area" is defined as land immediately adjacent to a tidal wetland. The boundary of the adjacent area extends 300 feet landward of the most landward boundary of a tidal wetland, to the seaward edge of the closest lawfully and presently existing(i.e. as of August 20, 1977)functional and substantial fabricated structure, or to the elevation contour of 10 feet above sea level. 15. 6 NYCRR § 661.4(ee)(1)(ii) classifies any form of dumping, filling or depositing, either directly or indirectly, of any soil, stones, sand, gravel, mud, rubbish, or fill of any kind, as a regulated activity. 16. 6 NYCRR § 661.4(ee)(1)(iii) classifies the erection of any structures or construction of any facilities or roads, the driving of any pilings or placing of any other obstructions, whether or not changing the ebb and flow of the tide, as a regulated.activity. 17. 6 NYCRR § 661.4(ee)(1)(vi) classifies any other new activity within a tidal wetland or on an adjacent area which directly or indirectly may substantially alter or impair the natural condition or function of any tidal wetland, as a regulated activity. 2 t 18. 6 NYCRR § 661.5(b) specifically enumerates regulated activities which are prohibited within a tidal wetland or tidal wetland adjacent area without Department authorization. 19. 6 NYCRR § 661.5(b)(25)prohibits the expansion or substantial modification of existing functional facilities and structures within a tidal wetland adjacent area without Department authorization, except for those actions covered by items 26, 33, 34 or 38 of§ 661.5(b). The expansion or substantial modification of existing functional facilities and structures within an adjacent area is classified as a generally compatible use of the area. 20. 6 NYCRR § 661.5(b)(30)prohibits the placement of fill in an intertidal marsh or adjacent area without Department authorization. The placement of fill in an intertidal marsh is classified as a presumptively incompatible use of the area. The placement of fill in an adjacent area is classified as a generally compatible use of the area. 21. 6 NYCRR § 661.5(b)(57) prohibits any type of regulated activity not specifically listed in § 661.5(b) in an intertidal marsh or adjacent area without Department authorization. 22. ECL § 71-2503.1(a) provides that"[a]ny person who violates, disobeys or disregards any provision of article twenty-five shall be liable to the people of the state for a civil penalty of not to exceed ten thousand dollars for every such violation, to be assessed, after a hearing or opportunity to be heard, by the commissioner. Each violation shall be a separate and distinct violation and, in the case of a continuing violation, each day's continuance thereof shall be deemed a separate and distinct violation." VIOLATIONS 23. The Department has documented that on or before September 27, 2022, Respondents cleared vegetation to create a large pathway filled with gravel on the Site,varying between 5 and 20 feet in width, through the 30' non-disturbance buffer and TWAA and down to the water. Under the Permit, Respondents were only permitted to create a path no greater than 4 feet in width through the buffer to access the pier. Pursuant to 6 NYCRR § 661.5(b)(30), the placement of fill in an intertidal marsh or adjacent area without Department authorization is prohibited. Pursuant to 6 NYCRR § 661.4(ee)(1)(vi), any other new activity within a tidal wetland or on an adjacent area which directly or indirectly may substantially alter or impair the natural condition or function of any tidal wetland is a regulated activity. Pursuant to 6 NYCRR § 661.5(b)(57), regulated activities not specifically listed in § 661.5(b)in an intertidal marsh or adjacent area without Department authorization are prohibited. Therefore, by causing or allowing vegetation to be cleared and fill to be placed within the TWAA and non-disturbance buffer, Respondents violated 6 NYCRR § 661.5(b)(30), 6 NYCRR § 661.5(b)(57), and Permit Special Condition#3. 24. The Department has documented that on or before April 1, 2025, Respondents cleared vegetation on the Site within the TWAA and 30' non-disturbance buffer, as well as within 75' of the tidal wetland boundary. Respondents shall cease and desist from further violations of any provision of the ECL and implementing regulations, more particularly ECL Article 25 and Part 661 of 6 NYCRR. II. Compliance. XH. Future Compliance. Respondents shall conduct all tidal wetland-related activities in strict conformance with Federal and New York State laws and regulations. To ensure compliance with this Order, duly authorized representatives of this Department shall be permitted access to Respondents' place(s) of business during reasonable hours, in order to inspect and/or require such tests as may be deemed necessary to determine the status of Respondents' compliance herewith. XIII. Binding Effect. The provisions,terms, and conditions of this Order, including Appendix A, shall be deemed to bind Respondents and Respondents' officers, directors, agents, employees, successors and assigns and all persons, firms and corporations acting under or for them, including, but not limited to those who may carry on any or all of the operations now being conducted by Respondents, whether at the present location or at any other in this State. XIV. Collection Costs/Fees. Respondents' failure to pay any penalty amounts due under the terms of this Order may result in a 22% surcharge in recovery costs and a potential tax refund offset by the Department of Taxation and Finance.
