(°ic� s,he sure to research before completing this question or call our office for assistance) Page 2, Area Variance Application Revised 6/2023 A P R Q 12026 REASONS FOR APPEAL Zoning Board of Appeals (Please be specific,additional sheets may be used with preparer's signature notarized): 1.An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted,because: Granting the requested variance will not produce an undesirable change in the character of the neighborhood nor create a detriment to nearby properties.The proposed in-ground swimming pool,hot tub and generator will be located in the side yard of the residential parcel and will remain well within the interior of the property,set back a substantial distance from adjoining property lines and neighboring residences.The improvement is consistent with typical residential development found on similar properties in the surrounding neighborhood and will not alter the residential character of the area or adversely affect neighboring properties. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The benefit sought cannot be achieved by another feasible method because the configuration of the waterfront parcel and the location of the existing residence limit the areas where the proposed pool,hot tub and generator can reasonably be placed.The rear yard is constrained by the shoreline,while other locations would require substantial reconfiguration of existing development.The proposed location adjacent to the residence is the most practical placement and requires the requested side yard variance. Additionally,the Board of Trustees require pools to be setback a minimum of 60'from the wetlands,which limits where the pool can be situated. 3.The amount of relief requested is not substantial because: The amount of relief requested is not substantial because the proposed pool,hot tub and generator will remain well within the interior of the parcel and will be located near the existing residence.The variance relates only to the placement of the pool,hot tub and generator within the side yard and does not involve an increase in the scale or intensity of the residential use of the property. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The requested variance will not have an adverse effect on the physical or environmental conditions in the neighborhood. The proposed pool, hot tub and generator will be located near the existing residence,within an already developed portion of the property.The project will remain consistent with the surrounding residential use of the area.To mitigate the proposed development,a 10'x100'non-turf buffer is to be planted with native salt-tolerant non-fertilizer dependent vegetation and a 10'non-turf buffer are proposed on the eastern side of the property along the existing concrete wall. The Board of Trustees have approved the proposed pool,hot tub and generator location. 5.
