Klipp at Greenport , on Mondyy, July 28, 19589 with the following present: Supervisor Klipp; Councilmen Albertson and Demar. est ; Ju-tice Clark; Town Attorney Tqsker and Town Clerk Booth. This hearing .was in the matter of the adoption of a bingo ordinance for the Town of Southold. The Supervisor opened the hearing at 7:30 P.M. and read the call of the meeting. He then called upon any person present who wished to speak either in favor or in opposition to the matter of the adoption of a bingo ordinance , There was no response in the negative , The following were in favor of the adoption of a bingo ordinance : Joseph J. Ficurilli , Chief of the Greenport Fire Department , Walter Kaelin, member of the Cutchogue Fire Department John Haas , representing the JvIattituck Fire Department Edward Grathwohl , Southold Town Fire Chief Council John Tillinghast , Tax payer The following co;imunications were received in favor of the adoption of the Bingo Ordinance: Raymond Cleaves Post No, 861 Cutchogue Fire Department Greenport Fire Department The hearing was closed at 7:40 P.M. for further deliberation of the BoTrd pending a resolution vote. Moved by Justice Clark; seconded by Councilman Albertson: s^1�irREAS , the Town Board of the Town of Southold has been requested by several organizations within the Town to legalize bingo in the Township, and WHEREAS, a public hearing was duly held by said Town Board on the 28th day of July, �958, on the matter of the adoption of a bingo ordinance NOW, THEREFORE, BE IT RESOLVED AND ORDAINED that it shall be lawful for anv authorized organization, as defined in Section 476 of Article 14--G of the General Municipal Law, upon obtaining the required license , to conduct the game of bingo within the territorial limits of the Town of ,Southold, subject to the provisions of this ordinance , Article 14-G of the General Municipal Law and Article 19-B of the Executive Law, and the following restrictions: - 1. No person, .firm , association, corporation or organization, other than an authorized organization licensed under the provisions of Article l4-G of the General A�Iunicipa.l Lahr shall_ be permitted to conduct such games . 2, No bingo game shall be held , operated or condiau ted on or within any leased premises if rental under such lease is to be paid, wholly or partly, on the basis of a percentage of the receipts or net profits derived from the operation of such game. 3 . The entire proceeds of any game shall be exclusively devoted to the lawful purpose of the organization permitted to conduct the same.,, 4. No single prize shall exceed the sum or value of two hundred fifty dollars . 5. No series of prizes on any one occasion shall aggregate more than one thousand dollars . 6. No person except a bona fide member of any such organization shall participate in the management or operation of such game . 7. The unauthorized conduct of a bingo game and any willful violation of any provision of this ordinance shall_ constitute and be punishable as a misdemeanor. The question of -the adoption of the foregoing resolution was duly put to a vote on roll call , which resulted as follows : Ayes-Supervisor Klipp; Councilmen .Albertson and Demarest; JusticE: = Clark, The resolution was thereupon declared duly adopted® Mrs . Florence Ziegler appeared before the Board requesting a change of zone from "A" Residential and. Agricultural District to "M" Multiple Resident District. She stated they would like to locate 3 d.uplex units in addition to the three trailers now located on their trailer camp property in East Marion, She gave the Board the dimensions of the plot, The Board informed her that the plot was too small_ to locate the three duplex., units in addition to the three trailers , and it had to be either the three trailers or the three duplex units . Mrs . Ziegler said -that she would take the matter up with her husband and report back to the Supervisor, . Moved by Councilman Albertson; seconded by Councilman Demarest: RESOLVED: That the regular monthly audit meeting of this Board will be held at the office of Supervisor Norman E. Klipp at Greenport ' on Tuesday, August 12, 1958, at 1:30 P.M. Tote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justice Clark. Moved. by Councilman Demarest; seconded by Justice Clark: WHEREAS , the Board of Trustees of the Town of Southold has received numerous complaints concerning the mooring of boats in town waters , and 1,UiEREAS , 'the Board of Trustees has requested that the Town Board enact an ordinance regulating the mooring of boats in town waters , NOW, THEREFORE, BE IT RESOLVED: that a public hearing be held by the Town 'Board of the Town of Southold at the Supervisors Office , 16 South Street , Greenport , N.Y. on the 12th day of August , 1958, at 2:00 o °clock P. T. of that day upon the question of the enactment of the follow- ing Ordinance , to wit:- SOUTHOLD TOWN ORDINANCE REGULATING THE MOORING OF BOATS AND THE PLACING OF OBSTRUCTIONS IN AND ON TOWN WATERS AND PUBLIC LANDS . Section 1 . No person shall place any piles , stakes , buoys., piers , docks or other objects inoor on any town waters or public lands under or adjacent to town waters in the Town of Southold without first obtaining a permit therefor from the Board of Trustees of the Town of Southold. Section 2. No person shall moor, anchor or place any boat on any public lands at the end of any town highway in the Town of Southold for a longer period than 24 hours . Section 3 . The Board. of Trustees of the Town of Southold is hereby authorized and empowered to issue revocable permits for the placing of Piles , stakes , buoys piers , docks or other objects in or on any town waters or public lands under or adjacent to town waters , provided that the same do not obstruct or interfere with navigation or the public use of said waters or lands . Section 4. Any violation of the provisions of this Ordinance shall constitute an off6nee and shall be punishable by a fine of not more than '0.00. Section 5. This Ordinance shall take effect immediately. BE IT FURTHER RESOLVED: That the Town Clerk cause a noti_�e of said hear- ing containing a copy of. the proposed Ordinance , to be published in. the Long Island. Traveler-Mattituck Watchman_, the official newspaper of said Town in the issue thereof to be published on or about the 31st day of July, 1_958. (The above proposed Ordinance was unanimously adopted at the regular meeting of the Southold Town Trustees held at the Southold Town Clerk' s Office on July 281 1958. Alvah B. Goldsmith, Clerk) Moved by Justice Clark; seconded by Councilman Albertson: WHEREAS , the members of the Southold Planning Board decided on a change of Section 1012 of the Building Zone Ordinance regarding penalties and voted a change from a misdemeanor to an offense , and it was the determination of the Planning Board to recommend the above change to the Town Board for approval , NOW, THR,REFORE , BE IT RESOLVED: That a public hearing will be held by cj the Southold Town Board at the Supervisor 's Office in Greenport, on Tuesday, August 12, 1958 , at 2:00 P.M. on the aforesaid matter. WHEREAS , the Southold Town Planning Board has prepared an official report and recommendation upon the petition of Frank B. Rogers , Jr, and Midgley and Horton, for a change of zone from. "A" Residential and Agric- ultural District to "B" Business District on certain real property situate at Peconic, Town of Southold, N.Y. NOW1 THE EFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor 's Office in Greenport, on Tuesday, August 12, 195$, at 2 o 'clock P.M. on the above mentioned petition. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justice Clark. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS , the Southold Town Planning Board has prepared an official report and recommendation upon the petition of Athanasios Spinthourakas and Helen Spinthourakas for a change of-zone from "A" Residential and A,ricultural District to "M" Multiple R sident District on certain real property situate at East Marion, Town of Southold, N.Y. NOW, THE EFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the American Legion Hall in Sout-_old, on Tuesday, August 12, 19589 at 7:30 P.M. on the aforesaid petition. NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the American Legion Hall in Southold, on Tuesday, August 12, 19585 at 7:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest and Justice Clark. Moved by Justice Clark; seconded by Councilman .Albertson: WHEREAS , the Southold Town Planning Board has prepared an official report and recommendation upon the petition of .Angelo G. Petrucci and 'Georgette Petrucci for a change of zone from ".A" Residential and Agric® District. to "M" Multiple Resident District on certain real property situate at Nassau Farms , Peconic, Town of Southold , N.Y. NONTI THEREFORE, BE IT R.FSOLV^D: That a public hearing will be held by the Southold Town Board at the American Legion Hall in Southold, on ,Tuesday, August 12, 1958, at 7:30 P.M.
