Dear Ms. Lanza:
I'm writing to respectfully request that you or the Planning Board either grant whatever approval the Building
Department suggests may be required for renovations and additions to the Graf family's home at 4855 Stillwater
Ave, Cutchogue,which was damaged by fire in November 2024, or confirm that no such approval is required.
Specifically, in response to an application filed by Caroline Statile,daughter of William and Susan Graf,the
Building Department has indicated that some form of approval or relief is needed from the Planning Department
due to the language of Covenants and Restrictions filed in October 1982, and amended in October 1983, which
required that"no residential structure shall be constructed"on then vacant land within 75 feet of the"upland
edge of the tidal wetlands and the shoreline of Eugene's Creek." As I explained to the Building Department, I
am confused by their guidance because when it was constructed,the existing dwelling was in fact located 75
feet from the line of mean high water associated with Eugene's Creek,which absent any other wetlands edge
established at the time was determined by the Town to satisfy the Covenants and Restrictions,and the house has
not moved in the past 40 years,nor would it move currently. Evidence of the dwelling's compliant setback is
documented by the enclosed Building Department records,including the pre-construction survey by Roderick
Van Tuyl, dated September 20, 1983; Building Permit dated March 1, 1984; as-built survey by Roderick Van
Tuyl, dated January 21, 1985; and Certificate of Occupancy issued on September 26, 1985.
And as the Planning Board was presumably aware in 1982, unlike lot lines, mean high water lines and
associated tidal wetland boundaries are dynamic features that typically migrate landward during a geologic
epoch of sea level rise. So although a wetland setback was required for the residential structure that"shall be"
constructed on then vacant land,without specific language to the contrary it does not stand to reason that the
