Since the DEC has documented the summer occurrence of the Northern Long Eared Bat (NLEB) (Myods septentrionaft),a species listed as "endangered" by both New York State and the US Fish &Wildlife Service, within 3 miles of the project location. We have determined that tree cutting at this location between March 1 and November 30 of any calendar year may result in the"take"of these endangeredithreatened species ortheir habitat within the meaning of Environmental Conservation Law(ECL) §11-535.The term "take" is defined in part as the direct killing or injury of individual members of a protected species, interference with critical breeding, foraging, migratory or other essential behaviors, or the adverse modification of the species' habitat The"take"of a species listed as endangered or threatened is prohibited in the absence of a permit from this Department issued pursuant to ECL§11-535. In order to avoid an Endangered Species "take," no tree cutting activities must be conducted at the project site between the dates of March 1 and November 30 of any calendar year. NOW,THEREFORE,THIS DECLARATION WITNESSETH: That the DECLARANT for the purpose of carrying out the intentions above expressed, does hereby make known,admit,publish,covenant and agree that the Property herein described shall hereafter be subject to the covenants and restrictions as herein cited,to wit: 1. There shall be no further subdivision of any of the lots shown on the aforesaid Subdivision Map resulting in additional building lots.In addition,no lot lines shall be modified unless authorized by resolution of the Southold Town Planning Board. 2. Clearing Restrictions a. The timing and methodology for clearing must follow the Southold Town Planning Board's"Protocol for Eastern/Woodland Box Turtle Conservation During Construction",on file with the Southold Town Planning Department.At the time of the creation of these covenants,the Woodland Box Turtle,aka the Eastern Box Turtle,was listed by New York State DEC as a species of special concern. This protocol limits the time of year clearing is allowed based on the biology of the protected species.It also provides certain procedures that must be followed prior to clearing. b. Prior to any clearing or grading, the applicant must provide correspondence from the New York State Department of Environmental Conservation(NYSDEC) Regional Office with a determination about whether a clearing timeframe must be applied for the protection of the Northern Long-Eared Bats that may be present in this area.At the time this subdivision was approved,the Northern Long-Eared Bat and its habitat were federally listed and protected by the U.S.Endangered Species Act.The time of year when clearing is permitted may be limited by the NYS DEC. c. Lots 1 through 8 are subject to a maximum limit of clearing for each lot pursuant to Southold Town Code,which equals 50%of the buildable lot area as follows(in square feet): Lot 1: 17,707 Lot 2: 18,088 Lot 3: 18,297 Lot 4: 17,527 Lots 5 through 8: 17,500 2 d. No clearing or grading is permitted outside the limits of clearing stated above in item c. e. Existing native vegetation including groundcover, shrubs and trees,shall be preserved in all areas outside the limits of permissible clearing,with the exception of deadfall and invasive plants. The deadfall and invasive plants proposed to be removed must be identified in the field for inspection by Planning Department staff prior to removal. Removal must be done selectively,preserving native plants to the extent practicable. f. Prior to building permits being issued,the clearing limits,and amount of land to be cleared shall be shown on the survey submitted in the building permit application. g. Prior to any clearing or grading, the clearing limits and buffers shall be clearly staked on site and inspected by Planning Department staff for compliance with these covenants and the Subdivision Map. h. After clearing and prior to beginning construction,the cleared area must be inspected by a Town official(either Building,Planning or Engineering Department)to confirm the cleared area conforms to the approved clearing restrictions. i. At any time,in perpetuity,in the event that a lot is cleared beyond the aforementioned permissible limit,the areas must re-vegetated by the lot owner according to a revegetation plan reviewed and approved in writing by the Planning Board.Any work being conducted on the site at the time the over- clearing is discovered,including interior construction,will be stopped until the site is revegetated according the revegetation plan. If the season does not permit replanting immediately,work may continue after a performance guarantee is provided in the amount it would cost to fully implement the approved revegetation plan. 3. Boundary Fence Prior to building permits being issued,a split-rail or similar fence to mark the edge of the Town's open space parcel is required to be installed as shown on the Subdivision Map.After installation,the fence will be maintained by Southold Town. 4. Each lot owner is responsible for maintaining these trees in good condition, protecting them from deer browse and antler-rub until they are mature enough to resist damage from deer,and replacing them in the event that they die,are destroyed by stones,and/or are removed for any reason. No street trees may be removed,except in the case of trees that are dead or diseased and are a safety hazard, and only after submitting an arborist's report to the Planning Board and the Planning Board issuing their approval in writing to remove the tree. Replacement of street trees must be done within six months with a species acceptable to the Planning Board at the expense of the Lot owner. 9. Irrigation,landscaping and fertilizer restrictions: a. Use smart irrigation control systems to prevent over-watering; b. The use of synthetic fertilizers,herbicides or pesticides is prohibited; c. The use of native,drought-tolerant plants are required in landscaping. d. The use of fertilizer products containing nitrogen,phosphorus or potassium is prohibited between November 1 and April 1. e. Only organic fertilizers where the water-soluble nitrogen is no more than 20%of the total nitrogen in the mixture may be utilized on the lots. f. A maximum of 1 pound of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 pounds per 1,000 square feet per year is permitted. g. The use of lawn fertilizer containing phosphorous is prohibited unless establishing a new lawn or a soil test shows that the lawn does not have enough phosphorus. h. Any fertilizer that is spilled on impervious surfaces shall be immediately picked UP. 10.Underground storage tanks are prohibited,except those with spill,overfill and corrosion protection requirements in place.
