AYES: Councilman Mealy, Justice Stevens, Councilwoman Doherty, Councilwoman Smith, Councilwoman Suess, Supervisor Krupski, Jr. NAYES: None Page 95 of 106 TOWN BOARD COASTAL EROSION HAZARD BOARD OF REVIEW TOWN OF SOUTHOLD FINDINGS AND --------------------------------------------- DETERMINATION In the matter of the Application of 8 JAN COURT,LLC 58525 County Road 48 Greenport,NY SCTM# 1000-44-2-17 --------------------------------------------- FINDINGS AND DETERMINATION Based upon the application, the documents in the Board's file, the determinations of the Zoning Board of Appeals and the Board of Trustees, the recommendation of the LWRP Coordinator, and the testimony received at the public hearing held on May 20, 2026, the Town Board finds and determines as follows: ISSUE 8 Jan Court,LLC("Appellant"),by application dated March 30,2026,appeals to the Town Board, sitting as the Coastal Erosion Hazard Board of Review (the "Board"), from the determination of the Board of Trustees, as Administrator of the Coastal Erosion Hazard Area Law, dated March 4,2026,which denied the Appellant a Coastal Erosion Hazard Area("CEHA")permit under Chapter 111 of the Town Code for proposed alterations to an existing single-family dwelling and seasonal cottage at 58525 County Road 48, Greenport, New York (SCTM# 1000-44-2-17). The Appellant seeks reversal of that denial or, in the alternative, a variance under § 111-20. FACTUAL BACKGROUND AND PROCEDURAL HISTORY A. The property and proposed action: The subject parcel is a 12,449.43 square foot (0.29 acre) non-conforming lot in the RR Zoning District,fronting Long Island Sound on the seaward side of County Road 48. It is improved with an existing 1,321 square foot dwelling and 406 square foot seasonal cottage and lies entirely seaward of the Coastal Erosion Hazard Line; the entire parcel is therefore within the CEHA. The dwelling holds Certificates of Occupancy issued in 1977, 1980, and 1987, and the Appellant replaced the bulkhead in 2023 (Trustees Permit Nos. 10439 & 10439C), raising it eighteen inches and covenanting to maintain a non-turf buffer over the entire parcel. The proposed work consists of largely cosmetic alterations: raising and reconstructing the dwelling's roof to 19.8 feet at peak; replacing seaward decks with stairs to grade; relocating the cottage door and replacing windows; adding a small deck over existing basement stairs; raising the cottage walls and reroofing; and abandoning the septic system in favor of an UA OWTS with a new stormwater drainage system. Except for roughly 200 square feet of decking, all work is within the existing footprints, with no footprint increase and a net reduction in total decking. B. Prior approvals: On March 20, 2025, the Zoning Board of Appeals (Determination #7988) granted the required area variances, finding the relief "the minimum action necessary and adequate" and, subject to conditions, consistent with the Local Waterfront Revitalization Program ("LWRP"). Following a duly noticed public hearing on February 11, 2026, the Board of Trustees granted a Wetland Permit (No. 10914) for the identical scope of work and deemed the action LWRP- consistent based on the imposed Best Management Practices. C. The Trustees' CEHA denial: By the same February 11, 2026 action, memorialized by letter dated March 4, 2026, the Trustees denied the CEHA portion of the application, finding that the proposal did not satisfy § 111-20(A) (no reasonable, prudent, alternative site) or § 111-20(C) (reasonably safe from flood and erosion damage). The record reflects that the determinative consideration was the parcel's location within the CEHA. D. The Town Board proceeding: The Appellant timely appealed on March 30, 2026. The Board held a duly noticed public hearing on May 20, 2026, at which testimony was taken from the Appellant's attorney and no member of the public appeared in opposition. The action has been reviewed under Chapter 268, Waterfront Consistency Review, and classified as a Type II Action not subject to further SEQRA review. The record closed on May 20, 2026. APPEAL OF THE TRUSTEES' DETERMINATION Under § I I1-24(B), the Board hears appeals alleging error in any determination of the Administrator, and under § 111-25 it may reverse, affirm, or modify that determination. Section 111-20 permits the standards of Chapter 111 to be varied where strict application causes practical difficulty or unnecessary hardship, provided the applicant shows: (A) no reasonable, prudent, alternative site is available; (B) all responsible mitigation measures have been incorporated at the owner's expense; (C) the development will be reasonably safe from flood and erosion damage; (D) the variance is the minimum necessary; and (E) where public funds are used, the benefits clearly outweigh the long-term adverse effects. The practical difficulty is established. The Coastal Erosion Hazard Line runs through County Road 48, placing the entire parcel— like every lot on the seaward side of this section of the road—within the CEHA. The structures predate both the zoning code and the CEHA Law. The difficulty arises from the location of the regulatory line, not from the proposed work, and is the same difficulty for which the ZBA granted relief. The Board finds each applicable criterion satisfied: A. No reasonable, prudent, alternative site is available. The work is cosmetic and confined to the existing footprints; it sites no new principal structure.Because the entire parcel lies within the CEHA, no portion of this constrained lot exists outside the hazard area to which the work could be relocated. Satisfied. B. Mitigation incorporated at the owner's expense. At its own expense the Appellant installed a new bulkhead, covenanted to maintain a non-turf buffer over the entire parcel, will upgrade to an I/A OWTS system, and will comply with Chapter 236 stormwater requirements. Both the Trustees and the ZBA acknowledged these measures mitigate potential impacts, and the Trustees deemed the identical work LWRP-consistent on that basis. Satisfied. C. Reasonably safe from flood and erosion damage. The new bulkhead provides reasonable protection; the minimal work occurs within existing footprints, adds no footprint, intensifies no use, and triggers no further FEMA compliance. Neither the determination nor the record identifies any feature of the work increasing flood or erosion risk —the only basis cited was the parcel's location within the CEHA, a condition of the lot rather than a consequence of the work. Satisfied. D. Minimum necessary. The proposal increases no footprint and reduces total decking. The ZBA reached the same conclusion as to the identical work, finding the relief the minimum action necessary to enable the alterations while protecting neighborhood character and public welfare. Satisfied. E. Public funds.None are involved; the criterion is inapplicable. Because all work except roughly 200 square feet of decking is within the existing footprints,the proposal is a non-major addition under Chapter 111,and the same scope has already been authorized by the Trustees under Wetland Permit No. 10914. CONCLUSION For the reasons set forth herein, the Board finds the Appellant has satisfied the criteria of § 111-20, reverses the determination of the Board of Trustees, and grants the application of 8 Jan Court,LLC for a Coastal Erosion Hazard Area permit pursuant to § 111-20 of the Coastal Erosion Hazard Area Law, subject to the conditions previously imposed by the Trustees and the ZBA, including the perpetual non-turf buffer, the I/A OWTS installation, and Chapter 236 compliance. This Determination shall not affect or deprive any other agency of its properly asserted jurisdiction, separate and apart from the proceedings under the Coastal Erosion Hazard Area Law considered herein. FACTUAL AND PROCEDURAL BACKGROUND The Appellant, 8 Jan Court, LLC ("Appellant") is appealing the determination of the Southold Town Board of Trustees ("Trustees") as the Administrator of the Town of Southold Coastal Erosion Hazard Area Law, dated March 5, 2026, which denied the issuance of a Coastal Erosion Hazard Area ("CEHA") permit to construct additions and alterations to an existing single- family dwelling and seasonal cottage on a .286 acre parcel located in the RR zoning District on Long Island Sound. The entire parcel and all improvements lie seaward of the Coastal Erosion Hazard Line. The proposed construction to the main house consists of the removal of the flat roof on the northeast side of the house and replacement with a pitched roof as well as the replacement of certain doors and windows. The alteration to the seasonal cottage consists of the relocation of the existing south facing front door to the east side and replacement of windows within the pre-existing non-conforming cottage. The construction of the existing house and cottage pre-dated our zoning code but the house does benefit form Certificates of Occupancy issued in 1977, 1980 and 1987. The Appellant recently replaced the bulkhead on the property pursuant to Trustees' permits 10439 and 10439C dated August 16, 2023. Due to the pre-existing nonconforming front yard setback and the location of the existing house and cottage entirely within the CEHA, the Appellant was required to obtain setback and lot coverage variances from the Zoning Board of Appeals ("ZBA") which variances were granted by way of ZBA Determination #7988 of 2025. In granting relief, the ZBA made the following findings: "Most of the dwellings fronting Long Island Sound along this section of County Road 48, like the subject dwelling and cottage, generally pre-date zoning and the implementation of the LWRP and Coastal Erosion Hazard codes, and were built very close to Long Island Sound. The subject residential structures are quite dilapidated and in need of repair. In their current condition, they are an eyesore.... The applicant is planning cosmetic fixes to both dwellings to improve the aesthetic look of the buildings, including improving the roofline and replacing old windows with new functional windows in the primary dwelling, and relocating the entry door of the cottage to a safer and more functional location on the east side of the building.... The property owner recently installed a new bulkhead and plans to construct a new deck over the existing steep and dangerous concrete steps that separate the cottage and the dwelling. This new deck will serve as the platform for the new cottage entry. No increase in the footprint of either building is proposed. These renovations will be in line with other approved renovations of homes along Long Island Sound in this area." On February 18, 2026, the Trustees granted a Wetlands Permit # 10914 for the proposed alterations to the existing house and cottage and the installation of small deck over the concrete stairs as well as the installation of an I/A OWTS sanitary system. The previously issued bulkhead permit was conditioned upon the establishment and perpetual maintenance of a non-turf buffer on the entire parcel. Based on the mitigating conditions imposed and Best Management Practices required by the Trustees and ZBA, both Boards determined that the action was consistent with the LWRP. It is noteworthy that the proposed construction would be deemed a non- major addition to the existing structures under the CEHL since all the work except for 200 SF of decking, will be within the footprints of the existing structures. The proposed work consists of a pitched roof and cosmetic upgrades that are intended to improve the aesthetics of these dilapidated structures. A review of the Trustees/Administrator's Determination and the minutes of the February 11, 2026 public hearing confirm that the only basis for denial of the CEHA permit was the location of the property within the Coastal Erosion Hazard Area. A copy of the entire Trustees' File (TR-10914) is attached hereto as Exhibit "A", including the Wetlands Permit, approved Site Plan and ZBA Determination. A copy of the minutes of the Trustees' February 11, 2026 public hearing are attached hereto as Exhibit "B". For the following reasons, the Appellant submits that variance relief pursuant to Section 111-20 of the Town Code is warranted. POINT I THE APPELLANT HAS SATISFIED THE CRITERIA FOR THE GRANTING OF A VARIANCE UNDER SECTION 111-20 OF THE TOWN CODE Section 111-20 of the Southold Town Coastal Erosion Hazard Area Law provides that: Strict application of the standards and restrictions of this chapter may cause practical difficulty or unnecessary hardship. When this can be shown, such standards and restrictions may be varied or modified, provided that the following criteria are met: A. No reasonable, prudent, alternative site is available. B. All responsible means and measures to mitigate adverse impacts on natural systems and their functions and values have been incorporated into the activity's design at the property owner's expense. C. The development will be reasonably safe from flood and erosion damage. D. The variance requested is the minimum necessary to overcome the practical difficulty or hardship which was the basis for the requested variance. E. Where public funds are utilized, the public benefits must clearly outweigh the long-term adverse effects. It is respectfully submitted that under the facts and circumstances presented here, the Appellant can clearly meet the standards set forth in Town Law §111-20 and as a result, the relief requested herein should be granted. A. No reasonable, prudent, alternative site is available. As stated previously, the proposed construction consists of largely cosmetic upgrades to the existing dilapidated house and cottage with the only structural change being the pitching of the roof. All the work will be done within the existing footprints of the house and cottage. As such, there is no reasonable or prudent alternative site on this heavily constrained parcel to complete the construction. B. All responsible means and measures to mitigate adverse impacts on natural systems and their functions and values have been incorporated into the activity's design at the property owner's expense. The Appellant has already gone to great expense to install a new bulkhead on the property which will protect the property from erosion. In addition, the Appellant has covenanted to maintain a vegetated non-turf buffer on the entire parcel. The Appellant will also be abandoning the existing sanitary system and upgrading to an I/A OWTS sanitary system. The Appellant will also comply with Chapter 236 of the Town Code relating to Stormwater Management. Both the Trustees and the Zoning Board of Appeals have acknowledged that these actions will mitigate any potential impacts to the physical or environmental condition in the neighborhood and deem the project consistent with the LWRP. C. The development will be reasonably safe from flood and erosion damage. As mentioned above, the Appellants have recently installed a new bulkhead that will provide reasonable protection form erosion and flooding. The minimal amount of construction proposed does not trigger further compliance with FEMA regulations. D. The variance requested is the minimum necessary to overcome the practical difficulty or hardship which was the basis for the requested variance. The practical difficulty or hardship here stems from the fact that the Coastal Erosion Hazard Line lies in the middle of County Road 48 and as such the entire property lies in the CEHA. That appears to be the only reason why the Trustees denied the permit after granting a Wetlands Permit for the very same work. In granting the area variance relief required for the construction, the ZBA found that: "The granting of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations to a seasonal cottage and single family dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community". It is respectfully submitted that the same finding applies to the instant appeal. E. Where public funds are utilized, the public benefits must clearly outweigh the long-term adverse effects. There will be no public funds utilized for this project and as such this criteria is inapplicable. CONCLUSION For the reasons set forth herein, it is respectfully submitted that the Appellant has met the criteria for the issuance of a variance under Section 111- 20 of the Town Code and therefore requests that relief be granted to permit the construction to proceed. It should also be noted that it is my understanding that an IA system has now been added to the application. The LWRP coordinator found this to be inconsistent. The inconsistencies lie with not meeting the minimum setback to wetland jurisdiction. None of the proposed work meets any setback requirements as permitted. The entire backyard should be designated a permanent non-disturbance buffer, covered in gravel or vegetated with American beach grass . Is there anyone here that wishes to speak regarding this application? MR. BERGEN: Dave Bergen, on behalf of 8 Jan Court LLC. This is a project that had been initially to the Building Department and referred to ZBA for various variances due to the setback issues . The ZBA granted the variances. The next step was coming here to the Trustees. It' s a very constrained piece of property, as you folks have seen, and we were able to propose an IA system that will hopefully fit on the property. And with that -- oh, and in regards to the LWRP, with a previous permit that was given by this Board for the bulkhead, it was agreed that the entire property would be a non-turf buffer. So I heard now that there is a suggestion of non-disturbance, and I know, I think I heard it was either mentioned either front yard, backyard. If we are going to do something that is non-disturbance, because, I want to clarify, landward of the house or seaward of the house. Because we, because of the minimum distance between the house and the North Road, we want to have the opportunity to put shrubs in to act a little bit as a sound buffer there. So I hate to see a non-disturbance buffer and impact that ability to put in shrubs between the house and the road. It's a very, very small area. So with that, I 'm here to answer any questions you might have. TRUSTEE KRUPSKI: Thank you, for that description. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The proposed as-built residence does not meet the setback requirements from a wetland as defined in Chapter§275-2 Definition; word usage and §275-3 Findings; purpose;jurisdiction; setbacks. D. Setbacks. (1) The following minimum setbacks apply to any and all operations proposed on residential property within the jurisdiction of the Board of Trustees: (a) Wetland boundary or bank. [1]Residence— 100 feet. None of the proposed work meets any setback requirements.
