My review included discussions with the Project Manager (Alex Perros). The purpose of this effort was to determine if the proposed construction complies with the 2020 NYS Building Code (Energy Conservation), in particular the 2018 IECC. The proposed work has been determined to be an "Alteration-2" as defined by the NYS Code. The elements reviewed for energy conservation include the exterior envelope, fenestration and HVAC System. Exterior Envelope: The exterior envelope includes the roof, ceiling walls and floor. The insulation provided in the design is as follows: Element Existing Proposed Roof Structure Batts—(R-11) Batts—(R-49) New Ceilings Batts— (R-11) Batts—(R-49) New. Walls - Exterior Batts.—(R-11) Batts—(R-15) New - Walls - Interior None Batts—(R-11) New Floors None Batts—(R-30) New Overall Substandard Exceeds Requirements 1 i I find this proposed design for the exterior building envelope to be compliant with the Code. This finding is based upon Code Section C503- Alterations, Item C503.1 General. The design building envelope meets the requirements of this Code Section as follows: - After the Alteration the building will be more compliant with the Code. - After the Alteration the building will use less energy for routine operational needs. - The Alterations do not create any hazardous conditions or overload any building systems - All exposed cavities in the roof, ceiling, walls and floors will be 100% filled with insulation. Fenestration: The fenestration includes the doors and windows throughout all the Cottages. As part of this alteration all the doors and windows are being upgraded. The doors will be Thermatrue or Anderson 400 Series. The windows will be Anderson 200 Energy Star Series. The new replacement doors and windows in the design all have a "u" factor in the range of 0.30 to 0.32. The Prescriptive Section of the Code requires: Windows -to meet Section C402.4 Table C402.4 the "u" factor is 0.45 Doors -to meet Section C402.4.5 Table C402.1.4 the "u" factor is 0.61 The Thermatrue Doors have a"u" factor of— 0.30 (or less) The Anderson 400 Series Doors have a"u" factor of- .032 The Anderson 200 Series Windows have a"u" factor of- .032 I find this proposed design for the fenestration to be compliant with the Prescriptive Code. This finding is based upon Code Section C402.4 and C402.4.5. The design for the window and door replacement meets the prescriptive requirements of the Code. HVAC: The HVAC Systems includes the new "split units" proposed for the cottages. The use of split units will provide a more efficient, highly controllable system for each cottage. The systems provided in the design are as follows: Cottage Conditioned Space Proposed Unit Unit 1 to 8 1- Individual Room ComfortStar Unit— 1.5 Ton Rating 2 I find this proposed design for the HVAC System to be compliant with the 2018 IECC, in particular Section C403.3.2 HVAC Equipment Performance Requirements. This finding is based upon the efficiency ratings and vast operational improvement of the newer systems. The building mechanical system meet the requirements of this Code Section as follows: - After the Alteration the building will be more compliant with the Code. - After the Alteration the building will use less energy for daily operational needs. - The Alterations do not create any hazardous conditions or overload any building systems Lighting: The Interior and Exterior Lighting Systems include all new LED luminaires. The interior lighting proposed for the cottages will be 100% LED, decreasing the amount of energy used, reducing the interior heat load and providing a longer unit life cycle. The exterior lighting proposed for the cottage area meets the code requirement for visibility while conforming to the Dark Sky requirements of Southold Town. The exterior fixtures will be 100% LED, decreasing the amount of energy used and providing a longer unit life cycle. The systems provided in the design are as follows: -After the Alteration the building will be more compliant with the Code. - After the Alteration the building will use much less energy for daily operational needs. - The Alterations do not create any hazardous conditions. The inspection covered the framing for the alteration to the existing structure. The areas inspected included the , first floors and roof of the existing cottage. The framing work included exterior and interior walls, floors ceilings and roof. The inspection results are: Items inspected included lumber type/grade, lumber size, dimensional spacing, framing connections, header sizes, bearing, continuity strapping and integration with the concrete foundation. The framing work was done according to.approved plans and in compliance with the applicable sections of the IRC,NYS and Southold Town Building Codes. The inspection covered the interior plumbing roughing for the Drainage Waste and Vent System(DWV) and the Water Supply System (WS). The inspection results are: 1 —DWV—System was fully exposed and readily viewed. I observed all drainage and vent lines. System constructed as required.New installation is connected to the existing system. All construction was done in compliance with the applicable sections of the IRC, NYS and Town of Southold Building Codes. 2—WS—System was fully exposed,pressurized and readily viewed. I observed all hot and cold water supply lines. System constructed as required. All construction was done in compliance with the applicable sections of the IRC,NYS and Town of Southold Building Codes. Note—The rough plumbing was connected to the existing water and septic systems which are part of the Village of Greenport master system. For your reference as we move forward, I have attached the relevant Chapter 280 Zoning Bulk Schedule and Density and Minimum Lot Size Attachments 1 -4 and the first two pages of the Zoning chapter for a resort Residential RR District. Scope: Phase 1 of the project is to restore the existing 21-unit motel in an RR zone with no additions and the existing fifteen (15) cottages on five (5) separate lots in RR zones with no additions. Although some, or all, of the existing structures may fall within the jurisdictions of Trustees and/or New York State DEC, it is the nature of the proposed improvements that may, or may not, trigger a permit application. JURISDICTIONS AND PERMIT REQUIREMENTS FOR PHASE ONE I. TOWN TRUSTEES a. Tidal Wetlands: within 100 feet landward of tidal wetland boundary or mean high water(MHW) to closest point of either existing or proposed structure. .b. Fresh Water Wetlands: 100 feet from closest point to existing or proposed structure. FINDING: Trustee permit(s) not required where renovation or repair of existing structure (including roof area), where there is no increase to existing footprint. This would apply to both residential and/ or commercial structures. II. NEW YORK STATE DEC a. Tidal Wetlands / HWM: 300 feet landward of either tidal wetland line or HWM, whichever is prevalent and most landward. b. Fresh Water Wetlands: 100 feet from closest point to existing or proposed structure. FINDING: Tidal wetland regulations say "substantial restoration, reconstruction, modification or expansion of existing residential structures located 75 feet or more from most landward edge of tidal wetland or HWM lines does not require a permit. Exception: Does not apply to a commercial building (DEC considers motel a commercial building) within the 300-foot jurisdiction zone. In addition, the structure must be at least 75 feet distance from the tidal wetland or HWM line. If not, a variance request will be required. FINDING: structure within 100 feet of Freshwater Wetland would "most likely" require a permit (unless interior work only) III. SOUTHOLD BUILDING DEPARTMENT AS ORIGINAL INTERPRETERS OF CHAPTER 280 ZONING CODE I submitted the overall site plan and the individual lot surveys along with a request for an opinion to the Building Department as to what, if any, zoning variances may be required for the proposed Phase one restoration plan. I was informed that the proposed work (exterior and interior restoration) does not appear to require any zoning variances for either the residential buildings or the motel. Note: As we previously discussed, the Building Dept. has a policy to the effect that if the total costs of materials and labor exceed 50% of a buildings market value, then it is considered a demolition. This designation would then require the building to be in conformance with Zoning Bulk Schedule and Density Attachments Charts and, if not, file for variance(s). With each building permit application, the only additional requirement would be a submittal of the proposed window schedule. *This will help us bypass the 50% rule SUMMARY TO DATE: From the site plan information we have, it does not appear that the motel is within 75 feet of the HWM, so no variance would be required. But we need to verify that assumption, once Young and Young has updated their survey to include the tidal lines and the flood zone lines. The only permit that appears to be a certainty is a DEC permit for the motel, as a commercial building within DEC's 300-foot jurisdiction zone. Just need the site plan for the motel lot with all the relevant information and distances to file for a DEC permit. Once closure has occurred, I can file within a few days.
