B. SEQRA STATEMENT – 615 PIKE STREET, LLC #8035SE– The Subject Action concerns a
Special Exception to construct a Commercial Building with four (4) retail/takeout units and
basement storage, pursuant to Town Code 280-45B(9). The Town of Southold Planning
Board, as Lead Agency, has determined the Action to be Unlisted and makes a determination
of non-significance for the proposed action and grants a Negative Declaration.
IV. DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS:
MARIANNA AUGUST/BMB HOMES, INC. #8068 – Request for Variances from Article XXIII, Section
280-124 and the Building Inspector’s September 16, 2025 Notice of Disapproval based on an
application for a permit to legalize ‘as built’ alterations to a single family dwelling; at: 1) less than
the code required minimum front yard setback of 35 feet; 2) less than the code required minimum
rear yard setback of 35 feet; located at: 1900 Gillette Drive, East Marion, NY. SCTM No. 1000-38-2-
20.
V. PUBLIC HEARINGS: All testimony shall be limited to zoning issues properly before the Board. Each
speaker is requested to speak for five minutes, and to submit testimony in writing when possible.
10:00 A.M. – MICHAEL DEALY - #8107–Request for a Variance from Article XXIII, Section 280-124
and the Building Inspector’s December 17, 2025, AMENDED February 19, 2026 Notice of
Disapproval based on an application for a permit to construct an accessory in-ground swimming
pool; at: 1) more than the code permitted maximum lot coverage of 20%; located at: 3080 Bayshore
Road, Greenport. SCTM No. 1000-53-6-39.
10:10 A.M. - ST. JOHNS EPISCOPAL CHURCH – FISHERS ISLAND - #8095 – Request for Variances
from Article III, Section 280-18 and the Building Inspector’s November 7, 2025 Notice of
Disapproval based on an application for a permit for a lot line modification; at: 1) proposed lot no.
14 having less than the code required minimum lot size of 40,000 square feet in area; 2) proposed
lot nos. 14 and 16.1 having less than the code required minimum lot depth of 175 feet; 3) cottages

on an application for a permit to demolish (per Southold Town definition) and construct a new
single family dwelling; at: 1) located less than the code required minimum secondary front yard

permit to legalize an as-built hot-tub and a sauna accessory to a single family dwelling; at: 1) both
hot tub and sauna are located in other than the code permitted rear yard; located at: 1415 North

1:10 P.M. - BRAVEPORTER, LLC / JOE IAVARONE - #8048 – (Adj. from December 4, 2025) Request
for a Reversal of the Building Inspector’s June 16, 2025 Notice of Disapproval, or in the Alternative,
a Variance from Article XXIII, Section 280-123A and the Building Inspector’s June 16, 2025,
Amended October 6, 2025 Notice of Disapproval based on an application for a permit to legalize
the “as built” demolition (as per Town code definition) and reconstruction of an existing single
family dwelling and to legalize the “as built” demolition (as per Town Code definition) and
reconstruction of an existing seasonal cottage (converted to year-round use) at: 1) cottage is a
nonconforming building containing a nonconforming use shall not be enlarged, reconstructed,
