SONING BOARD OF APPEALS , i AUG 2015 �� TOWN OF SOUTHOLD i el.(.631) 765-1809•Fax(631)765-9064 FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF AUGUST 20,2015 ZBA FILE# 6871 NAME OF APPLICANT: Emma Van Rooyen PROPERTY LOCATION: 575 Hill Road (adj. to Jockey Creek), Southold,NY SCTM#1000-70-4-29 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply ,dated June 25, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 24, 2015. The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 24,905 (24,063 buildable) square foot water front parcel located in an R-40 zone. The property has 107.41 feet of frontage along Jockey Creek. The parcel runs 226.34 feet on the West side, 105.00 feet along Hill Road, and 244.57 feet on the East side. The parcel is improved with a two story frame house with attached garage, a frame shed, and a wood ramp with attached floating wood dock. All is shown on a survey by Nathan Taft Corwin III L.L.S. dated June 13, 2014 and last revised December 2, 2014. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's June 1, 2015 amended June 15, 2015 Notice of Disapproval based on an application for building permit to construct additions and alterations to existing single family dwelling, at; 1) less than the minimum code required side yard setback of 15 feet,2) less than the code required total side yard setback of 35 feet. RELIEF REQUESTED: The applicant requests variances to make additions and alterations consisting of a proposed deck, pergola, pool, and raised patio that will result in a side yard setback of+/- 10.5 feet and a combined side yard setback of+/-31.5 feet. The code requires a single side yard setback of 15 feet and a combined side yard setback of 35 feet. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 2 ofli—August 20,2015 ZBA#6871—VanRooyen SCTM#1000-704-29 The Zoning Board of Appeals held a public hearing on this application on August 6, 2015 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a waterfront neighborhood which consists of single family homes. The additions and alterations are proposed on the water side of the house and will not be visible from the street. The applicant is requesting the variance so that it may keep the proposed raised patio in a straight line with the house for aesthetic reasons. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could make additions and alteration with a code conforming side yard setback. However, the existing residence already has a non-conforming side yard setback and combined side yard setback. The applicant is requesting a minimal increase to the already non-conforming single side yard setback. 3. Town Law V67-b(3)(b)(3). The variances granted herein for the combined side yard setback is not mathematically substantial, representing 10% relief from the code. The variance granted for the single side yard setback is mathematically substantial representing 30%relief from the code. However, the existing residence has a combined side yard setback of 30.3 feet and the proposed setback of 31.5 feet is more conforming to code than what exists. The applicant's property has a single side yard setback of 10.7 feet. Granting a variance to decrease the single side yard setback to 10.5 feet is a minimal increase. 4. Town Law V67-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law �267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, deck, pergola, and raised patio while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Horning, and duly carried, to GRANT,the variances as applied for, and shown on the survey by Nathan Taft Corwin L.L.S. dated June 13, 2014 and last revised December 2, 2014 and the Architectural plans by Berg Design Architecture dated December 90, 2014 and labeled A00 through A3. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
