LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an accessory apartment in an existing accessory structure, thereby enabling a modest expansion of the accessary apartment from 561 square feet to 697 square feet. The applicant is the Trustee of the Anastasios and Anna Parianos Trust,which owns the property,and is requesting authorization to establish an Accessory Apartment in an existing accessory structure located at 2720 Sigsbee Road,Mattituck,NY. SCTM No. 1999-126-5 13. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 11,032 square foot parcel in the R-40 Zoning District. The northerly property line fronting Peconic Bay Boulevard measure 147.12 feet,the easterly property line fronting Sigsbee Road measures 75 feet,the southerly property line measures 147.33 feet and the westerly property line measure 75 feet. The parcel is developed with a two- story frame dwelling with a roofed covered entry, a roofed rear deck and attached garage, a concrete driveway, a second one-story frame dwelling,and a frame shed, all as shown on the survey prepared by Howard. W.Young,L.L.S., last revised February 7,2024. ADDITIONAL INFORMATION: The application included architectural plans titled"Parianos Renovation,"pages ZBA-01,ZBA-02,ZBA- 03ZBA-4, ZBA-05, and ZBA-06,prepared by Anthony M. Portillo,R.A., dated February 13, 2026. The Southold Town Building Department provided a"Verification of Livable Floor Area"dated March 3, 2026, indicating the proposed accessory apartment will contain approximately 697 square feet and that the improvement will conform to Section 280-13B(13)(a) of the Code. Page 2,March 19,2026 #8087SE Maria Pourbouridis/Parianos SCTM No. 1000-126-5-13 The two-story dwelling on the property is covered by Certificate of Occupancy No. Z 14457 dated June 2, 1986 pursuant to Building Permit No. 11825Z dated July 28, 1982 for a one family dwelling replacing a structure damaged by fire. The parcel was the subject of ZBA Appeal No. 2947 dated April 1, 1982 which granted the applicants permission to reconstruct and locate a second dwelling as existed prior to its destruction by fire. This decision acknowledged the existence of an accessory structure and specified that it not be rented independently of the main structure and that it be used only by family members and guests. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 5,2026 at which time written and oral evidence were presented.Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application,the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13)to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply with all of the requirements for the reasons noted below: 1. The applicant, as Trustee for the Anastasios and Anna Parianos Trust, confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure.The architectural plans prepared by Anthony M. Portillo, R.A., last updated February 13, 2026, propose an accessory apartment with one full bathroom entirely on the first floor of the accessory structure with a conforming 697 square feet of livable floor area, as verified by the Building Department's "Verification of Livable Floor Area" dated March 3, 2026,requested by the ZBA. 2. The dwelling unit complies with the definition of same in §280-4 of the code. 3. The applicant herein, as Trustee for the Anastasios and Anna Parianos Trust, affirms that the Anastasios and Anna Parianos Trust owns the property as documented by a deed recorded May 2, 2013 transferring the property from Anastasios and Anna Parianos to Maria Poubouridis as Trustee of the Anastasios and Anna Parianos Trust. The applicant affirms that Anastasios and Anna Parianos reside at the property as documented by a utility bill identifying service to Anastasios Parianos at 10510 Peconic Bay Boulevard and a utility bill identifying service to Maria Poubouridis at 2720 Sigsbee Road. The applicant confirms that occupancy of the resident structures on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member, as defined in chapter 280-4. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant testified that the tenant of the accessory apartment will be Anthoula Parianos, the daughter of the occupants of the primary dwelling, as evidenced by a signed and dated lease between Maria Poubouridis, Trustee of the Anastasios and Anna Parianos Trust and Anthoula Parianos, and by a copy of the birth certificate for Anthoula Parianos. The owners' plans comply with the on-site parking requirements of three spaces,two for the principal dwelling and one for the accessory apartment, and provide for a total of three parking spaces, as shown on the survey prepared by Howard. W. Young,L.L.S., last updated February 7, 2024 and as confirmed by Board site inspection. 5. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 6. This conversion shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 7. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations,determinations and findings required in Chapters 280-142 (General Standards)and 280-143 (Matters to be Considered)specifically finds and determines the following: a) That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. b) That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. c) That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. d) That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. e) That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. f) Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Steinbugler,seconded by Member Lehnert,and duly carried,to GRANT the Special Exception Permit as applied for, including approval of the plans as submitted which include removal and replacement of the interior walls; maintaining the existing crawlspace, floor system, and some of the load-bearing walls; and raising the ceiling, shown on Architectural Plans(Sheets ZBA-01 thru ZBA-06)prepared by Anthony Portillo,Architect, last revised February 13,2026. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant is to provide the Zoning Board of Appeals with a copy of a completed, signed and notarized lease between the property owner and the tenant,Anthoula Parianos,prior to issuance of the Certificate of Occupancy on the accessory apartment and the associated rental permit. 2. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. The subject property (house or accessory apartment) is not eligible to be rented, outside of the Special Exception permit,as described herein. 5. The sanitary system must be approved by the Suffolk County Department of Health Services. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. Parianos, continued: ) GARY PLANNER OLSEN, ESQ. : At the last meeting that was held on February 26th, it was requested by the board that further information be provided concerning the history of the remaining cottage that' s on the property, as you are aware that previously there were two structures on the property, the main house and the cottage. The main house was destroyed by fire and the applicant is now seeking to reconstruct the main house. I was able to obtain a statement from the prior owner, who is Alma M. Granger, who's now living up in New Hampshire as to the history of the cottage, and she indicates that the small cottage that's still there had originally been a garage and was converted to a cottage with a bath, kitchen, bedroom and living room sometime around 1946. She goes into more specifics in the affidavit and I' ll submit this as part of the record. (Mr. Olsen submitted a two-page affidavit signed by Alma M. Granger and notarized on the 6th day of March, 1982. ) MR. CHAIRMAN: -Thank you. MR. OLSEN: As I've stated at the last meeting, Mr. and Mrs. Parianos are not seeking to have two separate dwellings on the property. They are willing to have the board impose a restriction that the present cottage be utilized strictly as an accessory guest house. Said cottage would be clearly incidental and subor- dinate to the main, principal house which the applicants seek to rebuild. We recognize that the property was zoned for single-family use only; however, it is not to be overlooked that the small cottage is an existing structure which was built prior to the enactment of the zoning ordinance and accordingly, a proper balance must be maintained between the purpose of the zoning ordinance and limiting the area of the single-family usage only, and the rights of the individual owner. As the board is aware, when Mr. and Mrs. Parianos purchased the subject property, it contained the main house as well as the cottage. By agreeing to the imposition of the aforementioned restriction, the character of the neighborhood would be maintained and the net result would be to limit the use of the property by only one family. The applicants understand that by limiting the existing cottage as an accessory building, subordinate to the main house, that it could not be rented to a separate family that I know will be a concern of the board. I also spoke this morning with Roy Reynolds of the Health Department. Last time when we had the last hearing I spoke to Mr. Brigham, who is not in change of the file but because Mr. Reynolds was away but he is now back, and he indicated that he could not foresee any difficulty to obtaining the necessary Health Department permits to rebuild the main house once the Zoning Board of Appeals has approved the issuance of the Building Permit for .the reconstruction of the main house. if there are any questions that you may have, I would be happy to answer them. .
