SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject conforming, irregular-shaped, split-zone(R-40 and Agricultural Conservation [A-C])206,545.98 square feet,4.74 acre parcel measures 100.02 feet along Elijah's Lane and follows a radius of R25.00 feet, L39.76 feet, then continues 181.45 feet along a residentially developed lot to the north and continues around that lot 200.41 feet then runs east 404.00 feet along agricultural lands then runs south 476.96 feet along a second agricultural field, then returns west 428.20 feet along an agricultural parcel also owned by the applicant and then runs north 217.19 feet along a residentially developed lot to the south and continues around that lot west 161.46 feet and follows a radius of R25.00 feet,L 38.76 feet back to the roadway. The lot is improved with a one-story, wood-frame garage, a cargo-box storage shed, two concrete `pads', a small shed, gravel parking area and a dirt and gravel driveway as shown on the survey prepared by Jason D. Leadingham,Licensed Land Surveyor and dated July 18,2024. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-14; and the Building Inspector's November 6, 2025 Notice of Disapproval based on an application for a permit to demolish, (per town definition), and (legalize) construct a new accessory structure (principal use); at: 1) less than the code required minimum rear yard setback of 75 feet; located at: 2184 Elijah's Lane,Mattituck,NY. SCTM#1000-108-3-5.41. RELIEF REQUESTED: The applicant requests a variance for the Town of Southold defined demolition of an existing garage (agricultural storage building) including additions and alterations and the removal of the roof structure to accommodate an increased ceiling height at the garage level and the addition of a full second-story `storage' area measuring 48.1 feet by 24.35 feet accessed by an enlarged entry deck and external stair with an existing rear yard setback of 47.6 feet where the Code requires a minimum rear-yard setback of 75 feet. Page 2,March 19,2026 #8083, Shipman SCTM No. 1000-108-3-5.41 ADDITIONAL INFORMATION: The applicant is the beneficiary of prior Zoning Board of Appeals relief granted under file#7967 dated December 2024, for which a Town of Southold Building Permit,#51662 dated February 19, 2025, was issued. On October 16, 2025, the Zoning Board of Appeals replied to the applicant's October 8, 2025 request for a De Minimus alteration (expansion of a second-floor deck to better accommodate entry/egress via external stair) denying that request. A `Stop Work Order' dated October 31, 2025, was issued by the Town of Southold Building Department during a `final' inspection where it was discovered that the applicant's construction was beyond the scope of the building permit,as issued. The application presently before the Zoning Board of Appeals is for the technical demolition of an agricultural storage building now`as built' and ready for final inspection,barring this application. The applicant provided photographic evidence of rot and other damage discovered during build-out which prompted the deviation from the building permit as filed. The applicant provided architectural drawings including a site plan,existing and proposed floor plans,elevations and sections labeled ZBA-0I through ZBA-04 prepared by Anthony M.Portillo,Registered Architect and dated October 8, 2025. The applicant and their family own multiple and contiguous agricultural parcels. The subject parcel is split-zoned with the majority of the lot located in the Agricultural Conservation(A-C)Zoning District. Only the access point(from Elijah's Lane, located between two existing, neighboring residences) is zoned R-40 Residential District. The applicant has stated that the existing building is not insulated or conditioned and does not contain any plumbing. The prior ZBA decision was amended on January 9, 2026 to allow the structure to contain basic electric service, which is presently in place. The applicant reaffirmed that no habitable space is proposed. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 5,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed technical demolition of an existing agricultural storage building, located in an agricultural zone, will not impact the nature of the immediate community since the structure previously existed in its present location,is surrounded by mature trees/landscaping,and is not visible from the roadway or neighboring residential properties to the west. The alteration to the structure, including an enlarged second floor deck,with a reduced rear-yard setback is not discernable to anyone using the public roadway and while potentially visible from adjacent agricultural lands, is subservient to the farm operation. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of the structure's original siting,with a rear-yard setback of 46.7 feet, where presently 75 feet is required by Code, the applicant has no alternative but to seek relief for any alteration to the structure, including a technical demolition or expansion of an existing deck. Page 3,March 19,2026 #8083, Shipman SCTM No. 1000-108-3-5.41 3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 36.5%relief from the code. However, a one-story structure has existed in this location for many years and the current structure continues in the same location(`as built'), and the addition of a second-floor storage area is common to agricultural buildings within the Town of Southold. Furthermore, the second-floor deck expansion will not be seen from the roadway,neighboring residences or adjacent agricultural properties as a result of mature landscaping. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a`technical demolition' for`as built' additions and alterations to an existing garage (agricultural storage building) including the removal of the roof structure to accommodate a higher garage ceiling height and the addition of a full second-story`storage'area measuring 48.1 feet by 24.35 feet accessed by an enlarged deck and external stair with an existing rear yard setback of 47.6 feet where the Code requires a minimum rear-yard setback of 75 feet, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Steinbugler, and duly carried,to GRANT the variance as applied for, and shown on the architectural drawings including a site plan, existing and proposed floor plans, elevations and sections labeled ZBA-01 through ZBA-04 prepared by Anthony M. Portillo, Registered Architect and last revised October 8,2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The subject agricultural storage building(garage with second-floor storage space)shall remain unconditioned, non-habitable space without the benefit of insulation or plumbing. 2. The small shed illustrated on the survey("to be removed")shall be removed from the subject parcel. 3. The applicant must apply to the Building Department for an amended building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 4. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 5. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Page 4,March 19,2026 #8083, Shipman SCTM No. 1000-108-3-5.41 The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformides under the zoning code. Portillo, Registered Architect and dated June 19,2024. The applicant and their family own multiple and contiguous agricultural parcels. The subject parcel is split-zoned with the majority of the lot located in the Agricultural Conservation(AC)Zoning District. Only the access point(from Elijah's Lane, located between two existing,neighboring residences)is zoned R40. Improvements on the subject parcel are covered by Certificate of Occupancy Z-013021 dated November 26, 1984 covering an Agricultural Building. The applicant has stated that the existing building is not insulated or conditioned and does not have any electric service or contain any plumbing. Furthermore,as part of the alteration and addition to the structure,no electrical or plumbing, or habitable space is proposed. The Town of Southold Planning Board determined on August 6,2024 that site plan approval is NOT required for the proposed second-floor addition to an existing Agricultural Storage Building(garage). Prior to the public hearing,the applicant provided on November 20,2024 communication reiterating and supporting their request for relief from the Code for a reduced rear yard setback; and also included an example of a similar agricultural property to the north of the subject parcel, that contained multiple farm buildings close to the rear lot line. ' No member of the public or an immediate neighbor spoke in favor of or against this application. By letter dated January 2,2025,the applicant's representative requested that the December 19,2024 decision be amended to remove the word "electricity" from`Condition #1; and therefore, allow electricity to be installed in the structure. The representative explained that with the installation of electricity,they wish to add outlets,lights and smoke detectors to the building,not only for working purposes, but for safety. At the January 9, 2025 Special Meeting, the Board members voted unanimously to"Amend Condition #1, to strike the word "electricity". All other conditions shall remain. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5,2024 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&26740)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. However,the structure exists in its present location and the addition of a second-floor storage area is common to agricultural buildings within the Town of Southold. Furthermore, the second-floor addition will not be seen from the roadway,neighboring residences or adjacent agricultural properties as a result of mature landscaping. 4. Town Law 4267-b(3)(b)(4). No,evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(1b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-1b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to an existing garage (agricultural storage building) including the removal of the roof structure to accommodate the addition of a full second-story `storage' area measuring 48.1 feet by 24.35 feet accessed by an external stair with an existing rear yard setback of 47.6 feet where the Code requires a minimum rear-yard setback of 75 feet, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
