SCTM No. 1000-35-6-14 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 15,000 square parcel located in the Residential R-40 Zoning District. The northerly property line measures 100.00 feet, the easterly property line measures 150.00 feet and is adjacent to Maple Avenue, the southerly property line measures 100.00 feet and is adjacent to Osprey Nest Road, and the westerly property line measures 150.00 feet. The property is a corner lot improved with a one-story frame dwelling with an attached garage and a wood deck at the rear of the dwelling as shown on the survey prepared by Robert W. Brown,LS, and dated March 16, 2025. BASIS OF APPLICATION: Request for Variance from Article XXXVI, Section 280-207 and the Building Inspector's May 22,2025 Notice of Disapproval based on an application to construct additions and alterations to an existing single-family dwelling; at 1) gross floor area exceeding permitted maximum square footage for lot containing up to 20,000 square feet in area; located at, 50 Osprey Nest Road,Greenport,N.Y. SCTM No. 1000-35- 6-14. RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations to an existing single- family dwelling. The proposed construction to the existing single-family dwelling, on this nonconforming 15,000 square foot lot located in the Residential R-40 Zoning District, is not permitted pursuant to Article XXXVI, Section A(b), which states; "the gross floor area shall not exceed the permitted square footage calculated as follows: Lots containing up to 20,000 square feet of lot area: 2.100 square feet plus 12.5% of the lot in excess of 10,000 square feet up to a total of 3,350 square feet'maximum." The permitted gross floor area is 2,725 square feet. The applicant applied for a proposed gross floor area of 3,370.8 square feet. Page 2,March 19,2026 98049,Haslbauer SCTM No. 1000-35-6-14 AMENDED APPLICATION: During the hearing,the applicants,were asked to bring the plan into more conformity with the code. The applicants on March 4, 2026, submitted a plan decreasing the proposed GFA(gross floor area) to 2,984.6 square feet bringing the plan into more conformity with the Town Code. ADDITIONAL INFORMATION: At the initial Public Hearing on November 6,2025 the request was to increase the first floor and build a second story of 646 square feet which has now been reduced by eliminating the proposed addition over the garage as shown on the new Site Plan drawings prepared by Mark Kevin Schwartz,Architect and dated February 26,2026. This reduction to the second floor reduces the variance request and the GFA nonconformity. The addition will be within the existing footprint of the dwelling. Examples of nearby dwellings in the neighborhood where the GFA has been exceeded were given to the Board. The,applicants also,indicated that a new Innovative Advanced(I/A)septic system will be installed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 5,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.. The community of Cleaves Point contains varying sized lots, many of which are the same or comparable to the size of the applicants,'that have beeri expanded by adding second- story additions. The subject addition and alterations are very much in keeping with the character of the existing community. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. This parcel is a corner lot and only 15,000 square feet in size. The proposed addition results in excessive gross floor area which requires variance relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein, as amended, is not mathematically substantial, representing 9.5% relief from the code versus the original request of 23.7%. The applicants made every effort to bring the request into more conformity with the code,and the proposed second story addition will be contained within the existing first floor footprint,which conforms to all code required setbacks. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of amended relief is the minimum action necessary and adequate enable the applicant to enjoy the benefit of a second story addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. In the Zoning Board of Appeals(ZBA) determination No. 8049, dated March 19,2026,the applicant was granted variance relief for proposed additions and alterations to an existing single-family dwelling that would exceed the permitted gross floor area. In your letter you explain that while in the process of obtaining a building permit, that it has been determined that the project may now be deemed a demolition by the Town Code definition. r The ZBA relies on the Building Department's expertise to determine whether a project is considered a demolition. The Board, during the May 7,2026 Regular Meeting,has decided that if the Building Department deems the subject structure as a demolition,pursuant to the Town Code definition,that a revised Notice of Disapproval should be issued. This decision is consistent with other denials f6r de minimus requests that we have issued to applicants that were granted relief for additions and alterations and were later determined to result in a demolition. Should you wish to pursue the rebuilding of a single-family dwelling,you will need to apply for variance relief for a demolition with a new application and a public hearing. Specifically, the ZBA granted alternative relief to allow GFA of 2,984.6 SF where the permitted gross floor area is 2,725 SF. As the Board may recall, the Applicants had initially sought relief for- a GFA of 3,370.8 SF to permit a full second story addition to their home. At the first public hearing, the Board asked the Applicants to bring the plan into more conformity with the Code. The Applicants complied and the second story addition was scaled back significantly but there were no changes to the proposed alterations to the first floor. Although that work primarily consists of the reconfiguration of the existing bedrooms and bathrooms, upon further review of the construction plans by the Building Department, a concern was raised that the extent of the work required to complete the first floor construction and to comply the new NYS Energy Code insulation requirements may result in this project being deemed a demolition by Town Code definition. The only variance required and granted was for GFA and the project is otherwise entirely compliant with the bulk schedule. The Applicants, therefore, respectfully request a deminimus amendment to the Determination to acknowledge that the project will constitute a demolition by Town Code definition rather that additions and alteration as initially intended. The subject parcel is a non-conforming 15,000 SF lot in the R-40 zoning district located on the corner of Osprey Neck Lane and Maple Lane in the Cleaves Point Subdivision in Greenport. The project contemplates a 1581 SF second story addition with a small 91 SF addition at the back end of the house and a 57.6 SF front porch enlargement. Although the proposed construction is otherwise conforming to all bulk schedule requirements, the proposed second floor addition will bring the GFA to 3,370.8 SF which is 646 SF above the allowable GFA of 2,725 SF. The surrounding neighborhood consists of one- and two-story homes varying in size on differently sized lots. Many of the homes in the community have GFAs that exceed the proposed GFA here. For the following reasons, the Applicant submits that variances from Section 280-124 are warranted. 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: As stated above, the surrounding neighborhood is characterized by one- story and two-story dwellings on varying sized lots, including larger waterfront parcels as well as substandard 15,000 SF lots like the subject premises. The existing dwelling on this property was constructed in 1974 and is not suitable for the needs of modern family living. The Applicant submits that the granting of the requested GFA variance relief to permit an aesthetically pleasing second floor addition to this home within its existing conforming footprint will not result in any undesirable change in the neighborhood and the renovated home will be entirely in character with many of the surrounding homes in the Cleaves Point community. While the proposed construction is otherwise conforming to the bulk schedule, the size of the parcel and the advent of GFA regulations triggers the need for variance relief for the second story addition. 3. The amount of relief requested is not substantial because: The Applicant submits that while the magnitude of relief sought for side yard relief may be mathematically substantial at 23.7%, it is not practically substantial since there are many homes in the Cleaves Point community with gross floor areas that are substantially larger than what the applicant is proposing here. For example, the house just 2 doors down at 250 Osprey Nest Road was recently constructed with a GFA of 4,205 SF; just around the corner, 600 Snug Harbor Road has a GFA of 5,556 SF and 520 Snug Harbor obtained a variance to maintain a GFA of 4,237 SF (See, ZBA # 7889). In addition, the home at 965 Snug Harbor has a GFA of 4,799 SF and 160 Snug Harbor has a GFA of 4,205 SF. The configuration of the streets in the neighborhood precludes a strict application of the guidelines for averaging but it is apparent that the proposed construction is in character with numerous homes in the surrounding neighborhood where lot widths, areas and the mass of neighboring homes vary substantially. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The granting of variance relief to allow the applicants to create necessary living space in their home will not have an adverse impact on the physical conditions in the neighborhood and will permit the construction of a two story home that is entirely consistent with the size and character of neighboring homes. In addition, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. S. Has the alleged difficulty been self-created?
