SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 11,353 square feet, 0.26 acre rectangular- shaped lot in the R40 Zoning District measures 185.00 feet along Rochelle Place,then runs south 60.00 feet along a residentially developed lot to the east,then runs west 193.43 feet along a residentially developed lot to the south(also owned by the applicant), and then runs 60.59 feet along Bay Avenue back to the intersection with Rochelle Place. The parcel is improvedwith a 1-story wood-frame dwelling, multiple concrete stoops, concrete walkways, and a Bilco basement access, as shown on the survey prepared by Kenneth M. Woychuk, Licensed Surveyor, dated November 12,20118. BASIS OF APPLICATION: Request fo:Variances from Article XXIII, Section 2.80-124; Article XXXVI, Section 207; Article XXXVI, Section 280-2,38 and the Building Inspector's April 28, 2025 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling;at: 1)less than the code required minimum side yard setback of 10 feet; 2) gross floor area exceeding permitted maximum square footage for lot containing up to 20,000 square feet in area; 3) the construction exceeds the permitted sky plane as defined in Article I, Section 280-4-of the Town Code; located at: 50 Rochelle Place, Mattituck, NY. SCTM No. 1000-144-5-1. RELIEF REQUESTED: The applicant requests three (3) variances for alterations and additions to a single-family residence including: 1) A single side yard setback of 0.3 feet where the code requires a minimum single side yard setback of 10 feet; 2)A Gross Floor Area(GFA)of 2,605 square feet where the code allows a maximum of 2,269.1 square feet(335.9 square feet greater than allowed); 3)Penetration of the sky plane to accommodate a second floor where the structure is to remain within the profile established by the sky plane. Page 2,March 19,2026 #8046,Jeffcoat/Visceglia SCTM No. 1000-144-5-1 ADDITIONAL INFORMATION: The applicant provided drawings including site data, site plan, existing and proposed elevations, sky plane analysis, and existing and proposed foundation and floor plans, labeled T-1, S-1, S- 2, and A-1 through A-8,prepared by James J.Deerkoski,Licensed Professional Engineer, dated July 11,2025. The applicant owns the adjacent house located at 2795 Bay Avenue. The public hearing was held on October 2,2025 and adjourned to January 8,2026 which was adjourned to March 5, 2026. The applicant dispelled Board concern that the proposed alterations and additions could potentially become a town defined `demolition'. The applicant was made aware to halt any work that exceeds the scope of work granted in this application. Numerous letters of support for this application were received by the Board of Appeals from the applicant's immediate neighbors, FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 2,2025 and March 5,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is located just off of Bay Avenue,a major residential roadway leading from the hamlet of Mattituck commercial center to the Peconic Bay. The immediate neighborhood was developed over the past 125 years with a variety of housing stock and styles all on lots varying in size. Additionally,the subject premises, located on Rochelle Place, is the `gateway' to Salt Lake Village, a private bayfront community with shared resources. Homes in Salt Lake Village, like the Bay Avenue area, are on varying lot sizes and are of varying age, size and design, including larger bayfront residences. Both communities contain homes with second floors. The proposed alterations will create an aesthetically pleasing alternative to the dated ranch-style home with pre-existing setbacks that the applicant does not propose to encroach on. Granting the requested side yard, sky plane, and gross floor area(GFA) variance relief to permit the renovation and addition of second floor living space within its pre-existing,non-conforming footprint will not result in any undesirable change in the neighborhood and the renovated home will be in harmony with many of the surrounding residences on Bay Avenue and Rochelle Place. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The applicant is seeking the benefit of expanded and upgraded living space. While they are proposing to renovate the residence substantially within the existing non-conforming footprint,the advent of GFA regulations and the pre-existing,non-conforming side yard setback trigger the need for variance relief. There is no way to construct a second-floor addition to this home within the sky plane with a 0.3 feet existing side yard setback. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 97%relief from the code relative to a reduced side yards setback of 0.3 feet; 14.8% relief from the code relative to excessive GFA of an additional 335.9 square feet of living space; and 100%relief from the code relative to the penetration of the sky plane. However, the magnitude of the side yard setback, as existing, is not practically substantial since the construction is confined to the existing footprint. The sky plane relief is mitigated by the applicant's ownership of the adjacent parcel and location of the residence on it, significantly south of the common boundary line; this is the only home that could potentially be impacted by the penetration of sky plane. While the GFA relief sought can be Page 3,March 19,2026 #8046,Jeffcoat/Visceglia SCTM No. 1000-144-5-1 construed as being substantial,as a result of larger homes within the Salt Lake Village community and on the eastside of Bay Avenue, the proposed GFA will not appear excessive and will maintain the character of the surrounding community where, as a result of lot width/depth and lot area,the size of area homes varies substantially. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and has indicated that they will upgrade and install an innovative and alternative wastewater treatment system(I/A). 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions to a single family residence,including the addition of 335.9 square feet in excess of the allowable GFA,penetration of the sky plane to allow the addition of a partial second floor and maintaining a side yard setback of 0.3 feet, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried,to GRANT the variances as applied for, and shown on the site plan, existing and proposed elevations, sky plane analysis,and existing and proposed foundation and floor plans,labeled T-1, S-1, S-2,and A-1 through A-8,prepared by James J.Deerkoski,Licensed Professional Engineer, dated July 11, 2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall install a new Innovative Advanced (I/A) sanitary system as voluntarily offered during the public hearing. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity, provided de minimis relief is requested within one year of the date of this decision. Any time after one year,the Board may require a new application. IMPORTANT LIMITS ON THE APPROVAL(S)GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. The subject parcel is a non-conforming 11,353 SF lot in the R-40 zoning district located on the corner of Rochelle Place and Bay Avenue in Mattituck. The lot is only 60' wide and therefore non- conforming in width and the house sits off center on the parcel such that a portion of its footprint lies just .3 feet from the side property line. The project contemplates an 837 SF second story addition with a small upper-level balcony at the back end of the house and open porch additions on the lower level. The proposed footprint would maintain the pre-existing non- conforming side yard setback of .3 feet where a 10-foot side yard setback is required under Town Code Section 280-124 on lots measuring up to 20,000 square feet in total size. This nonconformity makes compliance with the sky plane regulation impossible, thereby necessitating relief from the requirements of Section 280-208. The proposed construction is otherwise conforming to the front, rear and combined side yard setback requirements in Section 280-124. Although the proposed construction is conforming to the required lot coverage, the proposed second floor addition will add 837 SF bringing GFA to 2,605 SF which is 335 SF above the allowable GFA of 2,269 SF. The surrounding neighborhood consists of one- and two-story homes varying in size on differently sized lots. Rochelle Place is the gateway to a community of larger waterfront homes and many of the homes on the east side of Bay Ave in the vicinity of the subject premises have been significantly enlarged and renovated. In contrast, the west side of Bay Avenue is characterized mainly by smaller dated homes, which, similarly to the Applicant's home, require renovation. It is noteworthy that while the west side homes are currently smaller thanDAvenue Applicant's proposed home, the average of the allowable maximum G those homes is 3,056 SF. The average of the existing GFAs for the ho the east side of Bay Avenue is 2,812 SF (207 SF more than the propo the average of the allowable GFAs for the homes on the east side of B is 4,998 SF. For the following reasons, the Applicant submits that variances from Section 280-124 are warranted. Received 1. The existing dwelling on this property is an eyesore in desperate need of renovation. The Applicant submits that the granting of the requested side yard, sky plane and GFA variance relief to permit an aesthetically pleasing second floor addition to this home within its pre-existing, non-conforming footprint will not result in any undesirable change in the neighborhood and the renovated home will be entirely in character with many of the surrounding homes along Bay Avenue and Rochelle Place. It is noteworthy that the Applicant also owns the adjacent parcel to the south and therefore the side yard relief will be of no detriment to that property. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The Applicant is seeking the benefit of expanded and upgraded living space to meet the needs of 21St-century living. While they are proposing to renovate the residence substantially within the existing non-conforming footprint, the advent of GFA regulations and the pre-existing non-conforming side yard setback trigger the need for variance relief. There is no way to construct a second-floor addition to this home within the sky plane with a .3' side yard setback. 3. The amount of relief requested is not substantial because: The Applicant submits that while the magnitude of relief sought for side yard relief may be mathematically substantial, it is not practically substantial since the construction is confined to the existing footprint. The sky plane relief is mitigated by the Applicant's ownership of the adjacent parcel and location of the structures thereon significantly south of the common boundary line. As for GFA, the Applicant submits that the 14.8% relief requested is not substantial since the proposed GFA is well within the average of the existing and allowable GFAs on homes on the east side of Bay Avenue and the proposed construction is in character with the surrounding neighborhood where lot widths, areas and the mass of neighboring homes vary substantially.
