Box 1179 ' 54375 State Route 25 Southold, NY 11971 (cor.Main Rd. &Youngs Ave.) Southold, NY 11971 ® Telephone: 631 765-1938 cou LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Glenn Goldsmith, .President Town of Southold Board of Trustees Cc: Honorable Lori Hulse, Attorney From: Heather Lanza, AICP, Planning Director LWRP Coordinator Date: December 1'6, 2025 Re: LWRP Coastal Consistency Review PETER STEIN & ALLISON KRONICK STEIN, SCTM# 1000-40.-1-18 This application is to demolish and remove the existing dwelling, foundation, wood decks, wood fence, low stone wall, and stone path; construct a new 3,135 sq. ft. two- story dwelling that includes a 16.2'x10.10' covered porch, a 21'x4.6' northwest covered porch; a 5.5'x8.3' front deck, 5.1'x9.2' front entrance steps, 51.8'x10.1' at grade patio, 38'x2' wood steps, 15.5'x4.5' and 12.4'x4.4' second story balconies; install a new permeable gravel driveway; install a new I/A sanitary system landward of dwelling; any excavated fill to be graded out on the landward side of the property; existing 15' wide non-turf buffer; and to remove three (3) trees and replace with three (3) native hardwood trees. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The plan includes property improvements that are inconsistent with the requirements of Chapter §268 Waterfront Consistency Review based on re-building of a residence less than 100' from the wetland boundary. However, the portion of the proposed work that includes installation of a new I/A system to treat septic is consistent with §268 Waterfront Consistency Review: Policy 5. Protect and improve water quality and supply in the Town of Southold. 5.1 Prohibit direct or indirect discharge that would cause or contribute to contravention of water quality standards. C. Ensure effective treatment of sanitary sewage and industrial discharges by: 3. Modifying existing sewage treatment facilities to provide improved nitrogen removal capacity. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 Town of Southold LWRP CONSISTENCY ASSESSMENT FORM SEP 15 2025 SOUTHOLD TOWN A. INSTRUCTIONS PLANNING BOARD 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed .action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listintz both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions,it shall not be undertaken.
