B. ROBINSON REVOCABLE LIVING TRUST, SCTM# 1000-135.-3-37 This application is to remove remnants of existing dock and construct a new dock off bulkhead consisting of a 4'x45' long fixed dock using Thru-Flow decking with a 3'x14' aluminum ramp to a 6'x20' floating dock with untreated decking situated in an "L" configuration and secured with two (2) 10" diameter CCA piles. The proposed action has been reviewed to Chapter§268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Since there is no existing dock on this property this does not represent a reconstruction of an existing dock and instead constitutes constructing of a new dock with is counter to Effective November 6, 2025 Town Code §275- 11 "Construction and operation standard" was altered to include the following language: C. In water. The following standards are required for all in -water operations adjacent to residential properties. Operations conducted on properties zoned M1 or M2 may be given greater flexibility in these requirements given the water -dependent nature of their use. (2) Docks b) Dock locations and lengths. 3] Prohibited locations and activities. a] No new docks utilized for residential purposes shall be permitted on the Great/Little Peconic Bay, Pipes Cove, Southold Bay. Gardiners Bay, Shelter Island Sound, Hog Neck Bay, Orient Harbor, Hallocks Bay or Long Beach Bay with the exception of Fisher's Island and Robin' s Island. No new docks will be permitted on the Long Island Sound or in the following areas: Downs Creek, Hashamomack Creek, Long Creek (branch of Mattituck Creek, East of Grand Avenue bridge), Pipe's Cove Creek, West Creek, Laurel Lake, Marion Lake. Maratooka Pond, Husing Pond, Lilly Pond. Great Pond, Inlet Pond, Hashamomack Pond and Dam Pond. For this reason, a dock is not permitted at the proposed location.
