The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: 5.1 Prohibit direct or indirect discharge that would cause or contribute to contravention of water quality standards. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The plan includes property improvements consistent with existing setback requirements of Chapter 275-2 A. "Definitions" of the Wetlands Law of the Town of Southold. In addition to this, the proposed work includes removal of a pre-exsting paver patio and retaining walls that are currently within 75' of the tidal wetland boundary. Removal of a portion of an existing paver driveway and replacing this with gravel, the addition of more drywells to capture rainwater and the installation of a new I/A septic system are additional improvements which will help protect water quality. Conditions to consider: While the proposed plan calls for installation of an "I/A OWTS sanitary system on the west side of the dwelling", the site plan does not provide any details and-instead shows a narrow area in the side yard identified as "proposed septic system location by others". The plans for this system should be detailed before final approval as it is not clear that an I/A system will fit in the area identified, and if this is not the case, where will the system be installed? The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 Town of Southold LWRP CONSISTENCY ASSESSMENT FORM A. INSTRUCTIONS 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si in�ficant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions,it shall not be undertaken.
