The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is CONSISTENT with the LWRP as follows: Policy 4.1. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The proposed pool is located as far from the Special Flood Hazard Area as practical. There is a pool drywell proposed, and an existing 30' non-disturbance buffer that is required to remain by Planning Board covenant on a filed subdivision map, both of which help make the project consistent with Policies 5 and 6 by helping to protect water quality and protecting coastal habitat. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS PLANNING BOARD 1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable The proposed patio would be constructed at grade level,and the pool would be constructed in-ground but elevated above the groundwater table.A pool drywell and pool equipment would be installed more than 100 feet from wetlands and thus outside Chapter 275 jurisdcition;and a project-limiting silt fence would be installed between the work site and shoreline to control and contain site disturbance and potential runoff during construction.And the existing covenanted 30-foot wide non-disturbance/non-fertilization would be maintained adjacent to the wetlands boundary,continuing to provide a sink an filter for stormwater runoff and any chemicals potentially contained therein.Therefore,consistent with the goals of LWRP Policy 5,the project would protect the quality of groundwater and surface waters of Town Creek.
