The application referenced above is to construct a new 16'x32' in-ground pool with a
one (1) foot surround (512 sq. ft.); install pool enclosure fencing with gates, a pool
drywell, and a pool equipment area; and to establish and perpetually maintain a 30'
wide non-disturbance buffer area along the landward edge of the top of the bluff with a
4' wide access path to bluff stairs.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposal is CONSISTENT with LWRP
Policy 4.1, to minimize potential loss and damage by locating development and
structures away from erosion hazards. Although the proposed pool is only 82.3' from the
top of the bluff, a 30' non-disturbance buffer has been established, and therefore, the
action can be found CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS PLANNING BOARD
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3: If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listinLy both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.

Proiect Description for Grover & Mazzarino Pool Construction
The Trustee's issued permit# 10020 on October 20, 2021 to:
1) Construct a new in-ground swimming pool
2) Demolish and rebuild an existing, single family home
3) Install a new I/A septic system
After receiving the permit, the owners determined that the costs of demolishing and
constructing a new home exceeded their budget. So the existing home was renovated/ updated
with only a new screened porch and a new pool being constructed. A new application was
made to the Trustees for the screened porch, and was granted. The pool, however, was
constructed under permit# 10020.
The language issued by the Trustees in permit# 10020 should be copied and repeated in the
new replacement permit that only addresses the new pool without the new home and new
septic system language;to wit:
"Wetland permit to (home demo and rebuild deleted) construct a new 16' x 32' in-ground pool
with (1)foot surround (512 sq-ft)with pool enclosure fencing and pool drywell (new I/A OWTS
.septic system deleted) with the condition to establish and perpetually maintain a 30'wide
non-disturbance buffer landward of the top of the bluff; and as depicted on the survey
prepared by Peconic Surveyors P.C., last dated October 18, 2021,and stamped approved on
October 20, 2021:'
It should also be noted that the property owners were also issued another Trustee permit to re-
build a rock revetment at the base of the steep slope that fronts along Long Island Sound. This
permit required that a covenant be filed to "establish and maintain a vegetated 15' wide "non-
turf buffer" inclusive of the berm (with no substitution of sand or stone) at the top of bluff."
This covenant conflicts with the new house/ new pool covenant contained in permit# 10020.
Both Elizabeth and Tom in the Trustee's office were made aware of this conflict, and they
advised that no covenants be filed until the matter can be sorted-out. So the Trustees will have
to decide which covenant should be applied to the property so it can be properly filed. Given
that a new home was not constructed and only a new screened porch built that is only slightly
larger than an existing patio it replaced, the owners believe that the 15 foot buffer is the
appropriate covenant. This will conform to all the other adjacent properties on The Strand. If
the Trustees agree, then the new covenant language on the pool permit would be as follows:
