been disconnected and removed off the building structure that is located on the property.
Please note that there may still be PSEG LI facilities located within the property boundaries
and that NYS law(NYCRR Part 753)requires all contractors to call for a utility locate (NY

Dear Adam Prestandrea:
Based on the information you submitted the Department of Environmental Conservation
has determined that the existing bulkhead shown on the survey by Kenneth M.
Woychuk, dated December 11, 2019, is functional, more than 100 feet in length and
was constructed before August 20, 1977, as shown on Tidal Wetlands Map# 718-546
and AeroGraphics Exposure#73-2048. Therefore, the property landward of the
bulkhead is beyond Tidal Wetlands Act (Article 25)jurisdiction and no permit is required
for work landward of this structure.
Be advised, no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a
permit. It is your responsibility to ensure that all precautions are taken to prevent any
sedimentation or disturbance within Article 25 jurisdiction which may result from your
project. Such precautions may include maintaining adequate work area between the
jurisdictional boundary and your project (i.e. a 15' wide construction area) or erecting a
temporary fence, barrier, or hale bay berm.
This letter shall remain valid unless site conditions change.
Please note that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies or local municipalities.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, January 17, 2024:
WHEREAS, En Consultants, on behalf of PECONIC RIVER, LLC applied to the Southold Town
Trustees for an Amendment to Wetland Permit#9930 under the provisions of Chapter 275 of
the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated
December 26, 2023, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,

found Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, the LWRP Coordinator recommended that the detached deck be found Inconsistent
with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy of the Local Waterfront Revitalization
Program to the greatest extent possible through the imposition of the following Best
Management Practice requirements: deck location will no longer be seaward of flood zone, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 17, 2024, at which time all interested persons were given an opportunity to be heard,
and,

WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management Practice
requirement imposed above, the Board of Trustees deems the action to be Consistent with the
Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code,
and,
BE IT FURTHER
RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit#9930
for a revised site design that results in a reduction in the combined structural footprint of the
proposed dwelling, deck and pool, specifically to demolish existing two-story, 2,300 sf, FEMA-
noncompliant, single-family dwelling with 460 sf attached deck and 761 sf detached garage, and
construct new 1 and 2-story, 2,576 sf, FEMA-compliant, single-family dwelling with a 2.3' x 29.1'
easterly roof overhang, 6.1' x 17'4 and 15.5' x 20' covered porches and steps, 4.9'x 10.6' and 5'
x 12.8' areaways, 17' x 40' swimming pool (equipped with saltwater filtration system), 1,293 sf
attached deck with steps and, on top of deck, 5.8'x 6.5' enclosed seasonal bathroom, 4' x 5.5'
outdoor shower, and 6.5' x 10.8' trellis over outdoor bbq; remove existing nonconforming septic
system located +42' from bulkhead, and install new I/A OWTS sanitary system more than 100
feet from bulkhead; install a drainage system of drywells to collect and recharge roof runoff and
pool backwash; install new pervious gravel driveway and parking areas; install 4' high pool
enclosure fencing, pool equipment/heat pumps, generator, and 500 gal underground propane
tank; remove specified trees located no closer than +69 feet from bulkhead; and establish 27' to
39' wide, approximately 5,959 sf vegetated buffer area adjacent to bulkhead, consisting of
approximately 4,259 sf embankment and approximately 1,700 sf area up to 10 feet landward of
top of bank and retaining wall; and as depicted on the site plan prepared by DiLandro Andrews
Engineering, last dated December 14, 2023, and stamped approved on January 17, 2024.

Dear Mr. Herrmann:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, June.15, 2022.
RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit#9930 for the landward relocation and reduction in size of the
approved dwelling and swimming pool, specifically to demolish existing two-story, 2,300 sf,
FEMA-noncompliant, single-family dwelling with 460 sf attached deck and 761 sf detached
garage, and construct at least +27 feet farther landward a new 1 to 2-story, 2,350 sf, FEMA-
compliant, single-family dwelling with 16 sf and 17 sf entry porches, 1,402 sf attached pool deck
with 4.7' x 14'steps and associated retaining walls, 681 sf swimming pool (equipped with
saltwater filtration system), and 669 sf attached north deck; remove existing nonconforming
septic system located +42'from bulkhead, and install new I A OWTS sanitary system outside
Chapter 275 jurisdiction; install a drainage system of drywells to collect and recharge roof runoff
and pool backwash; install new pervious gravel driveway and parking areas; remove specified
trees located no closer than +69 feet from bulkhead; and establish a 27' to 39' wide,
approximately 5,959 sf buffer area adjacent to bulkhead, including existing 4,259 sf naturally
vegetated embankment and additional 10'wide, +1,700 sf non-turf buffer in place of existing
lawn along top of bank; and as depicted on the site plan prepared by Kevin O'Sullivan &Assoc.,
LLC, last dated June 10, 2022 and stamped approved on June 15, 2022.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the
deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of
issuance of this permit.
