En-Consultants on behalf of MARDIK DONIKYAN requests a Wetland Permit to demolish
the existing one-story dwelling and masonry patio; construct a two-story, 1,645sq.ft. single-
family dwelling with attached 16sq.ft., 80sq.ft. and 435sq.ft. porches with associated steps,
a second-story 15'x15' covered roof deck, a second story 10'x20' roof deck, basement
stairs and window wells for egress; construct a 10'x30' in-ground swimming pool with hot
tub; install a pool drywell and pool equipment area; install 1,160sq.ft. grade-level masonry
pool patio; a 12'x12' shed; a 4'x8' outdoor shower; install 4' to 6' high pool enclosure
fencing with gates; install a/c units and a generator, remove existing septic system and
install an I/A OWTS sanitary system landward of new dwelling; install a stormwater
drainage system; fill an approximately 520sq.ft. area of recessed driveway with on-site soil
material to match surrounding grades; and to establish and perpetually maintain an 18' to
22' wide vegetated non-turf buffer along the landward edge of the retaining wall (minimum

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of
the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted to this department, as well as the records available to me, it is
my recommendation that the action is INCONSISTENT with Policies 4 and 6.3 of the
LWRP.
Permanent, non-movable structure is located adjacent to the CEHA. Expansion of
structure is vulnerable areas subject to wind and erosion caused by storms is not
supported by this policy.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS
l, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town)
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

Hazard Area,would replace a dwelling located approximately 28 feet from the top of bank with a dwelling located a minimum of 62

Consistent with the standards for issuance of a Town wetlands permit set forth by Town Code Section 275-12,
the proposed replacement of an existing dwelling with a new dwelling and swimming pool would not adversely
affect Town wetlands but should in fact have a net beneficial impact on the environmental condition of the
property and adjacent tidal waters of Long Island Sound. Specifically, as a result of the below described design
elements and incorporated mitigation measures, the project would result in increased vegetated buffers and
separation distances between structures and the adjacent natural resources; potentially reduced runoff and
improved runoff quality; and potentially improved groundwater and surface water quality, thus also furthering
the respective LWRP Policy 5 and 6 goals of protecting and improving water quality, and protecting and
restoring the quality and function of Town of Southold ecosystems.
A) Project Design
1) The project,which is located entirely within a FEMA-designated Flood Zone X and landward of the
Coastal Erosion Hazard Area, would replace a dwelling located approximately 28 feet from the top
of bank with a dwelling located a minimum of 62 feet from the top of bank, more than twice the
existing setback; and replace a patio located 17 feet from the top of bank with a patio located at least
47 feet from the top of bank,almost three times the existing setback. The proposed swimming pool
will be located at least 50 feet from the top of bank, compliant with Town Code Section 275-
3(1))(1)(a)(5). The project will thus also further the LWRP Policy 4 goals of protecting and
minimizing potential loss from flooding and erosion on a property that is also well protected from
such risks by an existing bulkhead and retaining wall, which stabilize the embankment facing Long
Island Sound.
2) The existing dwelling, which is located just seaward of the "pier line" established by the closest
neighboring dwellings to the west and east—and substantially seaward of the pier line that would be
created by the construction of the proposed dwelling on the westerly adjacent property (see Town
Wetlands Permit No. 10047)—would be replaced by a dwelling located significantly landward of
both the existing and potential pier lines, compliant with Section 275-11(A)(3).
B) Mitigation Measures
1) The existing conventional and nonconforming septic system,which is located less than 100 feet from
the top of bank,would be removed and replaced with a low-nitrogen, innovative/alternative sanitary
system (I/A OWTS) located more than 100 feet from the top of bank. Unlike conventional septic
systems, I/A OWTS sanitary systems are designed to significantly reduce nitrogen loading into the
groundwater table.
2) A stormwater drainage system consisting of leaders, gutters, and drywells is proposed to collect and
recharge roof runoff, and a separate drywell is proposed for pool backwash.
3) An 18-ft to 22-ft wide vegetated non-turf buffer would be established and perpetually maintained
landward of the existing retaining wall (minimum 15 feet landward of top of bank), thereby
additionally mitigating surface water runoff and creating a sink and filter for excess nutrients
potentially contained therein before reaching the embankment and the surface waters of Long Island
Sound.
4) A project limiting fence would be installed to contain site disturbance and potential surface runoff
during construction.
